Fund of an overhaul of apartment houses of the Penza region

Since December 26, 2012 the changes in the Housing code of the Russian Federation made by the Federal law of December 25, 2012 No. 271-FZ "About introduction of amendments to the Housing code of the Russian Federation and separate legal acts of the Russian Federation and recognition become invalid for specific provisions of legal acts of the Russian Federation took effect". The called law, in addition, to the Housing code enters Section IX "The organization of capital repair of a common property in apartment houses" and also the concept "Regional Operator" is entered.

According to changes of the federal legislation, Legislative Assembly of the Penza region the Law of the Penza region by ZPO No. 2403 "About the organization of capital repair of a common property in the apartment houses located in the territory of the Penza region" was adopted on June 28, 2013.

Thus, creation of regional operator – NPO "Fund of an overhaul of apartment houses of the Penza region" became the investigation of innovations in the federal and regional legislation, in the Penza region.

The fund of an overhaul of apartment houses of the Penza region performs the activity aimed at providing the organization and timely capital repair of a common property in apartment houses in the territory of the Penza region at the expense of contributions of owners of premises in such houses, budgetary funds and other financing sources.

According to the Law of the Penza region and the Charter Fund

• accumulates the contributions to an overhaul paid by owners of premises in apartment houses concerning which funds of an overhaul form on the account, accounts of regional operator;
• opens special accounts on the name and makes operations with these accounts if owners of premises at a general meeting in selected the regional operator as the owner of the special account from an apartment house;
• conducts separately concerning each owner of premises in an apartment house accounting of the means which arrived into the account of regional operator in the form of contributions of owners of placements in the apartment houses creating funds of an overhaul on the account, accounts of regional operator on an overhaul;
• performs functions of the technical customer of works on an overhaul of a common property in apartment houses, owners of premises in which create funds of an overhaul on the account, accounts of regional operator;
• finances expenses on major repair of a common property in apartment houses, owners of premises in which create funds of an overhaul on the account, accounts of regional operator, within means of these funds of an overhaul with attraction in need of the means received from other sources, including from the regional budget of the Penza region and (or) the local budget;
• interacts with public authorities of the Penza region and local government authorities for the purpose of ensuring timely capital repair of a common property in apartment houses, owners of premises in which create funds of an overhaul on the account, accounts of regional operator;
• creates the common information space providing transparency of cash flows for control of target use of means by the regional operator according to the legislation.
