the Offer to change the Australian analog of the Yarovaya Law

On July 11, 2019 it became known of offers which were prepared by Kaspersky Lab for completion of the Australian analog of the Yarovaya Law.

This law adopted in 2018 requires from the Internet companies to give to intelligence agencies of Australia an opportunity to get access to correspondence of users. For violation the penalty at the rate to  10 million Australian dollars ( about $7 million) and also criminal sanction is provided.

The Kaspersky Lab company suggests to make amendments to the law on access of intelligence agencies to data
The Kaspersky Lab company suggests to make amendments to the law on access of intelligence agencies to data

Regulation and for adjustment of the law is opposed by many world IT companies, including Kaspersky Lab, Kommersant writes.

«
As earlier we submitted the recommendations, addressed us with the offer to prepare the assessment of the law. As well as other players of the market, we sent the second packet of recommendations for consideration — the head of the regional direction of Kaspersky Lab Oleg Abdurashitov told the edition.
»

According to him, the law in Australia is more tough, than its analog in the USA and Great Britain. The Australian companies are forced to transfer development or servers from the country that foreign clients did not refuse services.

Abdurashitov also added that without cooperation "the balance will be strongly displaced from users and the companies towards law enforcement agencies" that promotes "further fragmentation of the Internet in the area of state borders".

The director of technology practice in risk consulting of KPMG in Russia and the CIS Sergey Vikharev considers that the Australian regulation complicates activity of software developers and can open for different persons access to the intellectual property of the companies and also in general weaken the trust level on information security market. There is a concern that other countries of the British Commonwealth therefore the speech will already go about the considerable market will follow the example of Australia, he noted.[2]

Change of the name with Kaspersky

On June 4, 2019 Kaspersky Lab announced rebranding and transition to the Kaspersky brand. The basis of a former logo was developed in 1997 when the company only took the first steps. In an old logo images of the Greek alphabet and fine details which in 20 years managed to lose the relevance were used.

«
We it is from the 90th, creating the company in already far the 1997th, we aimed to create the most abrupt antivirus in the market. About any positioning, image and philosophy of a brand and the speech could not be. Words such were not known! There passed 22 years, almost everything exchanged. More than 4000 people work for us, we protect hundreds of millions people and businesses worldwide, even the concept "antivirus" already managed to become outdated, - Evgeny Kaspersky told.
»

According to him, the new logo is constructed of geometrical, mathematically exact forms of letters, and its basis was formed by values, important for the company, for example, the highest class of engineering school. Besides, from a logo the word "lab" is removed.

«
Outside the Russian Federation our company is called most often just a surname of your obedient servant, i.e. just by Kaspersky. And it is so really simpler, shorter and more clear, - Evgeny Kaspersky noted. - But if to dig slightly more deeply, clear that we not simply change visual style. All company changes. We understand that our approach to business, to our products, to itself and our vision of the future in recent years changed. All these years we saved the world. Fought against the cyberevil in any its formats and the embodiments. But at the same time we grew and changed. Also we feel in ourselves forces not only to save, but also to build more protected, safe world. I am firmly convinced that the concept "cyber security" will shortly become obsolete, and the concept of "cyberimmunity" will come to replacement to it.

»

According to Kaspersky, the African countries should invest in education in information security field as it will lead to creation of more qualified personnel capable to work in the developing digital economy of the continent.

The head of Kaspersky Lab also noted that the decision on opening of division in Rwanda has strategic approach as the country is one of the IT centers in Africa, and the company has more opportunities for business development in the region.[3]

The Russian vendor expresses openness of work also by other methods — for example, cooperation with consulting giant from "Big Four"  concerning audit engineering the practician on development and distribution of anti-virus bases.

Also Kaspersky Lab until the end of 2019 is going to create in Switzerland  additional infrastructure on processing and data storage which users voluntarily provide through Kaspersky Security Network.

At last, the company advances the program of search of vulnerabilities in the software. Thanks to it by the beginning of April, 2019 more than 50 errors found third-party specialists to whom in total paid more than $17 thousand[4] were corrected]

Written explanations concerning recognition of products of LK harmful requested from European Commission

On March 6, 2019 the European Parliament deputy Gerolf Annemans requested from European Commission of an explanation concerning the resolution of European Parliament of 2018 in which it was said that developments of Kaspersky Lab are allegedly recognized harmful. Annemans's request has official character, and, respectively, officials of the supreme body of executive power of the European Union should give the unrolled written explanations.

Questions are formulated as follows:

  • 1. Whether European Commissions any reasons, in addition to certain articles in the press which allowed to call Kaspersky Lab "dangerous" are known or "malicious", in particular considering that the members of the EU, such how Germany, France or Belgium, cooperating with the specified firm, did not face any problems?
  • 2. Whether European Commissions any programs or devices are known, that Kaspersky Lab concerning which the possibility of prohibition on use in the EU was considered releases?
  • 3. Whether the European Commission locates any researches or [authoritative] opinions of experts in cyber security or consulting structures on Kaspersky Lab and whether it can point to me to these documents?[5]

Gerolf Annemans. Photo: dezondag.be

In return, Kaspersky Lab already expressed support to actions of the parliamentarian.[6]

Gerolf Annemans represents Belgium in European Parliament. At the same time he is known as so-called "eurosceptic" and is a member of the right-wing populist Nationalist Party "Flemish choice" which led in 2012-2014.

However, regardless of its political orientation, questions which it asks look fair and reasonable.

As you know, in the first half of July, 2018 the European Parliament by a majority vote approved the resolution on cyber security. In this document the European state institutions are designed to inspect the software used by them, the IT and communication equipment and to review the approaches to its purchases and use. Thus it is supposed to avoid "potentially dangerous" products and to refuse those which "are already recognized harmful".

In the document only one software maker whose developments allegedly "are recognized harmful" directly is called is Kaspersky Lab. More any name in the text of the resolution is not provided. There are in it and no links to the documents confirming injuriousness of developments of Kaspersky Lab.

In reply Kaspersky Lab refused further cooperation with Europol — until the resolution of European Parliament is not repealed or the point infringing on interests and a reputation of the company is not excluded from it.

In 2017 the U.S. Government decided to eliminate Kaspersky Lab of suppliers of the hi-tech equipment for the state needs. The U.S. Department of Homeland Security, in turn, stated that products of Kaspersky Lab pose threat to national security and can be used by Russian authorities for access to government documents of the USA.

It was preceded by a series of publications in media in which Laboratory was accused of excessively close ties with intelligence agencies of the Russian Federation. The head of the company Evgeny Kaspersky categorically disproves these charges.

«
Witch-hunt in the USA and the EU purchases the most bizzare shapes, but in IT security market it has no relation to product quality and a situation — Dmitry Gvozdev, the chief executive of Information Technologies of the Future company considers. — A long-term attack to Kaspersky Lab, as well as more recent campaign against Huawei, in fact, are dictated by exclusively political reasons. From all it is hype nobody will win, eventually, except individual politicians and cybercrime.

Help in capture of the thief of data of the NSA

On January 9, 2019 it became known that Kaspersky Lab whose software was prohibited to be used in the American state bodies, helped to catch the thief of confidential data at the National Security Agency (NSA).

According to the Politico edition with reference to the people familiar with investigation, Kaspersky Lab "handed over" the NSA of Harold Thomas Martin who, working in the company contractor of the agency, stole confidential materials under a signature stamp "top secret" (including the classified information on the military operations of the USA) and stored them at home.

Martin created anonymous Twitter account under name HAL999999999 through which he sent to two experts of Kaspersky Lab five ciphered private messages. They were short, and correspondence came to the end also suddenly, as well as began.

Prohibited in the American state agencies Kaspersky Lab helped to catch the thief of data of the NSA

In the first message which is dated on August 13, 2016 the author asked to organize a conversation with Evgeny. Most likely, it is about the founder and the head of the Russian company Evgeny Kasperskom. In the second message Martin wrote "Relevance — three weeks". About what wanted to talk to Kaspersky stolen confidential data of the NSA, it is not reported.

The anti-virus company found the author of messages via the Google search engine: the request of HAL999999999 brought to personal which author looked for sexual partners. The anonymous declaration was posted on the website for the people who are interested in sado-masochism and binding of the sex partner and contained the real photo of Martin. The author of the declaration reported that he is 50 years old, and he lives in Annapolis, the State of Maryland.

