Court with Lanit
Lanit beat off multimillion claims for an annual delay of the project
In November, 2017 the court made the decision on the claim of management company of technopark "Zhigulyovsk valley" - "The center of the innovative development and cluster initiatives" (GAU "The CEC WITH") - to Lanita. The center required from the contractor to pay 125 million rubles of a penalty under the agreement on work on equipment of the Center of the equipment of the Samara region in 2014-2015.
Lanit was told, in turn, by the counter action to the Center with the requirement to pay the companies of 18.5 million rubles of a penalty for unpaid amount of the equipment and works.
Having understood business, the court reduced the size of a penalty which Lanit should pay to the Center, to the amount about 19 million rubles. Lanita the court met requirements completely. As a result of the offset including also mutual compensation for expenses on the state fee, remained Lanit owes the Center about 360 thousand rubles. The court decided to collect this amount from the company.
The controversial contract was signed by the parties in June, 2014. It included works on supply of equipment, preparatory, mounting and balancing and commissioning which had to be executed till the middle of December, 2015.
Follows from materials of court that a part of goods and works within the project were delivered in time, and a part - with a delay. One of acts of the performed works is dated December, 2016 - for a year after fixed term.
The center requested payment of a penalty in 125 million rubles at the contract price in 1.25 billion rubles of which a considerable part – about 810 million rubles – equipment cost is. The contract provided charge of a penalty for violation of delivery dates, execution of works at the rate of 0.3% of the cost of the agreement, but no more than 10% of the cost of the agreement.
The court studied terms of the contract and came to a conclusion that initially stated amount was calculated incorrectly – a penalty fee on supply of equipment should be calculated proceeding from the equipment cost, and a penalty fee for delay of execution of works − from the cost of works. Besides, the court took assessment of the valid, but not possible damage caused by violation of terms of the contract into account.
Repeated delays from the Center in providing information and documentation necessary for the contractor for proper execution of works for the agreement became one of arguments to which Lanit referred in court.
Having studied arguments of the claimant and defendant, the court came to a conclusion about existence of fault of both parties in delay of execution of works and reduced the amount of a penalty fee to 19 million rubles.
In turn, according to the counter action Lanita the court considered that violation of the diagram of money transfer for works took place and awarded Lanita the complete amount demanded by him. The center at the same time stated that the payment schedule provided by the agreement had only notifying character.
In the Center as of November 21 did not solve yet whether will appeal against court's decision and told TAdviser that the resulting part of the solution was received only this day and will study it with lawyers. Lanita also did not specify the plans concerning the appeal of the solution.
Submission of the claim
At the end of April, 2017 management company of technopark "Zhigulyovsk valley" - "The center of the innovative development and cluster initiatives" (GAU "The CEC WITH") - took legal action with the claim to Lanita and the requirement to pay 125 million rubles.
On case from a card file of arbitration court follows from materials that the claim is connected with the agreement signed with Lanit in 2014 on work on equipment of the Center of the equipment of technopark "Zhigulyovsk valley". The total amount of this contract was 1.25 billion rubles.
The director "the CEC WITH" Denis Zhidkov reported to TAdviser what the organization took arbitration court with the recovery suit with Lanita of a contractual penalty. Trial of case will be performed in open court session, he added. For what the penalty is collected, in "the CEC WITH" did not specify.
Under the terms of the agreement with Lanit, for violation of delivery dates, execution of works the contractor pays a penalty at the rate of 0.03% of the cost of the agreement, not no more than 10% of its total volume.
Lanita told TAdviser that the company received the claim and studies it.
Earlier, in 2016, announced Lanit a successful completion of works on this project (see in the history below).
Obtaining certificate of Tier III Uptime Institute
In 2017 Lanit received the certificate of Uptime Institute on compliance of a data processing center of technopark "Zhigulyovsk valley" to the Tier Design and Tier Facility standards. By results about 50 tests of systems the data center in Togliatti received the level of fault tolerance of TIER III. This DPC became the Russia's seventh, Tier Facility which underwent full certification.
