Ilya Massukh listed main advantages and shortcomings of import substitution policy in the field of the software. He carried the following to minuses:

- active technology cooperation of the Russian vendors;
- growth of the domestic radio-electronic industry.
Ilya Massukh said that directives on transition to the domestic software which were approved in 2016 begin to work only by the end of the 2019th. State companies understood that the government will not cancel a task of drawing up the corresponding plans till 2021, he specified.
In Voskhod will earn the stand for testing for compatibility of the softwares different configurations for government employees

The Russian software makers asked 70 billion rubles on import substitution
On September 17, 2019 it became known that the Russian software makers estimate import substitution of software in state bodies more than at 70 billion rubles.
Developers asked state support for implementation of the Russian software instead of foreign, Vedomosti with reference to the presentation of the working group on information security of the Digital Economy program reported.
The working group selected several classes softwares which need additional support:
- operating systems;
- office applications, search systems, browsers and communication software;
- database management system (DMS);
- management systems for the enterprises and so forth.
For each of classes in the presentation examples of the companies which make such software, and means which can be necessary are given.
Money, in particular, is offered to be spent for development of products, for user training, for financing of their purchases by government institutions.
Developers of operating systems asked 25.5 billion rubles for 2019-2024. They want to transfer to domestic software about 5 million jobs and to earn from export of the OS up to 1 billion rubles a year.
Developers of office applications, searchers, browsers and communication softwares asked more than 1.5 billion rubles for 2019-2022. These means are supposed to be let to subsidies to developers and for creation of the systems of risks insurance of users at implementation of domestic software.
On DBMS, according to the presentation, 1.8 billion rubles till 2022 are required. These are, first of all, subsidies, compensation of costs of state companies on Russian software and personnel training. If to put all requests for different classes softwares, the amount about 70 billion rubles turns out.
RUIE will be engaged in localization of foreign software for inclusion in the register of domestic software
At the beginning of July, 2019 it became known that the Russian Union of Industrialists and Entrepreneurs (RUIE) will be engaged in localization of the foreign software. The working group on import substitution of software in state companies is for this purpose created.
The working group will be created at committee on digital economy of RUIE which is headed by the president of Rostelecom Mikhail Oseevsky. Representatives of state companies which are members of RUIE will enter it generally. Participation in work of representatives of the Ministry of Telecom and Mass Communications, FAS and other departments is planned. According to Kommersant, RUIE sent to the Domestic Software association of software developers (ASD) the letter in which reported that upon transition to the Russian of software of state company also write-offs of old IT systems incur double expenses because of implementation new.

RUIE suggested ARPP to enter into alliance and "take active part in development of the consolidated position of the Russian business on import substitution of software".
The Russian producers complained more than once that customers still actively buy foreign software, notes the edition. Localization of those classes of software where there are domestic analogs, can destroy the Russian developers, the managing director of Rosplatforma company Vladimir Rubanov considers.

The share of the Russian software in purchases of state agencies reached 65%
On April 24, 2019 it became known that the share domestic software in purchases state agencies makes 65% while in 2015 it reached only 20% for April, 2019. Such data the deputy head brought Ministry of Telecom and Mass Communications Alexey Sokolov.
By calculations of the Ministry of Telecom and Mass Communications, by 2024 the share of the Russian software will be brought to 90% in purchases of state agencies, and to 70% — in purchases of state companies. The indicator at the level of not less than 45% is planned for 2019 for state companies.
The ministry also gave up-to-date data about the Register of domestic software which conducts since 2016 — for April, 2019 there are more than 5.2 thousand software products in 24 different classes.
In April, 2018 the previous Minister of Telecom and Mass Communications Nikolai Nikiforov reported that the share of the Russian software in purchases of federal state agencies for lifetime of the register increased from 20% to 65%. The polled representatives of the market expressed then no confidence to reliability of these data.
According to Sokolov, a certain progress in transition to the Russian of software it was succeeded to achieve the Russian Railway. At state company the permanent coordinating body which is directed by the Minister of Telecom and Mass Communications Konstantin Noskov was created. Also IT strategy was finished, besides, the government approved the plan of phased transition of the company for domestic architecture, and the Russian Railway is already engaged in implementation of this plan.
The ministry also notes that state companies asked to create the interdepartmental working group in the field of import substitution of software. In group there will be four sections – finance, transport, power and the industry.
According to Sokolov, import substitution is implemented also in the field of state procurements of telecommunication equipment. For April, 2019 there is already on interdepartmental approval a draft resolution of the government which will limit state procurements of foreign radio-electronic products. Software which is a part of such products should be in the Register of domestic software.
Also the authorities intend to publish the directives ordering to buy mainly Russian telecom equipment during creation of IT infrastructure at the expense of the state budget. For example, the list of the equipment necessary for connection of socially important objects to the Internet, includes 419 names. The list is already prepared the Ministry of Telecom and Mass Communications and Minpromtorg, with quantitative breakdown by years and technical characteristics.
The bill of independence of the Russian developments based on third-party software
The software products processed on the basis of third-party software will be able to be considered as independent solutions. On January 25, 2019 reported about it to TAdviser in ANO Tsifrovaya ekonomika. The relevant bill was approved by the working group on normative regulation which meeting took place on January 23 on the platform of the Ministry of Economic Development of the Russian Federation.
According to developers of the bill (competence center on normative regulation of the Digital Economy national project of Skolkovo Foundation), the Russian legislation still accurately does not differentiate the moment when the derivative work purchases independence and does not depend on a will and desire of the initial owner of initial software.
According to the offered bill, at signing of the contract, the providing right to use of the computer program or the database by processing, the parties of such agreement have the right to point to degree and characteristics of changes at which the result of product modification will represent new independent subject of copyright and also the moment of creation of such object. Are obliged to provide a procedure of the exclusive right to the created independent subject of copyright after termination of the contract in such agreement of the party.
At the request of the owner materials of the request for state registration of the computer program can include audiovisual displays of such program and the description of the program containing features of its functioning.