Search in LinkedIn led to a profile of a certain Hal Martin who in social network called himself the researcher in Annapolis Junction, "the technical adviser and the investigator for offensive cyberproblems".  In a profile of LinkedIn it was not mentioned the NSA, but it was specified that Martin worked as the consultant or the contractor "for different cyberinitiatives in the Ministry of Defence and prospecting bodies".

Specialists of Kaspersky Lab received two messages in 30 minutes before the Shadow Brokers cybergrouping began to publish software tools of the NSA on the Internet and announced a tender for sale of the source codes stolen from investigation for $1 million.

Kaspersky Lab found proofs of communication of the received messages in Twitter with the personal account of Martin and his work for U.S. intelligence. Then researchers began to check the possible relation of Martin to Shadow Brokers and for this purpose contacted the NSA to suggest to make investigation.

Judicial proceedings on Harold Thomas Martin's charge of theft of confidential data are planned for June, 2019. According to prosecutors, the suspect within 20 years stole the data belonging to the NSA and other governmental bodies including the most difficult and important hacker tools. In total attribute to Martin illegal copying 50 Tbyte of data.

After Kaspersky Lab transferred to the authorities of the message to Twitter and proofs of authenticity of the identity of the sender, FBI wrote out the search warrant of the house and Martin's property and also acquired the right to studying of its account on Twitter.

The search with participation of two tens armed FBI agents and special division of SWAT was carried out quickly. In Martin's house a number of classified documents in paper and digital formats was detected. Among the found materials there were also detailed descriptions of tools of the NSA which got to hackers of Shadow Brokers.

Martin's connection with this cybergrouping was not proved and did not bring him charge of espionage. Shadow Brokers continued to publish in the Internet data of the NSA after Martin's arrest, disproving the assumptions that that could be Shadow Brokers.

Though in mysterious messages on Twitter some saw Martin's attempts to transfer confidential data of Kaspersky Lab or to Russian authorities, his lawyers insist on failure of evidence of such intentions.

«
He is a patriot who recklessly accumulated and stored confidential materials only because suffers from compulsive frustration — James Vida representing Martin's interests in court said.
»

According to the former legal adviser of the NSA  Stewart Baker, on a twist of fate the staff of Kaspersky Lab who the U.S. intelligence had in mind told about this problem.

«
All of us thought that Martin was caught as a result of the updated or strengthened control, and instead all look like it was delayed for the fact that he is an idiot — Baker in a conversation with Politico reported.
»

He noted that the NSA did not find a good method to identify unreliable employees who treat confidential data badly. Approximately Evgeny Kaspersky told the same in an interview of The Wall Street Journal:

«
I am pursued by one disturbing thought: security of millions of people can be elementary compromised contrary to all technologies and security measures using the most ancient source of threat — five-dollar "USB stick" and the misled employee.
»

Though Kaspersky Lab cooperated many years with law enforcement agencies and the cybersecurity companies in the USA for tracking of hackers, tension of the producer with the government began to be fueled approximately in 2012. Then Kaspersky Lab revealed a number of espionage tools of the NSA and hacker transactions after detection of earlier unknown spy software on computers of clients.

The postponed plans for opening of offices in the USA

On November 27, 2018 it became known that Kaspersky Lab postponed plans for opening of offices in the USA. Besides, the company postponed to 2019 start of representation in the Canadian Toronto.

«
Need of opening of office in  Chicago and  Los Angeles disappeared  owing to the general difficulties of work in  the region so far. Now  we have a stagnation on  corporate sales. At the same time B2C-sales grow in  an online segment, but  it centralized, for  its development  new offices are not necessary. So so far we temporarily stop plans for  opening of new offices —  the director of business development of Kaspersky Lab Alexander Moiseyev told RIA Novosti.

Kaspersky Lab postponed opening of offices in the USA after sanctions

The company was going to open three new offices in North America during 2018. In this region, according to Moiseyev, the number of ordinary users of products of Kaspersky Lab, despite negative publications in media and restrictions for sales grows in state agencies.[7]

In the defense budget of the USA for 2018 there is provision according to which federal authorities cannot use software and services of Kaspersky Lab or the organizations under control of it.

Alexander Moiseyev also reported that Kaspersky Lab is still not going to go public as the company shows "growing and profitable" business therefore it is not necessary to attract money with it.

«
If shares of the company are traded at  the exchange, it is frequent for  it strongly complicates life, adds bureaucracy, complicates decision making. We see that some companies  just aim to leave today  the exchange and  to become again private. Generally, to carry out the IPO it is necessary  to understand why to do it, what final purpose. Our main task now — the maximum development of new technologies which  we already have  — he added.

Investment of $12 million into the centers of transparency and DPCs in Europe

On November 13, 2018 Kaspersky Lab announced investment of $3 million into opening of two data centers and the first center of transparency in Switzerland. In total the company will invest $12 million in start of such objects until the end of 2019.

Two DPCs located in Zurich, Kaspersky Lab began to use for  processing of the harmful and suspicious files arriving from the European users of the company.

Before samples of viruses were stored in Russia that caused concern in foreign regulators: Kaspersky Lab was accused that it can collect confidential data, Kommersant with reference to the vice president for communications with state bodies of the company Anton Shingarev writes.

According to him that "remove this risk", all information from the European users will be stored in Switzerland after complete start of data centers. Kaspersky Lab is going to complete creation of new infrastructure by the end of 2019.

On November 13, 2018 Kaspersky Lab also opened the first center of transparency in Zurich. Within this structure an opportunity to check the source code of products of the company is offered the entrusted partners and the government organizations. Besides, they will be able to get access to the bases given virus signatures, to software updatings documentation on safe software development and other important materials. The center of transparency will allow to book external audit and assessment of the source code of the company and also to study technical documentation in the safe and convenient environment which is specially created for this purpose.[8]

The following center of transparency will be started in Asia in 2019, one more — with a high share of probability will appear in Canada.

«
The transparency becomes new regulation for the IT industry and the market of cyber security in particular — the head of Kaspersky Lab Evgeny Kaspersky noted.

In September, 2018 the ex-programmer of the NSA 68-year-old Nguiya Joán Pjo was sentenced to five and a half years of imprisonment for the fact that he allowed leakage of confidential cybermilitary developments. In December Pjo pled guilty of premeditated unauthorized copying of the classified information relating to the sphere of state security. Read more here.

Victory in court with the Dutch politician and the large newspaper

The head of Kaspersky Lab Evgeny Kaspersky in the accounts in social networks announced that his company won court against the large Dutch newspaper De Telegraaf. Process was begun in the claim of Laboratory in connection with[9] of February 3 in which it was specified that the female hacker by the name of Rian van Ryaybrok (Rian van Rijbroek) cracked the Dutch office "Kaspersky Lab" and detected proofs of communication of the local politician there — the eurosceptic Thierry Baudet — with the Russian Government.

Quickly enough it became clear that no cracking existed, and not van Ryaybrok, but the Dutch politician Willem Vermend was a source of information.

Among proofs of a fabrication of article the telephone recording made Rian van Ryaybrok was brought into court. The main characters of these negotiations — actually Rian (RR) and the Dutch politician Willem Vermend (WV).

«
In records Rian is indignant that Willem set up her, having whispered to journalists of De Telegraaf what she never told. Willem makes a helpless gesture, referring to instructions from parliament of the Netherlands — Kaspersky in the blog on Livejournal wrote. Further the text of the record from which clearly follows that van Ryaybrok was substituted is provided.[10]
»

In June, 2018 Kaspersky announced submission of the claim[11] against De Telegraaf and Willem Vermend, requiring to publish a denial and to compensate damage of reputation of the company. According to the results of trial the court recognized correctness of claimants and obliged the newspaper to give a denial. To it Kaspersky provides documentary confirmation in the publication:

«
"A media campaign[12] against Laboratory began a few years ago, and since then some American media strongly dropped the reputation, regularly publishing custom lies of space incompetence from all of clear political anonymous sources — Kaspersky sums up the result. — Being covered with laws on protection of sources, the power do not hesitate in a perversion of facts of common knowledge and distribution of fakes which are picked up then by numerous trolls and sotsmediyny botnets, and afterwards are used for justification of political solutions. Alas, c’est la vie, and on this place can appear any objectionable company, any person.
»

This "media campaign" costs much to Kaspersky Lab. A series of publications as which affirmed that communications between the company and the Russian intelligence agencies became too close led to the fact that Laboratory began to have serious problems with business in the USA.

