Biography

2018: The story about hostile working environment in Zimmer Biomet

At the end of November, 2018 the court decided that the former vice president of Zimmer Biomet Robin Barney cannot apply for stocks of the company after the resignation in 2016.

According to Barney, she left a post because of hostile working environment, sexual discrimination and contract breach. Barney worked as the senior vice president for the international transactions and logistics since 2008, at first as a part of Biomet, and after merger of companies in 2015 in Zimmer Biomet. Barney claims that in October, 2016 the chief financial officer of Zimmer Biomet demanded from it to invent the false story explaining to investors recent errors. Barney refused. She also claims that the company forced it to forge documents on sales and deliveries of goods which were made on the platform which is already closed by regulatory bodies.

According to Barney, the CEO of Zimmer David Dvorak ordered it to leave under a false pretext in October, 2016. She refused again. At the same time Dvorak "was not satisfied with its failure and warned that the conversation is not ended". However Barney resigned on the same day, having said later that it had no choice. All incidents in general created intolerable conditions for work, and besides, Barney "did not want to get involved in fraudulent operations with securities which were performed by other company executives" as it is specified in court documents.

The district court judge of the USA Jon DiGuilio rejected Barney's claim for dismissal wage payment. Besides, the court found out that Barney cannot apply for share transfer of the company as its length of service in Zimmer Biomet did not reach 10 years. In the resolution of District court of Northern Indiana it is also specified that Barney "did not produce sufficient evidences that any of the staff of the company put pressure upon it".[1]