Rostelecom will prepare the plan of transition for Russian software

State corporations obliged to pass on Russian software by 2022
On December 17, 2018 it became known of requirements of Russian authorities concerning transition of the largest state companies to the domestic software. By 2022 at them more than a half of software should be Russian.
According to Kommersant, the first Deputy Prime Minister Minister of Finance Anton Siluanov approved directives for state companies from list No. 91-r about transition to "primary use" of the Russian software products. It is about such companies as Aeroflot, Gazprom, Sheremetyevo, Rosneft, the Russian Railway, Channel One, Rusnano, VTB, etc.
According to the directive of state company should approve the plan of transition to the Russian software within two months: till 2021 its share should exceed 50%. It is necessary to select programs from the register of the domestic software.
Plans will need to be approved with Competence center on import substitution in the field of information and communication technologies. Software will be separated into classes, and in three years more than a half of products in each of them should be Russian. The exception is possible if the state company proves that there is no analog in Russia, the director of the center Ilya Massukh says.
By its estimates, in segments of anti-virus and accounting solutions over a half of the market occupy the Russian products. At the same time their presence at segments of office software, management of databases and ERP systems is measured less than 20%.
The source in Aeroflot told Vedomosti that not all organizations are ready to such changes. According to him, urgent import substitution can negatively affect revenues of the company and reduce its competitiveness.
State companies, as well as authorities, are interested in that their IT systems continued to work, import substitution requires serious changes, and it "time, money and responsibility", the head of BaseALT company Alexey Smirnov notes.
Plan and beginning of the pilot for transition of federal agencies to cloud accounting of 1C

The government approved centralization of purchases of the office software and cybersecurity solutions for federal authorities
On June 13, 2018 on the official portal of legal information the resolution Governments of the Russian Federation "About the centralized purchases of office software, software for conducting budget accounting and also the software in the field of information security" is published. According to the resolution, powers on purchase of the office software and cybersecurity solutions for federal executive authorities, management of which are performed by the Government of the Russian Federation, are assigned to the Ministry of digital development, communication and mass communications. The Federal Treasury will be responsible for acquisition of the software for conducting budget accounting.
By the document it is established that requirement for implementation of purchases regarding office software and the software in the field of information security in III and IV quarters 2018 is defined in the amount of, not less than respectively 15 and 20 percent of measures and indicators of efficiency of transition of the federal executive authorities to use of the domestic office software set for 2018 by the corresponding scheduled plans.
The approved resolution also defines that office software is understood as the office suite, email applications, an organizer, preview players, the Internet browser, the editor of the presentations, the tabular editor, the text editor, data on whom are included in the unified register of domestic software. The software in the field of information security is understood as software, conforming to requirements of the legislation of the Russian Federation in the field of information security support and belonging to the class of "an instrument for ensuring of information security". The software for conducting budget accounting is understood as the software providing automation of the functions necessary for conducting budget accounting in accordance with the legislation of the Russian Federation.
Federal executive authorities, according to the document, should provide transition till January 1, 2020 to conducting budget accounting using the software provided to them based on the purchases provided by this resolution.
Till 2020 works on ensuring software compatibility of information systems of federal executive authorities with office software and the software in the field of information security of not less than 2 different owners should be carried out.
Also till 2020 terms of implementation of transition of federal executive authorities to use of domestic office software are prolonged.
Ilya Massukh: Transition of state companies to domestic of software should start in 2018

Minister of Telecom and Mass Communications N. Nikiforov: thanks to the register of software developers receive billions of additional revenue
The companies which placed the products in the register of domestic software received additional contracts in total for billions of rubles. It was said by the Minister of Telecom and Mass Communications Nikolai Nikiforov, speaking at the TAdviser IT Government Day conference on February 28, 2018. It is difficult to count the exact amount of additional revenue for these developers, the minister noted, but the speech can go approximately about 5 billion rubles a year.
Nikiforov was recognized that he has a certain share of disappointment in a question of import substitution. The break in import substitution can happen, "when the USA will accept the next package of sanctions and at all everything will be switched off", he joked.
Subsidizing of development of domestic software as, for example, subsidizing of agriculture, could stimulate more active import substitution. Judging by a share of purchases of domestic software, it is possible to speak about progress: in 2014 it was about 20-30%, now – 60-70%, the minister provided data.
At the same time the overwhelming number of the new key systems in the country is based if not on completely Russian software products, then on products with the open code, Nikiforov said. In them the foreign proprietary software is practically not used.
Concerning transition of state agencies to the domestic office software, the minister noted that nobody forces anybody it to do, and the decisions made on this matter were soft. Purchases of import software continue.

