Case from practice of import substitution: As the Russian solutions on state procurements are cut

In August, 2017 FAS^[1] of Master company to actions of the customer at equipment procurement recognized unreasonable the complaint and the software of a video conferencing (VIDEOCONFERENCING) for Management of social protection of the population of the Lipetsk region.

The organization specified in purchase^[2] the requirement to deliver it licenses softwares of Microsoft Lync (Skype for Business) for expansion of the available system, having excluded a possibility of use of equivalents of this product due to the need of integration with already used at it Microsoft Lync Server.

"Master" who came on the tender with a product for VKS of TrueConf, considers that such requirements to goods limit the number of procurement participants. Also, according to the company, in documentation there is no proper justification of impossibility of observance of prohibition on the admission of import software, and the instruction concerning the trademark without indication of equivalence is violation of the law about a contract system.

In Management of a social security of the Lipetsk region told FAS that the instruction on purchase of licenses of client access to Microsoft Lync does not attract restriction of number of participants since any participant can deliver them.

In turn, purchase of client licenses softwares VIDEOCONFERENCING of the Russian producers will not allow owners of such licenses to participate in the sessions of a video conferencing organized using the population of the Lipetsk region of the software applied by organizations of social protection - Microsoft Lync, the customer claims.

For expansion of the VKS system using products from the register of domestic software, he should refuse failure Microsoft Lync Server which is already set at it and purchase not only client, but also server parts of software products. It is economically inexpedient, the customer said.

FULL FACE reckoned arguments of Management of a social security of the Lipetsk region. The customer has the right to turn on in the description of a subject to purchase of characteristic of goods, meeting his requirements and necessary for accomplishment of the corresponding state functions, said in the FAS decision.

TrueConf told TAdviser that do not agree with the solution of the antimonopoly regulator. Apparently, FAS did not penetrate into technical capabilities of the solution proposed as an alternative. The development director of TrueConf Dmitry Odintsov told TAdviser that in TrueConf Server full integration from Skype for Business is implemented: "about it we said at the beginning of this year publicly. We have all information in open access on the website, i.e. it is quite simple to check it". Specialists of the company enclosed many resources in support of protocols and codecs of Microsoft, he added.

At the same time TrueConf is not required to buy separately both server, and client licenses in a case with VKS: at the level of the server license the limit of number of simultaneous connections of users is regulated.

Dmitry Odintsov says that neither FAS, nor the customer, nor the external expert addressed TrueConf as vendor with official request for refining of existence of necessary functionality. Situations when the regulator at analysis of similar situations does not go deep into technical capabilities of goods, arise quite often, note in the company. Probably, involvement of experts is quite difficult mechanism, and FULL FACE try to do without it, Dmitry Odintsov believes.

I will notice that there were situations when on the same complaint on identically prepared by terms of reference, two absolutely different in fact answers were given, - the representative of TrueConf says. - Unfortunately, the solution often depends on the identity of the specific customer.