Third-party information security experts, including European and American, consider that actions of U.S. authorities, Great Britain and the EU against Kaspersky Lab have disgraceful character: the public no serious evidence to the fact that the staff of Laboratory acted to the detriment of the clients or somehow participated in expected cyber attacks against other states was produced. Statements for "the proved threat" yet, except publications in media, are confirmed by nothing.

However, all attempts of Kaspersky Lab to dispute in court prohibition on use of its products in the USA, are ineffectual. Perspectives of similar judicial proceedings in other countries remain quite foggy so far.

Earlier Evgeny Kaspersky addressed the U. S. Congress with the offer to provide source codes of programs of Laboratory for inspection. The offer it did not meet understanding.

«
Considering that problems of Kaspersky Lab began with unfriendly publications in media, the won claim against the largest Dutch newspaper looks hopefully; at least, Laboratory won a moral victory — Dmitry Gvozdev, the CEO of Information Technologies of the Future company considers. — However before change of a political situation in the company world it will hardly be possible to reestablish partner communication with state agencies in the USA and Europe, regardless of results of judicial proceedings from media. And, apparently, any company which anyway causes associative communication with Russia still long time will cause in politicians and state structures of the USA and the EU a resistant idiosyncrasy.

Failure from work with Europol

In the middle of June, 2018 Kaspersky Lab announced failure to work with the European law enforcement agencies, including Europol. The producer of the antivirus software made this decision against the background of the new resolution of the European Parliament on gain of cyber defense from Russia, China and the DPRK.

That Kaspersky Lab stops cooperation with Europol on the page the founder and the CEO of the company Evgeny Kaspersky wrote to Instagram.

Kaspersky Lab refused to work with Europol against the background of the new resolution of the European Parliament on gain of cyber defense from Russia, China and the DPRK
Kaspersky Lab refused to work with Europol against the background of the new resolution of the European Parliament on gain of cyber defense from Russia, China and the DPRK
«
Within 20 years we protected the EU, working with law enforcement agencies. Numerous arrests of cybercriminals became result of this work. Due to today's unprecedented and unreasoned decision of the European Parliament we are forced to freeze our cooperation with law enforcement agencies of the EU, including Europol and project No More Ransom — he reported.
»

Evgeny Kaspersky  refers to the resolution on cyber defense adopted in June, 2018. In the document which was signed by European Parliament deputies by a majority vote, it is said that Russia, China and North Korea made cyber attacks of government level. The resolution calls for creation of the European rapid response team in the field of cyber security and to closer cooperation in this sphere with NATO.

Kaspersky Lab notes that the resolution has no legislative force and represents opinion of certain deputies, however the document shows explicit disrespect for the company which "was always a firm friend of Europe in the field of fight against cyber crime".

Kaspersky Lab stopped numerous joint projects with the European law enforcement agencies, including No More Ransom. The last represented state-private cooperation with research service of European Parliament.[13]

Kaspersky received tax benefits from the Moscow authorities

The Government of Moscow will provide to Kaspersky Lab tax benefits as the company was given the status of the anchor resident of technopark Water stadium, the Interfax news agency reports. The status was approved at a meeting of presidium of the Government of Moscow[14] today[15].

The status of the anchor resident of Water stadium will allow the company to pay to the city budget income tax at the rate of 12.5% instead of 17%. It is good news against the background of expenses in $12 million which the company will incur at relocation of the center of processing of user data from Moscow to Zurich and also against the background of failure of the Netherlands authorities from use of its products which announced news Reuters agency today.

Transfer to Switzerland assembly software and data of the American users

Kaspersky Lab intends to transfer processing of user data from Russia to Switzerland, reported CNews in the company. The new data processing center will be open in Zurich until the end of 2019. Data of users from Europe, North America, Singapore, Australia, Japan and South Korea, and will be stored and be processed afterwards there and other countries[16].

Project cost is estimated at $12 million, 60 employees of the company take part in its implementation. During transfer of data processing from Moscow to Zurich in the Swiss data centers 800 items of equipment will be unrolled.

In the center data processing which Kaspersky Lab collects through cloud infrastructure of Kaspersky Security Network (KSN) will be made, having requested previously voluntary consent of the user.

Center of transparency and assembly of software

In addition, Laboratory intends to open the first Center of transparency (Transparency Center) in Zurich. In total the company is going to create three such centers within the program of information openness (Global Transparency Initiative) started by it.

Kaspersky Lab will open a data processing center in Zurich In the Center of transparency operation of the equipment and software will be watched by independent third-party experts, they will check a program code of products for existence of not declared functions. Under their observation there will also be a processing of user data and assembly of products. "Laboratory" is going to charge these functions of new non-profit organization which creation it intends to support. Afterwards the organization will be able to render similar services and to other cybersecurity companies.

In addition, in Zurich "the pipeline on assembly of software" for some countries will be created. It will represent tool kit for assembly of programs from the source code. The pipeline will start working in Zurich until the end of 2018, it will begin to compile protective software products, anti-virus bases and their updates. The products collected thus will undergo independent testing for compliance of their code to that source code which was provided by the company.

Prohibition on state procurements of software in Holland

In the middle of May, 2018 it became known of prohibition of state procurements of the software of Kaspersky Lab in Holland. The authorities explained the solution with cyber attacks to the country to which Russia allegedly could resort.

That the government of the Netherlands decided to refuse use of products of Kaspersky Lab, said in the letter of the head of the Ministry of security and justice of the country Ferdinand Grapperhaus sent to national parliament.

According to the minister, the Russian government had "a program of cyber attacks which purpose, among other things, were interests of the Netherlands". He also emphasized that there are no "specific cases of abuses" of the Russian developer of an antivirus in the Netherlands, however "it is impossible to exclude it".

As specifies Reuters agency, Kaspersky Lab gets under operation of the Russian laws which can force the company to work for the benefit of the authorities, specified Grapperkhaus in the letter to parliament.

The authorities of Holland also began negotiations with the large companies working in the field of ensuring life activity of the state on an opportunity also to stop cooperation with the Russian company.[17]

In Kaspersky Lab with disappointment apprehended failure of the government of the Netherlands from the antiviruses developed by the company.

«
The Kaspersky Lab"  is very disappointed with the decision of the government of the Netherlands which is based only on theoretical reasonings, especially considering that our company is in process of implementation of a global initiative of information openness, which now purpose —  to clear any arising doubts — reported TAdviser in the company, having added that Kaspersky Lab was involved in geopolitical fight.

Creation of data center in Switzerland

On March 21, 2018 it became known of plans of Kaspersky Lab to open data center in Switzerland to calm the authorities of the western countries which are afraid of intended use of the software of the company by Russia for shadowing.

That Kaspersky Lab was going to start DPC, reported Reuters news agency with reference to internal documents of the company. Works on construction should begin approximately in the second quarter 2018, and come to the end — by the beginning of the 2020th.

Earlier American authorities suspected Kaspersky Lab that products threaten security of the country and can be used by the authorities of Russia for access to government documents of the USA. Though the producer categorically denied these charges, they were one of the reasons for construction of a data processing center by the company in Switzerland, tells one of the sources of the edition familiar with plans of the Russian vendor.

The world changes. Now to the forefront there are a balkanization and protectionism — the informant reported, discussing internal activity of Kaspersky Lab with Reuters.[18]

The interlocutor refused to disclose the additional information on the project and only noted that this DPC — "not just the PR-course". The company decided to change infrastructure of research and development, he added.

According to the source to the project in Switzerland the founder and the CEO of Kaspersky Lab Evgeny Kaspersky approved Reuters, plans, however he is upset with the fact that it is necessary to spend money for it as, according to him, there are more important directions for investment.

People, familiar relatives to Kaspersky and familiar with his relation with Russian authorities, told the agency that the Federal Security Service (FSS) can not allow start of data center in Switzerland, i.e. outside the jurisdiction.

According to the documents considered Reuters, the Swiss DPC will collect and analyze the files marked as suspicious on tens of millions of computers of clients in the USA and Europe. Data of other users will still go for processing to the Moscow data center.