During Nikolai Nikiforov's performance at a conference of TAdviser the question of permitting state agencies to select operating systems not from the register of domestic software as many of them are based on a global kernel of Linux, and to allow them to use world assemblies with the open code and at the same time free was brought up. Nikolai Nikiforov noted that there is no prohibition on use of world assemblies of Linux. And if you do not buy them, and they free, then especially there is no prohibition, he added.
The plan of appointment of Rostelecom as the only supplier of cloud office services for authorities
In February, 2018 it became known of plans of the Russian government to appoint Rostelecom by the only contractor of the project on providing domestic office software to authorities as cloud (SaaS) service. Till March 15 of the Ministry of Telecom and Mass Communications together with the interested federal executive authorities should prepare and provide to the government the relevant proposals, said in the minutes of the government commission on use of information technologies for improvement of quality of life and conditions of conducting business activity.
In addition to the direction of office software, Rostelecom will implement in authorities the mobile operating system and means of antivirus protection. For February 20, 2018 only one mobile platform is included into the register of the Russian software – Sailfish OS.
Besides, Rostelecom is going to be appointed the only contractor and services in completion of the IT systems used by public authorities for the purpose of ensuring their compatibility with domestic office software. They will be provided on service model and on the basis of safe information and telecommunication infrastructure and customer premise equipment.
According to the order of the Government of the Russian Federation of March 23, 2017, the operating system, the communication software, the office suite, email applications, an organizer, preview players, the Internet browser, the editor of the presentations, the tabular editor, the text editor, software of a file manager, a legal-reference system, electronic document management systems and means of antivirus protection belong to the office software.
Earlier it was reported that the Ministry of Finance and the Ministry of Telecom and Mass Communications till March 15, 2018 should provide to the government the draft of the regulation about ensuring centralization of purchase of office and accounting software and also cybersecurity solutions.
Purchases of the domestic office software for state agencies decided to centralize
At the meeting of the government commission on use of IT for improvement of quality of life and conditions of conducting business activity under the chairmanship of the prime minister Dmitry Medvedev which took place on February 9, 2018 the decision on centralization of purchases of office and accounting software and also software products for information security support was made. The portal reported about it reported D-Russia.ru with reference to the participant of a meeting.
According to the portal, it will be entrusted to Ministry of Finance and Ministry of Telecom and Mass Communications to develop and introduce till July 1, 2018 to the government the draft of the regulation about centralization of purchase of software. The document should provide:
- implementation of the mechanism of acquisition by state agencies of the domestic office software integrated with electronic document management systems including according to the SaaS model;
- determination of an order of collecting and synthesis of offers of state agencies on completion of the Russian office software and sale of the mechanism of its completion on analysis results of these offers.
Centralization of purchases of the office software was already discussed earlier. So, in October, 2017 at a meeting with the vice-president of the government it was entrusted to Ministry of Finance and Ministry of Telecom and Mass Communications to work and provide offers on the organization of the centralized purchase of the office software for needs of federal executive authorities and state non-budgetary funds.
On commission session Medvedev also suggested to improve rules of maintaining the register of domestic software.

State procurements of software from the EEU countries are resolved
In December, 2017 the Government of the Russian Federation lifted ban on purchases of the software by the Russian state bodies from the countries of the Eurasian Economic Union (EEU; in addition to Russia, it includes Armenia, Belarus, Kazakhstan, Kyrgyzstan). The corresponding order is published on the website of the Cabinet of Ministers.

Within the resolution of December 20, 2017 No. 1594 the concept "software" is specified and rules of determination of accessory of software are adjusted, is established that the additional requirements set by the order of the Government of the Russian Federation for the Russian software extend to the programs included in the register of the Eurasian software and also requirements to the register entry about software are specified.
Formation and maintaining the unified register of the Russian programs for electronic computers and databases and also the similar register with software of EEU is provided. Also it is going to create the federal state information system providing maintaining these registers of software.
Besides, the resolution specifies an order and terms of making changes about the owner on the software — for the purpose of prevention of transition of the rights to a product under control of the foreign organizations and individuals, the report says.
The government suggests to prohibit purchase of foreign software without source code
The Deputy Prime Minister of the Russian Federation Dmitry Rogozin suggested to prohibit state procurement of the import software if the developer refuses to open his source code, reports TASS news agency in October.
According to him, it is necessary to prohibit purchase in public sector of the equipment from the sellers who are not providing the source code and documentation for its subsequent upgrade by own forces. Delivery of the foreign equipment, such as switches, routers and servers means work with constantly upgraded foreign software which can be used for industrial espionage.
"As a matter of fact, we just wear out a bomb to own house and we do not know how this story will work in the conditions of strain of relations. And just nobody cancelled industrial espionage therefore it is simply silly", - the Deputy Prime Minister said.
Rogozin also noted need to set more ambitious tasks for himself, considering the capacity of the Russian defense industry complex. According to him, it is not so much technology how many a political task.
Russian authorities will prohibit purchases of foreign antiviruses for state agencies
Russian authorities intend to impose a total ban on state procurements of a foreign anti-virus software, electronic document management systems and accounting in the nearest future, told at a conference "The Russian software: effective solutions" Ilya Massukh, the head of the Competence center created at the request of the president on import substitution in the field of ICT, delegates the correspondent to RBC.