The data center of Colocation designed and equipped Lanity is in the two-storeyed building in the territory of technopark "Zhigulyovsk valley" and includes 8 modular halls with a total power of 2.3 MW. Lanita says that the solution is scalable and energy efficient.
Certification of DPC by the international institute consisted of two stages. First of all documentation underwent testing, and its full compliance to the implemented project was confirmed. At the second stage each system on in advance written scenario underwent check. To reveal the level of fault tolerance of DPC, tests imitated external impacts on it.
All tests were broadcast in the dispatching center which is also designed Lanity where the representative of Uptime Institute watched the happening temperature changes, energy consumption and other characteristics. One of the most difficult tasks, according to representatives of the company, was to provide a heat load of necessary power. Specialists Lanita installed 15 heat guns with power up to 100 kW. The company notes that with this and other tasks coped without notes and successfully passed all tests.
Among the experts who were present at testing of DPC there was a senior vice president of Uptime Institute Fred Dikerman.
2016: Completion of creation of data center
At the beginning of 2016 Lanit announced completion of creation of the center of the equipment (CE) for technopark under construction "Zhigulyovsk valley" in Togliatti. The integration solution represents data center Colocation corresponding to the level of fault tolerance TIER III Uptime Institute.
Lanit was equipped by technical service center with engineering and network infrastructure and also computing infrastructure which provides automation of work of the engineering systems.
As a result the customer received functional commercial data center and can place in it residents, lease spaces in racks for the equipment. This service is available not only to divisions in the territory of technopark, but also to any remote companies. Interest in placement in technical service center of technopark was expressed by many government and commercial structures. Among them: the leadership of the Samara region, the Volga region bank (the regional division of Sberbank servicing 7 areas) and other companies.
Technical service center includes six machine halls with a total area of 843 sq.m and contains 326 racks with power from 7 to 20 kW everyone. The data network is built using the HP FlexFabric and Juniper QFabric switches.
The intellectual structured cabling system of Panduit with a management system for physical infrastructure of PanView iQ allows to control far off and to automatically document a status of the physical layer of network and also to exercise intellectual control of a switching field.
According to statements of the contractor, the offered innovation cooling systems several times reduce costs for the electric power, and the systems of the uninterrupted and guaranteed power supply exclude equipment downtime probability.
The cooling system from AST Modular company including 44 modules of cooling with Natural Free Cooling fresh air is developed in four machine halls of the second floor. A system can cool the equipment of technical service center with fresh air to 90 percent of time in a year that considerably reduces costs for traditional active cooling using water chillers and draykuler.
The system of the uninterrupted and guaranteed power supply is constructed on the diesel - dynamic uninterruptible power supply units of Piller. In case of the termination of receipt of the electric power, the rotor rotates by inertia and the electrical unit continues to develop current some more seconds. This time is enough for start of the diesel generator. Thus, operation of the equipment does not stop for a second.
For ensuring fire safety on the platform the systems of early detection of the fire (an aspiration system – the sensors analyzing composition of air), automatic gas fire fighting and the system of gas elimination which eliminates a gas remaining balance after working off of the fire extinguishing system are unrolled.
Control of the building is exercised by means of the solutions constructed on the equipment of Schneider Electric company. The product Andover Continuum provides centralized operation with access, video surveillance, operation of the security and fire warning. Fire detectors of machine halls and equipment rooms manage start of a system of automatic gas fire fighting and the system of gas elimination.
The automated system of scheduling, monitoring and management of the engineering systems allows to manage by means of a set of sensors climate and power supply, practically without participation of the person.
Systems are connected among themselves by means of technology network segment of data transmission. The software is set on virtual machines, data backup is provided. The equipment is assembled in a failsafe configuration and placed in modular premises of Smart Shelter providing reliable protection of technical service center against the fire, moisture, vibration and other external influences.
2014
In July, 2014 the Center of the innovative development and cluster initiatives of the Samara region signed with Lanit company the contract of 1.25 billion rubles for work on equipment of the Center of the Equipment (CE) of technopark "Zhigulyovsk valley" in Togliatti.