Information will be transferred from Switzerland to Moscow only when the abnormal activity requiring manual processing is revealed. However, by March, 2018 99.6% of data which pass through automated systems of the company do not need manual check, the interlocutor notes.

From confidential documents also it became known that Kaspersky Lab will transfer from Moscow to Switzerland department of development of antivirus software. The authorities of the European state expressed readiness to give "firm support" of the company.

The company did not begin to comment on the appeared information. However on March 20, 2018 she announced plans to open the first "center of transparency". It agrees official to the statement, it will be located in Europe (in Switzerland, Reuters with reference to documents of Kaspersky Lab specifies) and will earn until the end of 2018. In this center the independent analysis of the source code, software updatings and rules of detecting of threats will be carried out

«
It will become an important stage of our Global initiative of information openness and will show how basic value for Kaspersky Lab has reliability of its products and warranties of lack of external intervention in them, says the company.
»

Opening of the new similar centers to North America and Asia is in the future planned.

«
We understand that in the conditions of geopolitical tension which is reflected in harder and harder picture of cyberthreats people can have questions, and we want to solve them — the representative of Kaspersky Lab need of start of the centers of transparency explained Reuters.

The top manager of Kaspersky Lab is suspected of non-payment of taxes

It is about 24 million euros — the amount of tax on profit from 2010 for 2015. According to the investigation, for these five years the Italian division of the company earned about 90 million euros. The edition does not tell the name of the main suspect.

The prosecutor's office considers that the Italian office acted as the intermediary in the relations with representation in London which managed activity of the company in the territory of Italy. The profits got in Italy, respectively, were paid in the territory of Great Britain. The Italian market brought the companies to 15 million euros a year.

Investigation was conducted since the beginning of 2016, the RAPSI specifies.[20]

It not the first investigation in which center Kaspersky Italia appeared in recent months. Earlier case of waste and assignment of funds of the company concerning a number of her heads for the amount nearly 3 million euros was investigated.

In September, 2017 Great Britain after the USA prohibited use of products of Kaspersky Lab in country state institutions.

Prohibition in Lithuania

On December 21, 2017 the Lithuanian government expressed the need removals of the software of Kaspersky Lab from crucial IT systems through the whole country.

According to Reuters agency with reference to the associate director of the state agency on cyber security of Lithuania Rytis Rainys, in software of Kaspersky Lab the potential threat of national security is detected.

«
Information from the computers using it software can flow away to the countries in which we do not want that it occurred. To this solution we were pushed by different sources, including our partners and investigation — Reynis reported.

Lithuania removes software of Kaspersky Lab from computers from crucial IT systems

According to the requirement of the Lithuanian authorities, the software of Kaspersky Lab should be deleted from the computers controlling crucial infrastructure, including power, finance or transport. And it concerns not only the state, but also private companies.

State bodies can continue to use solutions of the Russian company, only if they are installed on the equipment which, according to the agency on cyber security, is not of the state importance. Terms of replacement of software are not called.

Kaspersky Lab is sure that restrictive measures against the company in Lithuania are connected "only with geopolitical tension". The reliable evidence of the charges brought against the company was not submitted, noted in Kaspersky Lab.

«
Taking into account that Kaspersky Lab has no political connections or  affiliation with   any government, we are disappointed with this decision of the government of Lithuania — said in the company, having added that different options of resolving the situation are considered.[21]

Claim to the U.S. Department of Homeland Security

In December, 2017 Kaspersky Lab filed a lawsuit the claim against the U.S. Department of Homeland Security because of the recent solution to prohibit use of products of the company in the state organizations of this country.[22]

The company considers that the directive of the ministry on prohibition of use of developments of Laboratory issued on September 19, 2017 makes "a dangerous precedent which can be used for illegal restriction of any fair business".

Kaspersky Lab will dispute prohibition on the programs in the USA
Kaspersky Lab will dispute prohibition on the programs in the USA
«
This action which it is impossible to leave without reaction. Therefore we go to court, } it is told in the personal blog by Evgeny Kaspersky Sil[23].
»

According to the company executive, the directive was accepted on the basis of "unsuitable arguments": "... official representatives of vinisterstva confirmed that the solution was based on data from open sources ("read on the Internet") which, in turn, referred to anonymous authors, were confused in indications, distorted well-known things and told absurd because of bad understanding of technologies of cyber security, ignorance of industrial standards and political involvement".

But main, is that, from the point of view of Kaspersky, the Ministry of internal security violated the proper procedure, having ignored need of dialog with LK "for confirmation of justification of charges". In other words, Kaspersky Labs did not allow to act in the protection.

Meanwhile, effects of the decision of the Ministry of internal security were very dramatic for the company. At that time revenue from the software licenses sold to federal institutions of the USA make very insignificant part from total sales of Laboratory in the American market, the decision of the ministry resulted in domino effect: in the claim it is specified that several largest retailers of the country in general removed from sale of development of Laboratory and interrupted old cooperation. Not only the directive, but also the powerful media company as which leaders representatives of the U. S. Congress acted became the reason.

It should be noted that the Best Buy retail network refused sale of products of Laboratory some days before a release of the directive; "concerns about communications of the company with the government and intelligence agencies of Russia" became the reason. Kaspersky Lab persistently denies existence of any inadequate communications and informal cooperation with intelligence agencies. Evgeny Kaspersky said that all charges against the company were with deep arguments disproved while opponents do not provide any proofs, except as rumors and conjectures, including anonymous origin.

It is possible that the mentioned directive became a peculiar response to disclosure of secret cybertransactions of National Security Agency by Laboratory: experts of Kaspersky Lab the first published the analysis of hacker instruments of the Equation grouping, connected as it became clear later, with the NSA.

In 2017 in media there was a theory that developments of Laboratory were used for search and theft of classified documents and a program code of the NSA. Having made investigation, Laboratory reported that really its anti-virus tools revealed malware of Equation - on the home computer of the employee of the agency which, apparently, brought archive with documents and the code home, in defiance of all regulations of security.

At the beginning of December, 2017 the Daily Mail edition published material in which it was specified that a certain former employee of the NSA pled guilty that it really carried away confidential data home and that from its computer there occurred or could be "leak". Thus the version of Laboratory, at least, partially was confirmed. [24]

Perspectives of the claim are still unevident, Oleg Galushkin, the information security expert of SEC Consult Services company considers.

«
On the one hand, it would be necessary to submit a similar claim for a long time, Kaspersky's claims that this directive can strong do much harm to all market, are very reasonable — he says. — However since September a lot of things managed to exchange: prohibition on use of developments of Kaspersky Lab already became a part of the law adopted by the U. S. Congress and signed by the president of the country. Even if Laboratory will win the claim and use of products of the company in federal institutions — to the national interests of the USA which are not posing threats, at all not the fact will achieve recognition of the directive on September 19 invalid, and that it will lead to review of the law and will help to redeem Kaspersky Labs the reeled situation in the American market.

Closing of division in Washington

In December, 2017 it became known of closing of office "Kaspersky Lab" in Washington — divisions of Kaspersky Government Security Solutions which was engaged in delivering solutions for state bodies. It will be sold to the government and will continue to work with not federal clients in the USA through the representative offices of vendor which remained in the country, the vice president of the company Anton Shingarev told Bloomberg news agency. At the same time, Kaspersky Lab is going to open new offices in Chicago, Los Angeles and Toronto in 2018.

The office \"Kaspersky Lab\" in Washington will be sold to the government
The office "Kaspersky Lab" in Washington will be sold to the government

Shingarev also reported that Kaspersky Lab will open to the authorities the source code of the product for the independent analysis, having allowed experts to be convinced that the software has no hidden functions, does not send files of users to the third parties, does not spy and completely corresponds to user agreements.

In September, 2017 prohibited the American government use of the software Kaspersky Lab, referring to expected connections of the founder of the company Evgeny Kaspersky with the Russian intelligence, and a possibility that products of the company are capable to work as "harmful subjects", compromising federal information systems. This step caused concern of clients and in other markets, including, in Britain. According to Shingarev, loss of the state clients can be reflected noticeably in revenues of the company in the USA, besides, after prohibition of the government the company receives questions of security of the software from clients.

