Absentee arrest in fraud case

The Basmanny District Court of Moscow arrested Sergei Eskin in absentia. The wanted owner of DEPO Computers is accused of large-scale fraud (part 4 of article 159 of the Criminal Code). The newspaper Kommersant writes about this on July 28, 2022.

According to sources of the Kommersant newspaper, Eskin's case may be related to a fraud case when supplying computer equipment for the needs of the Russian Defense Ministry. We are talking about the conclusion of a large contract for the supply of a batch of laptops and USB drives for the defense department. His defendants were the junior companion of Sergei Eskin and at the same time the general director of DEPO Computers Alexei Irisov, who owned 1% of the company's shares, as well as the former head of Antey LLC Alexander Kurochkin. Initially, they were taken into custody and house arrest, respectively, but then the preventive measures were mitigated.

The court arrested Sergei Eskin in absentia in a fraud case

According to the investigation, when fulfilling the state contract, the cost was overestimated, and the conditions "for the country of production of one of the items of the equipment produced" were not met. Irisov's lawyer Dmitry Grigoriadi argued that the contract was executed "in a timely and full manner, no claims were received from the state customer," and Irisov himself "had nothing to do with the state contract directly."

The materials of the investigation were sent for approval to the Prosecutor General's Office, but then the SD of the Ministry of Internal Affairs itself withdrew its documents for unknown reasons, the publication points out.

According to Kommersant, by the end of July 2022, the whereabouts of Sergei Eskin are not known for certain to law enforcement agencies. Back in 2021, the entrepreneur, being not only a famous financier, but also a media figure, gave interviews to the media through Internet messengers, expressing his opinion on the prospects for the development of the Russian computer market.[1]

Reversal by court of decision on arrest in absentia

The Moscow City Court overturned the decision to arrest Depo Computers President Sergei Eskin in absentia in a large-scale fraud case. This was reported on September 19, 2022 by TASS with reference to the corresponding court document. It says the following:

The material, together with the petition of the investigator, should be transferred for a new trial to the same court in a different composition. }}

The reason for this decision was reportedly violations of the Criminal Procedure Code. The Moscow City Court found that the investigator did not notify the entrepreneur's lawyers by agreement and illegally brought to the trial the arrest of the lawyer by appointment in absentia.

According to Kommersant, the case against Sergei Eskin may be related to the case of fraud in the supply of equipment (laptops and USB drives) for the Ministry of Defense. The newspaper writes that the witness in this case was the former head of the order department for improving the technical basis of the control system of the armed forces of the Russian Federation (USS TOSU of the Armed Forces of the Russian Federation) Colonel Pavel Kutakhov. According to the publication, materials on involvement in other multibillion-dollar embezzlement against him and the former deputy chief of the General Staff of the RF Armed Forces, Colonel-General Khalil Arslanov, as well as military acceptance officer Igor Yakovlev were sent to a military court for consideration on the merits.

By September 2022, Depo Computers has been operating as a Russian manufacturer of storage systems, servers, computers, switches, printers and the like on the IT technology market since 1995. In recent years, the company has concluded hundreds of government contracts worth tens of billions of rubles.[2]