Contractor Selection
The contractor for this project was selected by an open competition in which, in addition to Lanita (revenue in 2013 - more than 77 billion rubles, the 2nd place in the rating of CNews100: The largest IT companies of Russia of 2013[1]), also submitted applications for participation Nvision Group integrators (39.4 billion rubles, the 4th place),Technoserv (40 billion rubles, the 3rd place) and R-Style (revenue in 2012 - 36 billion rubles, the 6th place).
In the course of tendering on actions of the customer two complaints FULL FACE arrived. The first Technoserv addressed to antimonopoly service. Among claims of the company - the requirement of the customer that participants of tender had the licenses of FSB and FSTEC confirming powers to work with confidential information and a state secret while the project does not provide in technical service center of technopark "Zhigulyovsk valley" of such need.
Excess qualification requirements to participants of tender in the form of need to provide copies of different certificates which, according to the company, are also not obligatory to perform project works became one more claim of Technoserv.
In addition, Technoserv noted that the tender documentation contained data on a subject of biddings in the volume insufficient for preparation of the application for participation in them, and did not set a payment procedure of the works which are a tender subject that is contrary to the law. FAS recognized the complaint of Technoserv reasonable and directed the customer to eliminate violations.
The second complaint FULL FACE to the Center of the innovative development and cluster initiatives of the Samara region arrived from Nvision Group after the tender results were summed up. The company tried to dispute legitimacy of the choice by the contractor Lanita.
In the complaint of Nvision Group it is noted that at tender bid evaluation indicators of qualification of the participant of tender and compliance of its offer of terms of reference prevailed, at the same time in the tender documentation there were no quantitative indices by these parameters. For example, the number of earlier implemented agreements, the number of the certified employees, etc. can be like those. At the same time as the price of the agreement under which Lanit gained "0" points was allocated for assessment of such important indicator an insignificant part, said in the complaint of Nvision Group.
However, soon the company withdrew the complaint. Why the decision it was made to make, in Nvision Group did not explain. On the tender the company stated the price of works below, than Lanit - 1.142 billion rubles of Software of the lowest working costs suggested to execute R-Style - for 1.099 billion rubles.
What should be made within the project
Technical service center is one of objects of technopark where servers,DWH and other equipment which then will be used under lease by the companies placed in technopark will be installed. Lanita notes that for such hi-tech equipment special operating conditions are necessary: power supply, the thermal mode, humidity level, etc. therefore is economically reasonable to place the equipment in one center.
Representatives Lanita told TAdviser that as of the middle of August, 2014 the building box is already constructed. The doproektirovaniye and making changes in the existing project enters tasks of the company at the first stage; certification of the project in Uptime Institute; preparatory work on technical service center building; ensuring input of communication channels; creation of a complex of engineering support on the 1st floor and one hall of the 2nd floor of technical service center and a commissioning of the mounted equipment; installation and a commissioning of the IT equipment in the created halls (the network and server hardware and the equipment on information security support); carrying out acceptance tests and input of premises of the 1st stage in operation.
The second stage includes creation of a complex of engineering support of DPC in 3 remained halls of the 2nd floor; installation and commissioning of refrigerators; delivery, installation and commissioning of the fourth diesel dynamic UPS; installation and a commissioning of the IT equipment in 3 remained halls (the network and server hardware and the equipment on information security support); carrying out acceptance tests and commissioning of the facility.
Main difficulties
According to representatives Lanita, complexity of this project consists, first of all, that completion and adaptation of the existing project should be carried out to a short time. According to terms of reference, they are designated December, 2014. For this reason the innovative solutions will be used, and it is necessary to build in already existing equipment them, speak in the company.
For example, hi-tech modular constructions which are quickly built will be applied. The system of ambient cooling on Fresh Air Cooling technology, in turn, is applied to cost reduction on electricity (the expected economy will make 20-30%).
Lanita added that their company already has an experience of implementation of similar projects: this creation of the hi-tech modular DPC, largest in Russia, for VimpelCom of 3000 sq.m in the Yaroslavl region. Each its module has own systems of electrodistribution and active ambient cooling of Natural Fresh Aircooling.
Later the contract underwent changes: final date was removed for more than 15 months — for April 1, 2016.