«
We conduct negotiations with the National Computer Security Center and we try to define what is necessary to deserve the opposite recommendation — Shingarev says. — In general they support the idea of opening of the source code of our software for substantive audit.
»

Kaspersky Lab is going to create the Centers of transparency (Transparency Centers) in the USA, Europe and Asia in which the code of the software can be analyzed by independent experts. It will be buildings of high degree of security with the security guard cameras, without the Internet in which the invited specialists will analyze the code with assistance of the staff of the company.[25]

Kaspersky intends to regain the trust of the USA and Europe, having opened the centers of transparency and source codes of products

Kaspersky Lab is going to take a number of measures which will allow it to prove groundlessness of charges of cyber espionage, which the company faced and to increase to itself trust in foreign markets. It follows from a speech of the vice president for communications with state bodies of Kaspersky Lab Anton Shingarev on December 6, 2017.

Opening of three centers of transparency - in the USA, Europe and Asia, disclosure of a product code and their updates for substantive audit to foreign regulators belongs to the specified measures, Shingarev reported.

The representative of Kaspersky Lab explained TAdviser that first of all these centers will be engaged in the analysis of the source code and updates together with representatives of the foreign organizations, regulators. It will allow to dismiss all charges of espionage, calculate in the company.

Anton Shingarev
Anton Shingarev

In a conversation with TAdviser Anton Shingarev noted that disclosure of the code for substantive audit - standard industry practice which the different companies perform, including, Microsoft in Russia. Also there are very strict rules of transfer of the code for a research in the protected conditions.

Shingarev told TAdviser that as of the end of the year the company discusses different options of carrying out audit with foreign regulators - in the USA, Europe and Asia. To any arrangements with it the company did not come yet. Process progresses not so quickly as it would be desirable, he added. It is especially difficult to develop the system of check of updates of products as updates can change their functionality. Nobody in the world built such system yet, Shingarev says.

«
We very much expect a feedback from regulators because without it we do something special, and it it can senselessly appear. When we do something, it is not believed therefore we need to build such system which will be trusted by default. Therefore the third party, the third parties for verification is necessary, - he explained TAdviser.
»

The best feedback - from Europeans, they in general are more open for cooperation, and a political situation with the USA really very heavy, the representative of Kaspersky Lab says.

Anton Shingarev found it difficult to call exact terms of opening of the first center of transparency. The company calculates that it will occur at the beginning of 2018.

The head of Kaspersky Lab reminded that in 1997 when the company was created, in the world there were only 500 viruses. 10 years later the Kaspersky Lab base included already more than 2 million malware. Only in 2017 the quantity of new samples of viruses can exceed 90 million, he predicts.

Evgeny Kaspersky provided data according to which daily in the world about 300 thousand new viruses are registered. Most of them can be referred to category of simple viruses which are easy for destroying. In total in the world there are 500 million "unique virus files", and malware purchase more and more complex character.

Graduates of DVFU, respectively, will become the first candidates for employment for the Far East office "Laboratorii".

Representatives of the cybersecurity industry repeatedly complained about insufficiency of training in the Russian universities. It is connected with the fact that the education system just does not keep up with the happening changes so svezhevypushchenny specialists sometimes should be retrained "from scratch". But at the same time universities after all give fundamental knowledge which need nobody denies. In this regard players of the cybersecurity market aim to set up cooperation with higher educational institutions, opening "the" courses and the centers of training of specialists which already "will be completely ready to the use".

Kaspersky Lab locates several more R&D-центрами in the country — in Novosibirsk, St. Petersburg and Moscow. Besides, in the last two years the company opened offices in Ireland and Israel.

At the same time Kaspersky Lab will continue to propose the solutions in the field of cyber security in the USA via own website and other retailers.

Earlier in September, 2017 in the American press there passed messages that the senate expects to impose a total ban on use by state institutions and departments and also the related firms of products of Kaspersky Lab on a wave of the growing concerns that "the hackers supported by the Kremlin" allegedly can use the Russian company to try to manipulate users, to catch their private correspondence and data.

Products of Kaspersky Lab left the list of administration of general services of the USA (GSA) of external suppliers whose products are approved for use by public institutions of the USA.

It is noted that the counterprospecting division of FBI holds similar meetings with business since the beginning of 2017. Most often to similar briefings the energy companies and those which use supervisory control systems and data collection (SCADA) and also solutions for management of production processes are attracted.

According to interlocutors of CyberScoop, at meetings with heads of the companies the staff of FBI submits the high-level overview of threat which are allegedly posed for itself by products of Kaspersky Lab. One of main, allegedly, is "close and active interaction with the Russian intelligence". Are given as an example of illegal acts of the company appearing earlier in media this, including the publication of Reuters (2015) in which it was told about creation in Kaspersky Lab of false viruses for the purpose of harming the competing producers and their users.

As noted CyberScoop in the U.S. Government, the companies using  the systems of collecting, processing, display and archiving of information on object of monitoring or management in general agreed to follow the recommendations of FBI, and some representatives of business after the briefing began to conclude bargains with competitors of Kaspersky Lab.[33]

Settlement of the conflict with Microsoft

Microsoft said that "found a common language" with Kaspersky Lab according to the complaints filed in Russia and Europe. The Russian company confirmed that all points of its address FULL FACE concerning unfair competition were satisfied.

«
We are happy with the approach to execution of warnings of FAS offered Microsoft and terms of its implementation. We also prepare the appeal to the European Commission and Federal agency on cartels of Germany that we to Microsoft have no notes any more, says Kaspersky Lab.
»

Settlement of the conflict happened at the initiative of Microsoft. The company expressed the intentions of closer interaction with producers of antiviruses to an exit of updates of products to help them to solve problems of software compatibility.

Besides, Microsoft will allow anti-virus vendors to use in Windows of the notification and the notification of clients about the forthcoming or already happened end of term of a subscription to software and also will provide to developers more understanding and determinancy concerning the diagram of an exit of updates.

Kaspersky Lab accused Microsoft of "abuse of a dominant position in the market of operating systems" and "unfair competition in the market of solutions for protection against computer threats". The essence of a claim was that after release of Windows 10 Microsoft began to interfere with actions of competitors and tried to persuade users to refuse third-party solutions for benefit of Windows Defender.[34]

Trump struck LK off supplier lists of products for state agencies

On July 11, 2017 the Presidential Administration USA Donald Trump excluded the Russian Kaspersky Lab from two supplier lists of the hi-tech equipment for the state needs. Is about two lists of Management of services of general purpose of the USA (U.S. General Services Administration, GSA) which certifies suppliers and enters them to the database of the companies: services in information technology fields and deliveries of photography equipment.[35]

As notes Reuters, the concern that products of the Russian developer can serve for collection of information in the American computer networks became an occasion. Earlier NBC News announced the confidential memorandum prepared by Committee on investigation of the U.S. Senate, sent to the head of the National intelligence. Affirmed as it that the Russian intelligence agencies can use products of Kaspersky Lab for espionage for Americans and sabotage of infrastructure facilities.

According to representatives of GSA, today's decision was made after "the analysis and thorough examination" — for providing "integrity and security of the U.S. Government, a system and network". At the same time state institutions of the USA can still use products of the Russian laboratory, but only purchased outside government contracts.

In return, in Kaspersky Lab explained Reuters that did not receive any notifications from GSA or any other American government structure concerning change of the status of the supplier yet.

"The Kaspersky Lab has no relation to any government, the company never helped and will not help any of the governments in the field of cyber espionage", said in the statement of the company.

At the end of June, 2017 the staff of FBI conducted surveys of the American representatives of Kaspersky Lab with the purpose to find out in what measure the representative office of the Russian company reports to the head office. After this the committee of the Senate of the U. S. Congress for armed forces took the initiative to prohibit use of software of Kaspersky Lab in the American army.[36]

Evgeny Kaspersky with respect thereto expressed readiness to address the U.S. Senate, having answered any questions and also to open to the American authorities source codes of the software with the purpose to get rid of charges of cyber espionage.

In September, 2017 it became known that Kaspersky Lab closes in the USA the division of Kaspersky Government Security Solutions Inc (KGSS) [37], being engaged in cooperation with the American government structures. The Bell two sources close to[38] reported about it[39]. The division which is in Washington was created for contacts with government structures which at the moment Kaspersky Labs are actually prohibited, explained The Bell source the reason for which it is going to close KGSS.
The U.S. Department of Homeland Security issued the directive in which explained that bodies have 30 days on detection in the Laboratorii software networks, 60 days — on plan development on its removal, and 90 more days — on removal. The order concerns only civil departments, but not the Ministry of Defence. However the Pentagon stated earlier, as so does not use products of Laboratory.