One of the Russian companies — "Kaspersky (earlier Kaspersky Lab)" — earlier faced symmetrical clippings in the American market. On July 12 the White House excluded it from a software supplier list whose products are approved for use by state structures of the USA. In September the U.S. Department of Homeland Security obliged all state institutions to refuse use of antiviruses of Kaspersky Lab and to replace them with other software within three months.
The Ministry of Telecom and Mass Communications with delay for half a year developed methodology of migration of state agencies on domestic software
Development of methodical recommendations about transition of state agencies to the domestic office software dragged on in the Ministry of Telecom and Mass Communications for half a year. In the evening on July 3, 2017 department published on the website the order on the statement of these the recommendation signed by the Minister of Communications Nikolai Nikiforov. In the document it is said that it was prepared for implementation of point 8 of the plan of transition of state agencies to the Russian software in 2016-2018 which was approved by the order of the Government of July 26, 2016 No. 1588-r.
According to the above-mentioned government directive, federal state agencies and off-budget state funds had to approve scheduled plans of the transition on domestic software till March 1, 2017. At the same time, besides, provided the recommended forms of these scheduled plans and value of target indicators on implementation of different types of software of the Ministry of Telecom and Mass Communications just now — in a packet of methodical recommendations. These recommendations in general define the main criteria of transition of state agencies to use of the domestic office software in 2016-2018 and for planning period of 2019-2020.
The document was developed based on the pilot project which passed in the first half of 2017 within which the Ministry of Telecom and Mass Communications, Minpromtorg, the Ministry of Finance, Federal Bailiff Service, the Federal Tax Service, Social insurance fund and the Pension fund tested Russian software.
"After the approval of methodical recommendations plans of transition to the domestic office software should approve departments", says the Ministry of Telecom and Mass Communications.
It is supposed that transition will begin to be performed using the programs included in the unified register of the Russian software supervised the Ministry of Telecom and Mass Communications. At the same time transition to use of domestic office software can be ordered not only to state agencies, but also the state corporations and the companies, joint-stock companies with state participation.
Indicators of efficiency of transition
The recommended form of the scheduled plan of transition to the Russian software prepared the Ministry of Telecom and Mass Communications for state agencies in 2017-2018 and for planning period till 2020 contains target indicators and indicators of efficiency of transition corresponding to them with breakdown by separate types of software.
According to the document, the share of the Russian OS in the office of a single state agency in 2017 should make 30%, and by 2020 grow to 80%. In territorial subdivisions of this body in 2017 the share of domestic OS should make 20%, but by 2020 also grow to 80%.
The share of domestic office suites during the same period should grow in devices from 50 to 80%, in divisions — from 20 to 80%, a share of email clients — from 50 to 100% and from 35 to 100% respectively, a share of workflow systems — from 50 to 100% and from 30 to 100% respectively, a share of Internet browsers — from 30 to 80% and from 20 to 80% respectively, a share of antiviruses — from 99.5 to 100% everywhere.
Pilot project of the Ministry of Telecom and Mass Communications on transition of state agencies on domestic software
SDU "Priority" on the Docsvision and "The Protected Mobility" platform – participants of a pilot project on transition of federal state agencies to the domestic office software
In May, 2017 the pilot project Ministry of Telecom and Mass Communications Russia on transition of federal executive authorities and state non-budgetary funds to use of domestic office software (S) came to the end. 16 products from became project participants Unified register of the Russian software.
Pilot tests were carried out on the basis of order of the Deputy Prime Minister of Russia A.V. Dvorkovich of 11/19/2016 No. AD-P10-6948, the organizer of the project – the Ministry of Telecom and Mass Communications of the Russian Federation. Implementation and testing of products was held in the Ministry of Industry and Trade of the Russian Federation, the Ministry of Finance of the Russian Federation, Federal Bailiff Service of the Russian Federation, the Federal Tax Service, Social Insurance Fund of the Russian Federation, the Pension Fund of the Russian Federation and directly in the Ministry of Telecom and Mass Communications of the Russian Federation. In total more than 100 platforms, including central offices of departments and their division.
The pilot project was carried out in several steps: check on compliance of software to technical and functional requirements, compatibility with products from the Unified register of the Russian software (PostgresPro, Alt Linux, MyOffice, etc.) and with the application corporate software, testing by the working group. More than 45,000 users became participants.
"The purpose of this project – to check the software included in the Unified register for compliance to additional requirements to software and databases, to test possibilities of its integration into the application software which is available in departments according to the Government decree of March 23, 2017 No. 325", – the associate director of Department of state policy in the field of informatization of authorities of the Ministry of Telecom and Mass Communications of the Russian Federation Yakov Tebenkov told. – Replication of the implemented solutions on other state agencies will become the next stage of work".
According to this resolution treat the office software, including email applications, an organizer, file manager and also electronic document management systems and means of antivirus protection. In particular from all products Digital Design included in the register took part in the first pilot project "The protected mobility" and SDU "Priority". Special requirements for each software are stated in the resolution. As for electronic document management systems, the detailed description of all processes of documentary management and the requirement to information security are stated in the separate document – the Order of the Ministry of Telecom and Mass Communications of the Russian Federation of September 2, 2011 No. 221.
2016: Growth of a share of domestic software in purchase of federal and regional structures
The Ministry of Telecom and Mass Communications of the Russian Federation on a regular basis carries out monitoring of state procurements in regions. According to data which the head of department Nikolai Nikiforov shared, acting on board of the ministry on May 3, it is visible at what serious rates the share of domestic software in purchase of federal and regional structures including in purchase of works grows.

