By data SPARK-Interfax, revenue of Medtekhnika in 2016 made 40.8 million rubles at net profit in 224 thousand rubles. Assets of the plant are estimated at 19.2 million rubles.[1]

2018

Attraction to subsidiary liability of the ex-CEO of Iatrotechnics on debts of the plant

In December, 2018 the former director of "The Kazan Iatrotechnics plant" within bankrupt case is pursued by the decision of Arbitration court of Tataria secondary liability on debts of the enterprise. The amount of requirements to Igor Kushnikovsky was 40.23 million rubles. As the receiver specified in the statement, "the basis for attraction to subsidiary liability of the defendant is bringing the debtor to a bankruptcy status in way commission of the suspicious transactions which are not equitable to the interests of the debtor and his creditors". Kushnikovsky's son appeared in one of transactions, Regnum news Agency tells on December 7, 2018.

In the petition of the receiver, in particular, it is specified that during the activity the defendant granted to NPP Ekosfera LLC right to use of the production premises of 515 sq.m which was constructed in 2015 on the permission issued to "The Kazan Iatrotechnics plant". At the same time neither the rent, nor a payment for the electric power was levied from NPP Ekosfera which placed the equipment in these premises. Moreover NPP Ekosfera LLC free of charge used the production equipment (machines — listogibochny, scissors guillotine, the cutting machine) belonging to Iatrotechnics.

As it is specified in case papers, in November, 2017 lease agreements on the equipment and the premises, payment for which followed, were signed. However on July 11, 2017 NPP Ekosfera signed the loan agreement with "The Kazan Iatrotechnics plant" for 2.1 million rubles, at the same time the debt as of December 7, 2018 is not repaid.

A founder of NPP Ekosfera LLC till August, 2017 was Ekofarm-service LLC as which founder and the director, in turn, Igor Aleksandrovich Kushnikovsky acted. On August 18, 2017 between Ekofarm of Service (seller) and Kushnikovsky Konstantin Igorevich (the buyer, Igor Kushnikovsky's son) signed the purchase and sale agreement of a share in authorized capital of NPP Ekosfera LLC. As the result, the founder and the director of NPP Ekosfera became Igor Kushnikovsky's son.

On November 7, 2016 between the plant and SUE Tattekhmedfarm the contract of delivery of the equipment for the amount of 4 977 750 rubles was signed. After receiving 100% prepayment according to Igor Kushnikovsky's order the loan agreement was signed with Ekofarm LLC, and a part of the amount received from state unitary enterprise in the amount of 2.1 million rubles was listed to Ltd company. The company had to return a loan till August 10, 2017.

The financial manager considered that actions of the defendant with affiliates in issue of a loan and non-paid use of property of the debtor "did harm to the debtor and his creditors".

At the same time Kushnikovsky I. A. knew about insolvency of Ekofarm LLC, and that it is not capable to perform the obligation undertaken according to the loan agreement of 7/11/2017 as according to the certificate of incorporation was his director and the founder, reported in case papers with refining that only credit debts of Ltd company to PJSC B&N Bank at the time of signing of the contract made 34 576 182,59 rubles.

Also Ekofarm LLC owed 19 780 260,96 rubles of KBER Bank Kazani LLC. The debt under the agreement of assignment was transferred to Olimp broker company.

On December 7, 2017 Ekofarm LLC was declared bankrupt and concerning it the procedure of bankruptcy proceedings is entered. Igor Kushnikovsky also issued the guarantee of JSC Kazan Iatrotechnics Plant under the credit in B&N Bank for Ekofarm LLC and a mortgage of the real estate of JSC Kazan Iatrotechnics Plant, and for December 7, 2018 the bank is a mortgage creditor of the plant.

Besides, according to the financial manager, "doubtful agreements on carrying out installation and construction works" in the plant building were signed, but at the same time "documents (KC 1 forms) in accounting are absent, works are not performed" though money was transferred. The arbitration manager at the same time found out that the information about founders (participants) of Iatrotechnics and also about holders of shareholder registers of the Kazan plant in the USRLE is absent.

These circumstances interfere with identification of other persons controlling the debtor for the purpose of attraction to subsidiary liability together with the debtor's head — it was noted in the arbitration court ruling.

The decision on attraction to subsidiary liability is performed immediately, but can be appealed. Judicial proceedings on bankrupt case of the plant are suspended before the end of settlings with creditors.[2]

Repeated claim of B&N Bank for bankruptcy of KZMT

The arbitration court of Tatarstan accepted the claim of B&N Bank in which he requires to declare bankrupt of Kazansky zavod medtekhnika (JSC). A claim was submitted on May 14, 2018, but so far to production is not accepted, the correspondent of Regnum news Agency reported on May 16, 2018.

The amount of claims of bank, in February, 2018 trying to make bankrupt the plant, is about 34.6 million rubles. Legal justification of these claims of B&N Bank will be checked by court on May 24, 2018.

As noted, in base of arbitration court the iatrotechnics is dealt with similar claims to "The Kazan plant". A claim was submitted by the natural person later replaced with NPO Analitik-LAB, in the middle of November, 2017. the Amount of Claims Was 300 Thousand Rubles. in This Claim the Court Recognized on April 16, 2018 the Liquidated Debtor — Kazansky zavod Medtekhnika LLC — insolvent and opened bankruptcy proceedings against him for a period of six months — till October 16, 2018. Zufar Sharipov is approved as the receiver.

According to the financial analysis of the debtor provided by the chairman of liquidation commission the debtor has fixed assets in the amount of 2 742 739,69 rubles, inventory items for the amount of 340 457.57 rubles, receivables in the amount of 7 746 682 rubles, accounts payable are 8 001 156 rubles, said in court's decision which entered bankruptcy proceedings.[3]

Reorganization canceling

In the USRLE there is a mark about canceling in the middle of March, 2018 of earlier made decision on reorganization of JSC Kazan Plant Iatrotechnics (KZMT).

Bankruptcy

From the middle of April, 2018 "The Kazan Iatrotechnics plant" (KZMT) is a bankrupt and is under bankruptcy proceedings till January 22, 2019.[4]

The B&N Bank demanded to declare the plant bankrupt

As it became known in February, 2018, the B&N Bank through court demanded to declare bankrupt "The Kazan Iatrotechnics plant".

The claim of B&N Bank to the plant was registered on February 6, 2018, at the same time the amount of requirements for it, according to data of a card file of affairs of Arbitration court of Tatarstan, was 10 rubles. As of February 7, the claim is considered in the first instance so far.

By data from open sources, Iatrotechnics is engaged in repair and maintenance of the medical equipment and has the agreement with several treatment and prevention facilities of Tatarstan.

2017: Claims of creditors

In the middle of November, 2017 from creditors of the plant claims with the requirement to declare the company bankrupt began to arrive. Among the largest creditors — PJSC B&N Bank (a debt to it — over 34.576 million rubles).

1994: Formation

The JSC Kazan Iatrotechnics Plant enterprise (KZMT) is created by reorganization in August, 1994, the company conducting the history since 1956.