The center of researches and development in Jerusalem

Kaspersky Lab opened in the summer of 2017 the center of researches and development (R&D) based on the office in Jerusalem. Studying and the analysis of cyberthreats for new technologies, such as Internet of Things and the built-in systems and also for industrial management systems and cars connected to network will become the main area of work of the center.

The center in Israel became the second R&D laboratory of the company opened abroad for the last year: in September, 2016 the similar center was open in Ireland. Specialists in Israel will closely cooperate with colleagues from other countries and to share information on the last detected cyberrisks menacing to the companies and individuals.

The USA wants to limit Kaspersky: It became too widespread

Memorandum of Committee on investigation

U.S. authorities are afraid that the Russian intelligence agencies can use Kaspersky Lab to spy on Americans and to sabotage work of the key infrastructure systems of the country. The ABC News edition[40] reported about it[41]. The authorities are concerned by the fact that products of the Russian company are widely used in the USA, and not only in private, but also in a commercial and also state segment. For example, antiviruses of Laboratory are used in Federal bureau of prisons. Besides, in the territory of the USA notebooks on which it is preset by software of the Russian company are on sale.

Concern the about possible threat proceeding from Laboratory was stated in the confidential memorandum which was sent last month to the director of the National intelligence Dan Coats and the Attorney-General Jeff Sessions. The document was prepared by Committee on investigation of the U.S. Senate. The committee kindly asks to take measures in connection with potential risk which is born in itself by a wide use of products of Laboratory in the American market. It is regarded as a national security issue.

Personnel problem

The American officials are concerned by the fact that some heads of Laboratory worked for the Russian prospecting and military structures earlier. For example, the director of the company on legal issues Igor Chekunov worked in due time in the border service of Russia which reports to bodies of state security. The chief executive Andrey Tikhonov was the lieutenant colonel of the Russian army where was engaged in information technologies.

The head of Laboratory Evgeny Kaspersky answers it that both employees came to the company more than 20 years ago and that he for 100% is confident in lack at them of communications with the government.

The complaint in European Commission against Microsoft

In April, 2017 Kaspersky Lab temporarily decided not to file against Microsoft a complaint with charge of abuse of a dominant position in the market and attempt to force out developers of the antivirus software.

It is about restriction of an opportunity for installation of third-party antiviruses in Windows 10. The discontent of Kaspersky Lab is connected with the fact that the American corporation significantly reduced time for adaptation of the antivirus software of third-party developers to this operating system — from two months to six days.

Besides, according to the Russian vendor, Microsoft imposes to users of Windows 10 the Defender antivirus software to the detriment of competitors and creating obstacles for work in the market to other developers. In November, 2016 Kaspersky Lab promised to file a complaint to the European Commission.

As the founder and the head of Kaspersky Lab Evgeny Kaspersky on the sidelines of the Hannover Messe 2017 exhibition told Reuters agency (on April 24-28), the company will wait a little with the complaint, having continued to conduct with Microsoft negotiations on change of approach to work in the market.

«
They listen to us and already made some changes. It is permanent process. Of course, if Microsoft agrees to all our requirements, we will not file a complaint — Kaspersky said, having added that the decision on development of case will be made within several months.[42]
»

Meanwhile, in Russia trial between Kaspersky Lab and Microsoft is conducted. The Federal Antimonopoly Service (FAS) of the Russian Federation appointed to  June 2, 2017 consideration of the case against Microsoft on  signs of abuse of a dominant position in the Russian market.

Microsoft said that cooperate with FAS within antimonopoly case. Consideration of the case was already postponed twice: the first meeting on  case took place on December 20, 2016, it was postponed for  February 14, and  then and  for April 21. On April 21 FAS announced  case adjournment again.

In June, 2017 it became known that Kaspersky Lab addressed with the complaint to the European Commission and Federal agency on cartels of Germany on Microsoft, having accused the American company of unfair competition. According to fighters against cyberthreats, against a release of Windows 10 of Microsoft "began to create obstacles for the producers of protective solutions competing with it and by different methods to push users to failure from third-party software for benefit of Windows Defender". Believe in Kaspersky Labs that actions of Microsoft "lead to decrease in level of protection of users, restriction of their option and financial losses both users, and producers of protective solutions".

At the end of June, 2017 Microsoft published[43] the official statement concerning the complaint of Kaspersky Lab to violation of the antitrust law by the American company. In the long statement of Microsoft protects the antivirus in Windows 10 and tells about cooperation with producers of anti-virus solutions with the purpose to make OS compatible to third-party products of security. According to the author of the statement, the representative of Microsoft Rob Lefferts, Windows Defender is one of top anti-virus solutions in the market with the level of detection of 99%. "We created Windows Defender Antivirus with the purpose to convince our clients that each device running Windows 10 VSEGDA will be protected from viruses and the malware", - Lefferts said. According to the statement, Microsoft cooperates from 80% of independent software makers within the program of Microsoft Virus Initiative (MVI) allowing vendors of antiviruses to prepare for a release of new versions of Windows and to optimize under them the products to avoid problems with compatibility. Thanks to the program of testing of Windows for insiders producers can test compatibility of the antiviruses with new versions of OS.

The author of the document specifies that  Kaspersky Lab did not correct vulnerabilities which were detected at the hacker  SyScan 2014 conference in Singapore.

As specified TAdviser in the press service of Kaspersky Lab, in documents of WikiLeaks also heapgrd which actually were eliminated in 2009 is about vulnerabilities DLL inject.

The plan of the appeal to European Commission with the complaint to Microsoft

On December 12, 2016 it became known of plans of Kaspersky Lab - to address to European Commission with the complaint to Microsoft which, according to the company, does not give time for adaptation of products to upgraded versions of Windows because of what Windows Defender antivirus uses undeserved preference. The address is expected in January, 2017.

Developers of antivirus software consider - because of the decision made by the American corporation they cannot "fulfill fully the obligations to users". As a result clients are left without protection, and Kaspersky Lab sustains financial losses[45].

The essence of claims is that Microsoft does not give to developers of products of protection of software enough time, for ensuring compatibility of their products before release of RTM versions Windows 10. Developers had two months and six calendar days before release Windows 8 and Windows 7 - this time was not enough properly to modify software technologies, to provide their full compatibility and efficiency of reflection of all cyberthreats from the first day of availability of the version of OS.

When the user passes to Windows 10, and the current version of antivirus software is incompatible with this OS, the client is not informed on need of installation of the compatible version, according to developers of anti-virus products. Third-party antivirus software is removed, instead of it Windows Defender antivirus which is built in Windows OS without the explicit consent of the user to it joins.

In November, 2016 preferences of Windows Defender became the reason of the complaint of Kaspersky Lab in the Federal Antimonopoly Service (FAS). Developers of antivirus software said then, they addressed not at once regulators as Microsoft - the partner.

Now Kaspersky Lab is going to complain in European Commission of actions of Microsoft. Several months of direct negotiations with Microsoft did not bring success.

«
A few years ago Microsoft headed for reforming of the Windows platform. Certainly, intentions good — convenience, security, performance, etc. Actually, behind Microsoft scenes elegantly takes the niche markets and squeezes out independent developers from there, replacing them and offering users the products not of the best quality.

FAS initiated proceedings against the American company on signs of abuse of a dominant position (Part 1 of Article 10 of the law on protection of the competition). Evgeny Kaspersky called all independent software developers for Windows "stand together" against violation of the law.

The development plan of the platform for Internet of Things in cooperation with Tayzen.Py

Kaspersky Lab joined association "Tayzen.Py", integrating the Russian developers of IT solutions based on open operating system Tizen for mobile devices and Internet of Things (WILLOWS/INTERNET OF THINGS/IOT). Within the membership in association the company intends to work on creation of the protected platform for IoT- devices which cornerstone is OS Tizen. It is expected that corporate customers will become the first users of similar devices.