Despite such growth of purchases of the Russian solutions, it is quite difficult to reveal projects of import substitution, analysts of TAdviser note. The limitation of open information on the current infrastructure of authorities not always allows to refer implementation of domestic software to import substitution. Besides, many import-substituting implementations are executed in a complex with other projects therefore from financial side it is not always possible to estimate them.
Among regional authorities it is possible to refer to the largest projects of import substitution of 2015-2016, for example, migration of capital state institutions from the solution Microsoft Exchange on uniform service of e-mail "MyOffice". The project started in 2016. The first stage which had to affect about 6 thousand users was estimated at 43.6 million rubles. In total about 600 thousand people should be transferred to a domestic mail service.
Among federal agencies it is possible to refer relocation of FMS with EDMS based on Documentum on the Russian solution "Logic of EDMS" to the largest projects of import substitution. The project started in 2015 and was estimated at 74 million rubles.
Some state companies also pass to domestic goods. Among the projects starting in 2015-2016 it is possible to select migration of RusHydro from EDMS Documentum for LanDocs. The project budget made 75 million rubles.

Plan of transition of state agencies for the domestic software
On July 26, 2016 the prime minister Dmitry Medvedev announced signing of the plan of transition of federal executive authorities and also state non-budgetary funds, on use of the domestic software.
Order of the Government of the Russian Federation of 7/26/2016 No. 1588-r "About the approval of the plan of transition in 2016-2018 of federal executive authorities and state non-budgetary funds on use of domestic office software". Point 5. Recommend to executive authorities of territorial subjects of the Russian Federation, to the state corporations and the companies, joint-stock companies with the state participation to provide implementation of transition to use of domestic office software.

Law on the register of the Russian software
On June 29, 2015 the President Russia Vladimir Putin signed the drafted Ministry of Telecom and Mass Communications federal law No. 188 (to download PDF) on creation of uniform register of the Russian software.
The law becomes effective since January 1, 2016.
Criteria of an otechestvennost of the software
The Federal Law defines criteria to which should correspond to software to be included in the register.
* the exclusive right to software in the territory of the whole world and on all validity period of the exclusive right should belong: To the Russian Federation, subject of the Russian Federation or municipal entity; the Russian NPO which supreme body of management forms directly or indirectly the Russian Federation, the subjects of the Russian Federation, municipal entities or Russians and which is not recognized as the Russian organization controlled by the foreign person; the Russian commercial organization with a total share of direct or indirect participation of the Russian Federation, the subjects of the Russian Federation, municipal entities, NPO and direct or indirect participation of citizens of the Russian Federation more than 50%; to the citizen of the Russian Federation;
* to software it is available on free sale;
* the total amount of payments for the license and other agreements providing the rights to results of intellectual activity and means of individualization, execution of works, rendering the services used for development, adaptation and modification of software, for benefit of the foreign persons controlled by them the Russian organizations, agents, representatives of foreign persons and the Russian organizations controlled by them is less than 30% of the owner's revenue of implementation of software for calendar year;
* the information about the owner of software is entered in the register of the accredited organizations performing activity in information technology field;
* data on software do not make a state secret and programs or databases do not contain the data making a state secret.
The law also makes changes to Part 3. Article 14 44-FZ about a contract system in the field of purchases, the providing possibility of prohibition on the admission of a certain list of the types of goods coming from the foreign states and restriction of their admission for the purposes of implementation of purchases. Change to this part was the fact that in the presence of the circumstances allowing exceptions of the set bans and restrictions, customers will be obliged to prove impossibility to observe prohibition and restrictions.
In the text of the law it is said that it was accepted for the purpose of expansion of use of the Russian programs and rendering the state support to their owners.
The government decree about restrictions of state procurements of foreign software (it is published on November 20, 2015)
The law on the register of the Russian software will be applied according to the government decree "About Establishment of Prohibition on the Admission of the Software Coming from the Foreign States for the purposes of Implementation of Purchases for Ensuring the State and Municipal Needs". Its text was published on the website of the Government on November 20, 2015 (it is possible to study the document here).
According to the resolution, since January 1, 2016 customers are obliged to limit purchases of software for the state and municipal needs to the software included in the register of the Russian software.
The expert advice will create and update the register. Its structure was approved on December 31, 2015.
The number of representatives of federal executive authorities cannot exceed 40 percent of total number of members of expert advice. Not less than 50 percent of total number of members of expert advice form according to offers of associations of the Russian software developers, said in the resolution.
It is possible to purchase foreign software in case of absence in the register of domestic software with necessary functional, technical and utilization properties.
The customer will have to prove the need for compliance of the software product to certain characteristics.
Rules of determination of requirements to the purchased software (and also to services of development, maintenance, technical support, etc.) in the Ministry of Telecom and Mass Communications should develop together with the interested federal authorities. The document containing offers on this subject should be transferred in February, 2016 to the Ministry of Finance, and then to the Government.
In January, 2016 the Ministry of Telecom and Mass Communications approved the qualifier of programs containing the instruction on characteristics by which compliance of the software to a certain class and also rules of application of the qualifier is determined.
The organization given the right of receiving an obligatory copy of the software according to the Federal Law "About an Obligatory Copy of Documents" will be operator of the register under the contract from the Ministry of Telecom and Mass Communications. In the current version of the law MNII "Integral" is responsible for the software.
To the draft resolution (which was drafted the Ministry of Telecom and Mass Communications in February and for 2015 it was discussed in federal agencies) it was specified in the explanatory note that the document is prepared for the purpose of protection of domestic market of the Russian Federation, development of national economy, support of the Russian organizations performing activity in the field of IT, considering including the restrictions for use of foreign software by the separate Russian organizations set by a number of foreign owners in connection with the entered USA and some other countries to sanctions.
How to be included in the register of the Russian software
For entering of a product into the register of the Russian software his owner will have to submit the application in the Ministry of Telecom and Mass Communications via the website of the operator of the register. The website address as of November 20 is not announced.
Access to forms for filling of the statement will be provided after identification of the owner in a unified identification and authentication system (it is used on the portal of state services). The application will need to be signed the strengthened qualified electronic signature, reported TAdviser in the Ministry of Telecom and Mass Communications.
Within 10 working days the ministry will have to check the statement and documents attached to it confirming compliance of software to the criteria stated in the law (the cm is higher).
Then 30 working days the expert advice which will draw the conclusion about compliance or mismatch of software to requirements of the register will consider the application. The conclusion will be published on the website of the operator of the register in open access.
No later than through 10 workers after the approval of the expert opinion, the Ministry of Telecom and Mass Communications has to make the decision on inclusion of software in the register. In case of the positive solution the special order of the ministry then data on a product will be entered in the register will be issued.
How to prove impossibility of failure from foreign software
The resolution defines rules of preparation of justification of impossibility of observance of prohibition on the admission of foreign software for state procurements and also requirements to the content of such justification.
Justification is prepared by the customer at implementation purchases of the software in the following cases:
- in the register of the Russian programs there are no data on the software corresponding to the same class software as the software planned to purchase;
- the software, data on which are included in the register and which corresponds to the same class of the software as the software planned to purchase on the functional, technical and (or) utilization properties does not conform to the requirements to the software planned to purchase set by the customer.
Justification should contain requirements to necessary characteristics of the software, and the instruction on characteristics on which the analog which is contained in the register does not correspond to them.
Justification is prepared and affirms the customer on to status on the date of placement of the notification on implementation of purchase in to the unified information system in the field of purchases. Then it should be posted on the website of state procurements (along with placement of the notification on purchase implementation).
The expert advice should check adequacy of the chosen justifications probably (this question as of November, 2015 is in discussion).
"It is quite difficult to formalize general requirements that is admissible and that is not present when choosing software. Customers have different tasks, different requirements, identical products do not exist. Therefore it is necessary to proceed from real tasks of the specific customer and to look whether really system operation at 1000 workstations, specific functions, etc. is necessary for him", - Evgenia Vasilenko, the chief executive of ARPP "Domestic Software" considers.
Plan of import substitution of geographic information systems

