2017: A dispute with Minpromtorg on structure of the register of suppliers of medical products from PVC

As it became known at the end of October, 2017, the Viroban company, producer of medical products from polyvinylchloride (PVC), intends to dispute the decision of Minpromtorg on inclusion in the domestic register of suppliers of medical products from PVC-plastics only of one company — Medpolimerprom Group. According to the statement Viroban, the requirement to potential participants of the register initially predetermined results of selection.^[1]

Orders of the Government of the Russian Federation

In August, 2017 the prime minister of the Russian Federation Dmitry Medvedev signed two government decrees which entered account medical products from PVC for medical ventilators, blood transfusions, artificial blood circulation and a plasma exchange in the list of products getting under action of the rule "Third wheel" and entered other scheme of public procurements of these products. It was entrusted to Ministry of Industry and Trade to maintain a register of the companies which are actively investing in development of local production which products will be mainly bought by state companies.

Reason of discontent with Viroban

The above-named register of suppliers was published by Minpromtorg at the beginning of October, 2017. As it appeared, only one organization — Medpolimerprom Group belonging to the co-owner of TD "Medpolimer" Alexey Borisov and the former chairman of the board of directors of VAM group Eugeny Spector was entered to it. The Viroban company discordant with such solution, in turn, distributed the message about plans for the appeal to the Government of the Russian Federation, the Ministry of Health, Roszdravnadzor and the Government of the Moscow region with a request to review criteria of inclusion in the register. On belief of Viroban, as it stands they are excessively tough.

In the message the company emphasizes that high requirements to suppliers "not only eliminated the competition from foreign producers, but also limited entry into the market of the domestic plants, many of which work not one decade". If criteria are not reviewed, then it is necessary to the Russian suppliers of medical products from PVC-plastics who were not included in the list "or to find the new markets, to switch to release of other products, or just to be closed — due to the lack of demand", said in the statement Viroban.

Requirements to suppliers

According to government decree No. 967 of August 14, 2017 to be included in the exclusive list, the supplier should correspond to a number of requirements, including: have not less than seven registration certificates on medical products which are manufactured in Russia, and not less than seven patents for the component parts or components used by production of medical products from PVC-plastics. Income of the organization applicant from sale of medical products should be at the same time at least 700 million rubles for the last three years.

Among other requirements — use of technologies and materials which were developed at the expense of budgetary funds, including within the "Development of the Pharmaceutical and Medical Industry" state program for 2013-2020.

Alternative opinion

In return the chairman of the board of directors Medpolimerprom Eugeny Spector called the set criteria sufficient, emphasizing that it is not just about providing the Russian medical institutions with quality medical products, and about the project of revival of the Russian polymeric industry which could compete successfully with foreign analogs in the world market.

He also specified that the version of the register provided by Minpromtorg — final, and Medpolimerprom Group already signed the relevant agreement with department, and inclusion of other companies the set regulations is not provided.