"Internet of Things develops extremely quickly. Today the set of devices is connected to the Global network: in addition to traditional computers and smartphones, TVs and video cameras, printers and routers, medical and industrial equipment, household appliances, wearable gadgets and even cars have Internet connection. However all of them were created without need to provide reliable protection against cyberthreats. Our experiments and researches show that malefactors can crack and recustomize IoT-devices without special work — and all due to the lack of any security system in these devices. With respect thereto now very much to develop separate approach to protection of IoT-devices, to think over possible vectors of threats and to create a specialized security system for Internet of Things. We will also be engaged in it within cooperation with Tayzen.Py association" — Andrey Dukhvalov, the chief of the department of perspekrtivny technologies of Kaspersky Lab explained.

Kaspersky Lab will struggle with viruses together with Europol

Kaspersky Lab and Intel Security together with Europol and police of the Netherlands started project No More Ransom ("redemption"). Its purpose consists in fight against the programs encoders infecting computers and mobile devices, doing information on them unreadable. It is possible to recover access only for "redemption", Kommersant[47] writes [48].

Within the project the website of the same name on which users can find information on threats and also free of charge use four key tools for decoding of several widespread programs encoders given after the attack is created. Besides, the website of the project allows to notify police on "attack" if an incident occurred in one of the European Union countries.

According to Kaspersky Lab, the number of the users attacked using encoders from April, 2015 to March, 2016 grew up by 5.5 times in comparison with the previous same period and made 718.5 thousand human. Most often users became the victims of the TeslaCrypt, CTB-Locker, Scatter and Cryakl programs to which share nearly 80% of all attacks fell.

"The main problem with encoders and racketeers is today in what often the victims agree to pay, without seeing other method to return access to the valuable data, – the senior anti-virus analyst of Kaspersky Lab Fedor Sinitsyn noted. – Such behavior of users leads to appearance of new players and urges on cybercriminal economy".

Kaspersky Lab cooperates several years with Europol. In June, 2014 the company rendered assistance to Europol, FBI and Government Communications Headquarters in operation on neutralization of the criminals attacking the systems of online banking using the Trojan of Shylock. Besides, in February, 2015 the anti-virus company took active part in investigation of Europol and the Interpol concerning the Carbanak grouping which abducted money from banks and payment systems worldwide.

In Russia the Pseudo-Kaspersky Lab appeared

In the summer of 2016 in Moscow the company of the same name was registered (see learn more separate article).

According to her experts, the innovation virus capable to reprogram a factory firmware of computer winchesters is created really. Thanks to it malefactors can control operation of the notebook or a desktop even after formatting of the drive or reinstallation of the operating system. It is interesting that the program can be hidden in hard drives of the famous producers, such as Toshiba, Western Digital, Seagate and IBM.

Bloomberg: LK shares data on users with intelligence agencies of the Russian Federation

On March 19, 2015 it became known of cooperation of Kaspersky Lab company with the Russian intelligence agencies. About it the Bloomberg agency was told by the being and acting staff of developer company of antiviruses. Evgeny Kaspersky denies that these relations are beyond the legal framework[49].

Office of the company, 2014

Since 2012 Kaspersky Lab was left by the high-ranking managers to the place of whom in a number of cases the people supporting communications with the Russian military or prospecting structures came writes[50]. Some of them actively help FSB with criminal investigations, using information about 400 million clients of the company. The agency refers to information obtained from six operating and former employees of firm, they refuse to discuss publicly this subject, being afraid of repressions.

According to Bloomberg, the founder of the company Evgeny Kaspersky, the former employee of KGB, weekly goes to a bath in group of 5–10 people among whom there is staff of the Russian intelligence agencies. The businessman said in an interview that group campaigns in a bath perform exclusively social funktsiya: "When I go to a bath, they become friends".

Evgeny Kaspersky, 2014

Four former insiders told the agency that communications of the company with intelligence agencies sharply amplified after two surges in departure of top managers. The first such case, according to them, happened in 2012 when Kaspersky refused partnership on the IPO with the American investment firm General Atlantic. After that the commercial director of the company Harry Kondakov distributed for internal use by e-mail the letter where it was specified that the high-ranking posts will be held only by Russians, two persons who said that they saw this mailing told Bloomberg. Kaspersky Lab denies existence of such letter.

In 2014 Kaspersky dismissed group of the high-ranking managers, reports in the publication of Bloomberg, including the technical director Nikolay Grebennikov and the president of the North American direction Steve Orenberg who asked the founder of the company to reserve only a post of the chairman of the board and to resign from the post of the CEO.

The deputy head of the company on legal issues Igor Chekunov regularly joins Kaspersky's campaigns in a bath and is a key person on interaction with the Russian government, told Bloomberg three sources in the company. The agency claims that since 2013 Chekunov directs group of ten specialists who study information from the clients who underwent the hacker attacks and provide technical support to FSB and other Russian state structures. This group has data access from all systems of the company, Bloomberg explains. According to the representative of Kaspersky Lab Sara Kitsos, Chekunov worked in border management of KGB, then served in police.

The managing director of North American department of Kaspersky Lab in Boston Chris Doggett claims that all information is anonymous. Two persons familiar with this technology told Bloomberg that from these data it is possible to obtain information on identification of separate computers and this method was used for the help of FSB at investigations.

The Bloomberg edition noted that promulgated information can cause difficulties for Laboratory: business of the company in Russia is complicated by an economic crisis whereas in the climate which developed political she already receives less orders from the American contractors.

Evgeny Kaspersky said that representatives of state structures cannot attach information collected by his company to certain clients. According to him, he should not worry about the growing pressure to show loyalty to Vladimir Putin.

"I am not that person to whom it is possible to talk about the Russian realities because I live in a cyberspace" — Evgeny Kaspersky said.

Frame from Kaspersky's interview to the Bloomberg agency, 2015

In the blog the company executive wrote:

First, a third of article — purely established, public facts which can be checked at us on the website, in our open reports and other public documents. Secondly, what was very strange (the same Bloomberg!), a considerable part of material — a lie. Outright lies. The conjectures, the assumptions, outputs based on incorrect information and in a false manner interpreted. To file a lawsuit against them, perhaps? Thirdly, the rest is exactly the fact that "dug out" Bloomberg. Secret, to nobody the unknown information which is of extreme value for the investigation and which unambiguously confirms the fact that I am the Russian spy. This information (if to eliminate all other figota): I go to a bath (when in Moscow), we dismiss managers (yes at what company of it does not happen?), many in the company speak Russian (alas, it is a genetic flaw), our yurdirector served in 18 years a srochka on border. In total.

Payment of the fee for a performance to Flynn - to future assistant to Trump

The child structure of Kaspersky Lab paid the fee to the general Michael to Flynn for a performance at a forum in Washington in 2015. In two years in 2017 Flynn was appointed the Assistant to the President of the USA of Donald Trump on national security and this fact was used in a campaign against it. Michael Flinn resigned in only 24 days after the appointment to this post because of political scandal, an occasion for which used its negotiations with the ambassador of Russia in the USA Sergey Kislyak.

Flynn received more than $11 thousand from Kaspersky Lab subsidiary company, reported Bloomberg.

"Kaspersky Lab subsidiary company of Kaspersky Government Security Solutions (now — KGSS Inc.) paid to the general Michael Flynn the fee for a performance at the forum Government Cybersecurity Forum held by KGSS Inc. in Washington in 2015" — the representative of Kaspersky Lab reported.

According to him, during Government Cybersecurity Forum cyber security problems which the governments of the different countries face, and ways of their solution were discussed, and part in work of a forum was taken "by leaders political and IT experts".

At the same time the representative of Kaspersky Lab emphasized that Kaspersky Lab is private company and though cooperates with the authorities of many countries and the international law-enforcement organizations in fight against cyber crime, it is not connected "with any government".

As in 2017 wrote Bloomberg with reference to the documents published by democrat congressmen, Michael Flynn received in total more than $56 thousand from the companies connected with Russia. In particular, he received $11,250 from Kaspersky Government Security Solutions, Inc., subsidiary company of Russian Kaspersky Lab, and $45 thousand more — for participation in the action devoted to decade of RT TV channel. During "gal dinner" which suited TV channel Michael Flynn sat near the President of Russia Vladimir Putin.

At the same time the The Wall Street Journal edition noted that for participation in a conference in Moscow Flynn received less from RT — $33,750, and two more payments — for $11,250 — he received from two Russian companies — cargo and software. The Reuters agency assumed that in a case with transport company the speech can go about Volga-Dnieper airline.