The recommendations of the Security Council to use Russian software in energy industry
In the fall of 2015 documents according to which they should report as they carry out works on import substitution were sent to all large oil and gas companies from Security Council of the Russian Federation. Estimates of perspectives of import substitution in a public sector market participants
In spite of the fact that import substitution perspectives in a public sector are highly appreciated by the Russian companies, process will slowly take place also with "big blood". In the conditions of fall of the budget it is inevitable, though it is told still more, than really becomes, respondents of TAdviser experts consider.
Migration on new technologies and products is always integrated to emergence of different technical issues and inconveniences, and most of heads do not want to face their solution. Therefore some market participants speak about need of accumulation of pressure from the state that process of replacement of foreign solutions made success.
Where questions concern security and technology independence of bodies of authority and management, tasks of import substitution will be solved and money for them will be, Vladimir Andreyev, the president of DocsVision company considers, adding that in other questions import substitution will be slowed down by a lack of means.

"Руссофт" accused the Ministry of Telecom and Mass Communications of a conflict of interest
On April 11, 2016 it became known of negative attitude of the Russoft non-profit partnership (NPP) to the procedures accompanying inclusion of software in the register of the Russian software. NP Russoft accused of their imperfection the Ministry of Telecom and Mass Communications.
According to NP Russoft the procedure by means of which the expert advice at the Ministry of Telecom and Mass Communications defines compliance of the software for inclusion in the register of the Russian software is used for competitive struggle.
The president of NP Roussoft Valentin Makarov wrote the letter to the director of the department of development of high technologies of the Ministry of Telecom and Mass Communications Dmitry Chernov "with offers of quality improvement and objectivity of examination of software products" for inclusion in the register of domestic software.
Makarov considers - to the expert advice responsible for the solution "include / not include" software in the register, "it is not always possible to avoid discrepancies, errors, a conflict of interest at pronouncement of solutions" as requests of the companies are transferred to the experts of rival firms applying for inclusion in the register. According to Valentin Makarov, it is inadmissible as "in this case the negative expert opinion is, in fact, one of competitive struggle forms".
Experts are guided by the criteria which are not provided in the government decree, the head of NP Russoft considers. They, in particular, consider: "products on the basis of the free software should have considerable completion in Russia, and components of foreign production as a part of the software product should not make it the main functionality".
Failure to include in the register products IT group which chairman Tagir Yapparov is included into council of board of Russoft became the reason for the appeal to the ministry, according to the Kommersant edition. Eight products of IT were included into the register, three — are not present.

