Compulink lost in court to the partner in reconstruction of testing facilities for space rockets of Roskosmos

2020: Compulink lost multimillion process because of the project for Roskosmos

On March 19, 2020 it became known that to the system integrator "USP Compulink" it is necessary to pay to the partner in the project for "Roskosmos" about 67.2 million rubles debts and penalties and also a penalty fee which exact volume will be calculated only in day of its repayment. This partner is JSC Mera Research and Production Center. Its parent company, Mera scientific and production enterprise LLC positions themselves as the developer and the supplier of onboard and managing measuring systems for industrial test stands.

The decision on payment of the above-mentioned amount by Compulink was made by Arbitration court of Moscow which SPC Measure took with the claim on October 11, 2019. The agreement between integrator and the center of July 31, 2018 on 294.6 million rubles on delivery of the unnamed equipment in court's decision became cause of action. "Measure" considered that the customer was calculated with it for the equipment not fully, and the court with its arguments agreed in full.

During trial Compulink submitted the countering statement about collecting from Measure of 7.3 million rubles a penalty for delay of delivery of goods. However the court rejected this claim.

The conflict arose at implementation of the project under the name "Reconstruction of the B2B Stand for Ground Tests of the Propulsion System of Upper Steps of the Carrier Rocket with Simulation of Regular Operating Conditions". The analysis of the website of state procurements shows that in December, 2017 Compulink signed the contract for implementation of the project with such name for the amount of 2.24 billion rubles with Roskosmos.

Directly purchase was placed by the "Scientific and Test Center of the Space-rocket Industry" (Research Center RCP) enterprise entering into state corporation from the city of Peresvet situated near Moscow. Except Compulink more nobody came to tender therefore he received the contract is uncontested.

In a contract card for March of 2020 year of its execution it is registered on November 30, 2020 and there is an instruction on the fact that the cost of the obligations fulfilled by the supplier is 682 million rubles while actually 792.1 million rubles are paid to it. That fact that if data of a card on state procurements are relevant, then after 27 months of project implementation, in 8.5 months prior to its end the obligations fulfilled by the contractor are estimated less than at a third of the budget of reconstruction attracts attention. At the end of 2018 the integrator had to get for the performed works of 1.25 billion rubles in time.

Compulink could not answer a question in what stage of readiness there is a project and whether the delay threatens it. Also in the company could not report whether arranges its court's decision, and whether its appeal is planned.

From documents on the website of state procurements it is possible to conclude that reconstruction of the test stand which is performed by Compulink represents repair and upgrade of a number of engineering constructions of testing facilities of Research Center RCP in Peresveta. The base is positioned as the testing complex, largest in Russia, for working off of broad range of products of the missile and space equipment. Its total area is 10 thousand sq.m. In a year on it about 20 tests are performed.

The complex includes the bench body, the bunker of management, pumping the station, water reservoirs, the mounting body, panel board, platforms of pipelines of alcohol, oxygen and vapors of hydrogen and so forth. The most part of constructions was built in the 1960th years and for 2020 defects of walls, overlappings, beams, etc.

The technical project provides gain and recovery of constructions, warming of constructions, underground laying of a water supply system, the sewerage, electrocables, grounding, communication wires, the pipeline of draining of liquid oxygen and also installation of the interception rod, re-planning of premises with the device of brick partitions improvement of the adjacent territory etc.[1].