The American patent on the Russian product is taken out

On June 15, 2015 Kaspersky Lab announced the patent which is taken out from Bureau of patents and trademarks of the USA, in which system architecture of security of virtual environments is described[51]. The patented technology is used for full-function protection of virtual machines against cyberthreats without decrease in their performance.

The combination of security and optimal use of resources is reached thanks to installation of the specialized virtual machine equipped with the special module. It undertakes functions of the protective solution for other virtual machines on which the so-called easy agent in addition is established. The patent describes the communication option between the module and agents allowing the last not only to send data for the analysis and to carry out the received instructions, but also to provide the additional levers of security unavailable at traditional approach.

In virtual environments to each machine so much RAM and the processor power how many it is required for its tasks is selected. The less resources are necessary for each machine, the more machines can be started on one server. To modern measures traditional protective solutions take away not so many resources, however at simultaneous operation of a set of virtual machines total costs of security become essential. The patented technology allows to reduce this loading considerably. Moreover, presence of the agent allows to protect more effectively the virtual machine thanks to existence of direct access to her memory and deep system processes and also opportunities to use additional security technologies, such as web control, control of applications and devices.

"One of main advantages of virtualization is the efficiency of use of resources. Alas, also reefs which face in attempt to ensure safety of virtual infrastructure are concealed here, – traditional means of protecting are not optimized for virtual machines, and their application leads to significant performance penalties. Our patented technology solves this problem – ensuring reliable safety of virtual environment, we also save its efficiency. Moreover, for some virtualization platforms this technology is still only really specialized means of protecting" — Matvei Voytov, the product manager of Kaspersky Lab noted.

The patented technology is applied in the corporate product Kaspersky Security to virtual environments — the Easy agent. According to the developer, the solution protects servers, virtual workstations in an environment Microsoft Hyper-V, Citrix XenServer and VMware vSphere.

Charges of counterfeit of viruses for sabotage of work of competitors

On August 14, 2015 it became known that for 10 years Kaspersky Lab forged viruses with the purpose to do much harm to competitors. About it the Reuters agency was told two former employees of the Russian company.

According to them, within several weeks or months specialists of LK developed projects of sabotage. The task to try to decompile the antivirus software of competitors was set for them to understand how it can consider dangerous absolutely harmless files.

The former subordinates accused Kaspersky of deception of competitors
The former subordinates accused Kaspersky of deception of competitors

The decision to use special aggregators by means of which decision makers for ensuring cyber security share with each other information on malware was made. Such service is VirusTotal.

There LK anonymously sent "software of any computer which is an important part" the file which is specially infected with the harmful code. The antiviruses of other companies often borrowing others technologies instead of independent determination of threats began to consider dangerous even not modified versions of this file on computers, gave untrue reports on threats and placed important files in a quarantine, breaking work of users.

Thereby, as noted, the founder of LK Evgeny Kaspersky, wanted to revenge Microsoft, AVG,  Avast and other competitors for copying of technologies of the company and also to increase its market share. LK deny similar provocations:

"Our company never waged any confidential campaign to deceive competitors and to generate false operations for damage of their reputation in the market. Such actions are unethical and dishonest, and their legality, at least, is doubtful".

Moreover, according to Evgeny Kaspersky, his company itself fell a victim of similar sabotage in November, 2012 when its software mistakenly signaled about viruses in files of Tencent, Mail.ru and Steam companies. Representatives of Avast, Microsoft and AVG refrained from comments.[52]

Kaspersky urged "wet" competitors

On August 28, 2015 it became known that the fragment of correspondence of the founder of Kaspersky Lab (KL) Evgeny Kaspersky with one of the assistants was at disposal of Reuters agency. During communication by e-mail the famous entrepreneur urged "waste in an outhouse" competitors from AVG Technologies company.

Correspondence is dated 2009. In it Kaspersky told the following:

The fragment of correspondence of Kaspersky leaked out into mass media: the founder of LK urged \"wet\" competitors
The fragment of correspondence of Kaspersky leaked out into mass media: the founder of LK urged "wet" competitors
"Frankly speaking, me it will be very bad when AVG becomes the public company and will earn one billion. They will not tell thanks to either you, or me — do not even hope. Wet is one of methods which we will surely use in combination with others".

Follows from Kaspersky's correspondence that LK already used methods for which he called.

"We already "wetted"  — in  China. In 2002-2003 we put an end to the movement of one of  market leaders", – the founder of LK wrote to the assistant.

As told the edition one of former employees of LK, the company carried out attacks to the Chinese  company Beijing Jiangmin New Science & Technology Co for the fact that it without the conclusion of the license agreement copied identification of viruses which was made by LK.

According to former employees of LK, under expression "waste in an outhouse" which was borrowed from one of Vladimir Putin's expressions Kaspersky meant sabotage of AVG which would lead to hard errors in a company performance.

In the middle of August, 2015 the ex-serving LK told Reuters that for many years the company shared with competitors, including Microsoft, AVG and Avast, false information concerning what files are dangerous to computers. The Russian software maker denied these charges, having stated that the company "never held campaigns with the purpose to mislead competitors and to force their solutions to issue false positive operations".

As for desire to undermine work of AVG, it, as it appears from promulgated correspondence, was connected with Evgeny Kaspersky's discontent with enticement of staff of LK with the competitor.

In the comment the representative of LK reported to the edition that similar e-mails "can be not reliable and are taken from the sources pursuing the hidden aims".[53]

Part of a packet of Natalya Kasperskaya passes to Americans

In January, 2011 it became known that, the American private equity fund of General Atlantic purchased a large share block of Kaspersky Lab. It is a case of an input of the professional institutional investor, the first in the history of the anti-virus developer, in the company.

The parties do not open the size of the share in Kaspersky Lab purchased by Americans, a paid amount, but report what upon completion of the transaction of General Atlantic will become the second in value shareholder of Laboratory. The representative of fund - the managing director and the head of the European division John Bernstein will be a part of Board of Directors of Kaspersky Lab.

Evgeny Kaspersky having a controlling stake will remain the largest shareholder of the company.

The chief executive of Kaspersky Lab Evgeny Buyakin reported to CNews that the share sale agreement is signed, but "closing of the transaction still requires confirmation of shareholders and also certain legal formalities". It is expected that it will occur within 2-3 weeks.

Part of the stocks transferred to General Atlantic fund belonged to one of former shareholders of the company earlier, other part which Evgeny Buyakin called "symbolical" was released in addition. According to CNews, acted as the main seller of actions the co-founder and the chairman of the board of directors of Laboratory Natalya Kasperskaya. Evgeny Kaspersky's actions did not participate in the transaction.

Natalya Kasperskaya told CNews that the share of the new investor in Laboratory will make "less", than 20%. According to her, it saved an essential part of stocks of the company, and it has no plans to leave a chair of the chairman of the board of directors, "if only shareholders do not make other decision".

General Atlantic was an initiator of the transaction: his chief executive John Bernstein says that the fund was engaged in search of the producer of protective solutions for investment long ago and "addressed to Kaspersky Lab with the offer on cooperation about a year ago".

At the request of CNews capitalization of Kaspersky was estimated by the chairman of the board of Finam Vladislav Kochetkov who believes that all company costs $1.5 billion at presumable revenue in 2010 to $540 million now.

Sergey Belousov, the founder of Runa Capital fund and the chief executive of Parallels, also considers that "most likely, revenue of Kaspersky Lab is more than $500 million". He found it difficult to estimate capitalization of the company as Kaspersky "very well grows, and its profitability is unknown". According to Belousov, Laboratory "is more ground" not on profitability, and on growth which strongly influences its cost.

Proceeding from different estimates of capitalization and a share of the sold papers, the upper limit of the means obtained at sale of shares can fluctuate over a wide range from $200 to $300 million.

Characteristic investment strategy of General Atlantic is the input in the fast-growing companies, and an exit from them after the IPO. However, according to Evgeny Buyakin, the forthcoming public placement of papers of Kaspersky Lab in the short term does not follow from this strategy of fund. "Now the company does not plan public placement of actions, however considers the IPO as one of possible ways of development in the future", - he explained.

At the beginning of 2012 Kaspersky Lab finally refused the idea of an exit to the IPO. Besides, she made the decision to redeem the shares from the American investment fund General Atrantic which became the second in value shareholder of the company after its head and the founder Evgeny Kaspersky a year ago and also at the minority shareholders who wished to participate in recapitalization.