The Ministry of Telecom and Mass Communications announced participation in in expert advice, in addition to representatives of the IT companies, specialists from federal executive authorities, institutes of the innovative development and associations of the Russian software developers. As of April 11, 2016 in the register of 398 software products - the expert advice rejected no more than 20 requests.
Evgenia Vasilenko, the chief executive of Association of software developers, noted presence of direct competitors at the majority of software products in the register and, as a result, prooflessness of charge of a conflict of interest.
The register of domestic software will not earn in any way
To the middle of February, 2016 the mechanism of purchases of domestic software installed by the government in state agencies remains to the unemployed: The Ministry of Telecom and Mass Communications did not publish at the scheduled time necessary bylaws for purchasing control of foreign software, and in the register only 3 software products are registered.
In two-month time from the moment of signing of the government decree about restriction of purchases of foreign software in state agencies, i.e. till January 16, the Ministry of Telecom and Mass Communications had to approve regulations on expert advice which makes the decision on inclusion of software in the register of domestic software and also the qualifier of programs and databases containing characteristics of software according to which it is carried to a certain class software. Besides, in the rules of formation and maintaining the register approved by the resolution it is said that Ministry of Telecom and Mass Communications should appoint the official site of the register of domestic software and an operating company which will be responsible for maintaining the register. Elections of this company should be performed according to requirements of the law on state procurements.
At the beginning of December, 2015 the Ministry of Telecom and Mass Communications published the draft of the order on determination of the official site of the operator of the register and also the draft of the qualifier of software on the regulation.gov.ru portal. Both documents as of February 18 were not registered and published. The Kommersant newspaper with reference to the sources writesthat necessary papers were sent for registration in Ministry of Justice with violations, and therefore were not registered, and now the Ministry of Telecom and Mass Communications corrects the mistakes made in them.
Interlocutors of the newspaper note that without bylaws the register started to the address reestr.minsvyaz.ru is not the legal register. Besides, for lack of regulations on expert advice the expert advice operating now is also not legal, note sources.
At the same time, existence in the register only several software products in expert advice a bit different reasons. On the website of the register tens of registered requests for inclusion in it are registered. One of members of expert advice -Alexey Smirnov, the CEO of Alt Linux, told TAdviser that, first, there passes some time from the moment of registration of the request before receiving by a product of assessment of the Ministry of Telecom and Mass Communications and its subsequent transfer for examination of expert advice. According to Smirnov, new "batch" of products already came to council for examination, however decision making on them clogged. The decision of expert advice on each product is made on the basis of results of vote of members of council which is taken in absentia and if with the first three products it passed in a case very quickly, then with the second list for some reason it is not possible to collect quickly all votes, Smirnov in a conversation with TAdviser noted.
Alexey Smirnov says that collecting of voices according to the second list of products continues and the expert advice is going to hold an internal meeting to consider a number of the organizational moments and to settle a question with examination of products.
On February 17 told about the planned meeting of expert advicethe Minister of Telecom and Mass Communications Nikolai Nikiforov on air of Russia-24 TV channel. According to him, it is going to approve about 50 requests about inclusion of software and about 50 more requests to consider.
Opinions of the Ministry of Finance and FAS on restriction of state procurements of foreign software
The Ministry of Finance and FAS expressed against the offered restrictions of state procurements of foreign software. The Ministry of Finance considered that it is necessary to leave to state agencies an opportunity to buy foreign software products for the purpose of "completion, expansion or prolongation of licenses on already used by them software". Otherwise, believed in the ministry, implementation of the resolution will demand additional resources from the federal budget.
In turn, FULL FACE considered that the taken measures can lead to abuses: to bypass restrictions and to buy foreign software, state agencies will specially specify such functions which Russian does not do not possess in tenders. FAS also suggested to enshrine in the resolution that products from the register of domestic software should extend in Russia at uniform prices not to allow their growth.
Opinions of players of the market on criteria of domestic software
In February, 2015 the opinion on criteria of domestic software was expressed to TAdviser by several software developers with the Russian roots by origin and connected with the foreign states legally. One of them –Kaspersky Lab. Reaction to regulatory measures of the foreign IT companies

According to him, the European business actively invested in Russia in the last 10 years and was going to continue to do it in the future, however "in the conditions of fuzzy rules of a game" the foreign IT companies can suspend investment programs or even to abandon the Russian market.
The edition source in one of the ministries said that concerns of AEB are caused not so much by the law obliging state agencies to prove purchase of foreign software, how many by the draft resolution of the government on restriction of state procurements of the foreign software entered by the Ministry of Telecom and Mass Communications in June, 2015. It is about prohibition on acquisition since January 1, 2016 of foreign software for the state and municipal needs.

On January 26, 2017 it became known of plans of the Ministry of Telecom and Mass Communications to prohibit the Russian state bodies and state companies to update the foreign software. This question will be submitted for one of meetings of the Government of the Russian Federation.
The report of the Minister of Communications Nikolai Nikiforov on import substitution of software was at disposal of Vedomosti. In it it is said that state customers willingly use a hole, connected with the fact that restrictions for state procurements of software do not extend to service payments therefore they buy "works on creation of the new software products based on foreign software". As a result domestic developers and, as a result, the Russian economy loses billions of rubles of the half-received income, seriously complicating the further solution of a problem of an imortozameshcheniye of software, affirms as the document.
According to the Ministry of Economic Development for 2015, the share of expenses on state procurements of domestic software made only 23%, however the number of contracts for acquisition of such products increased more than twice relatively 2014.
At the same time, as two federal officials told the edition, Nikiforov's report will not be submitted at a meeting of the Government on January 26, 2017. It was excluded from the agenda, and, perhaps, it will be considered another time, one of interlocutors of Vedomosti reported.

Initiative of experts led by Cognitive to give preferences of Open Source
The commission of the State Duma on development of strategic information systems operating at the State Duma Committee on science and high technologies at the meeting in September, 2015 announced that it started development of the bill which would provide advantages of Open Source over proprietary products on purchases on 223-FZ and 44-FZ.
As envisioned by the commission, within such purchases of the organization will have to prove need of the proprietary software in the presence of Open Source analog. The Russian Open Source at the same time should have a priority in relation to import, ideologists of the bill believe.
Need of the specified measures contacts, first of all, potential security risks of strategic IT systems when using proprietary products. The responsible secretary of the commission Andrey Chernogorov, the CEO of Cognitive Technologies, during the meeting also emphasized possible economic effect: according to it, economy for the budget of the country when using Open Source can exceed 500 billion rubles a year "even by the most conservative estimates".
The acting director of the department of development of the industry of IT of the Ministry of Telecom and Mass CommunicationsPavel Anisimov at a meeting reminded that the plan of import substitution adopted by its department assumes preferences to domestic software developers on state procurements as a support measure. In this part at the level of the Federal Law changes were already made, and further the Ministry of Telecom and Mass Communications will introduce to the government the draft resolution, the register of domestic software regulating maintaining and the procedure of hit in it, he told.
The representative of the Ministry of Telecom and Mass Communications added that it is possible to use the mechanism put in these measures of support and it is supposed to use applicable and to Open Source.
In parallel with preferences of Open Source on purchases the commission of the State Duma suggests to enshrine also in the legislation classification of software on free and license, according to the following determinations:
- Open Source is the software distributed on the terms of the free license agreement on the basis of which the user acquires the right to use the program in any, the purposes which are not prohibited by the law; get access to source texts (codes) of the program both for the purpose of its studying and adaptation, and for the purpose of processing, to distribute the program (free of charge or for a fee, at discretion), to make changes to the program (to overwork), and to distribute copies of the changed (processed) program taking into account possible requirements of inheritance of the license;
- The licensed software is a software, all opportunities for use which modification and distribution are defined for the specific user by the owner.
In addition, the bill provides changes in the law on personal data 152-FZ, regarding provision of guarantees by owners for the licensed software and Open Source to users of security of their personal data when using this software.
Ideologists of the bill expect to prepare and submit it for consideration in the State Duma at the end of November - the beginning of December, 2015, and specify the preliminary time frame of the introduction of the law in force on January 1, 2016.
Respondents of TAdviser experts criticized the idea of the bill as in terms of its expediency in general, and the determinations of the free and licensed software offered by his initiators. So, the CEO of Alt LinuxAlexey Smirnov in a conversation with TAdviser noted that exhaustive and competent determinations of Open Source already are in GOST P 54593-2011 "Information technologies. Open source. General provisions".

"Unfortunately, authors of the bill are little familiar with subject of Open Source and licensing and fondly divide software into "license" and "free", without understanding that "free licenses" are licenses with the requirements and restrictions too, and are selected among other licenses with a certain set of the rights granted to the licensee", - he says.
The CEO of Alt Linux added that, "unfortunately, after adoption of law on preferences to domestic software, the offers trying to blur it began to appear one behind another". So, the idea to equate to domestic software "localized" foreign, now attempt to separate domestic software depending on a business model which is used by the developer was voiced recently, he says.
"I think that it is a deadlock way. On the contrary, the maximum consolidation of developers of the domestic both free, and non-free software is necessary. Such position is upheld by the leading associations of developers ARPP "Domestic Software" and RUSSOFT who, unfortunately, were not invited to discussion", - he told TAdviser. – It seems that instead of supporting domestic developers (both the free, and non-free software), redirecting the state money from import of licenses for purchase of the qualitative and mature products created in Russia - someone wants to allocate public funds under a promise of future developments".
According to Smirnov if really there is a wish to support Open Source, then it is necessary to publish all results of the works performed on the state money under the free license. Not purchased, namely developed by request, he emphasizes. It is also necessary to support participation of domestic developers in key international projects of development of Open Source.
"In my opinion, unfair experts misled deputies. There are determinations in state standard specification about Open Source, and just legal nonsense is offered. In offers it is not considered that any software approaches under license not to mention that the country does not need abstract Open Source as it is offered, and products which can support and develop the Russian companies are necessary, and the question of the license is secondary", - he considers.
As for preferences of Open Source on purchases, it, according to Komissarov, "the harmful idea". The law already set preferences to the Russian software which can be both Open Source, and proprietary, and initiators of the bill suggest to give preferences before, for example to 1C which is simply downloaded from the Internet of Open Source accounting, the CEO explains New cloud technologies.
The opinion of colleagues on the market is shared by the president of STC of a ROSAVladimir Rubanov: according to him, in GOST more competent definition of Open Source is contained. Initiators of the bill offer the determinations correct for "wild Open Source", he believes. Under the last joint development of basic technologies by the international community when costs share between many participants means, and the result equally belongs to all. On the basis of such software then the real, occasionally competing among themselves products under own brands (corporate functions are added, errors, etc. are corrected) therefore it is necessary to separate accurately "wild Open Source" and products of specific producers on its basis become.
"For final customers, including for the state, "wild Open Source" is useless without creation of local examination on behalf of local vendors or departmental Competence Centers. Behind each product for serious application there has to be a legal entity with technicians in the state which "is responsible" for it, accumulates examination and the best practicians, can develop and support", - Rubanov says.
In terms of technology independence, the main factor, according to the president of a ROSA, is extent of control of this or that software product by Russia, including the legitimate rights and real opportunities to modify and distribute modifed versions.
Legal aspects of criteria of "rossiyskost" are stated software in recently adopted amendments in laws on the register of domestic software. According to Vladimir Rubanov, it is necessary to add need of existence to them within the country for each Russian product of "a triad of technology independence": the complete source code, means of its development and the third – the local specialists understanding the first two points.
