2020: 2 years conditionally for the death of the girl because of the rejected ventilator

On June 30, 2020 the Zlatoust city court of Chelyabinsk region pronounced a sentence to three doctors of city hospital No. 2 in Zlatoust in which in 2017 the 2-year-old girl because of connection to the rejected ventilator died.

The chief physician of hospital Natalya Akhtaryanova was put on 2-year probation. Also she was forbidden to hold executive positions during the same period. Akhtaryanova was found guilty according to Part 2 of Article 293 of the Criminal Code of the Russian Federation (the negligence which entailed the death of the person by negligence), her subordinates – according to Part 2 of Article 109 of the Criminal Code of the Russian Federation (negligent homicide owing to improper execution by the person of the professional duties).

Two other defendants in the case – the pediatrician Nina Vyyukova and the resuscitator Anton Bogdanov – sentenced to two years of restriction of freedom, but in connection with lapse of time of criminal prosecution of the doctor are exempted from punishment.

Besides, the court obliged physicians to pay to parents of the died child 10 million rubles of moral compensation.

The tragedy happened on July 8, 2017 in Zlatoust. The two-year-old girl was brought in a serious condition to intensive care unit of hospital No. 2. She choked because of a severe stenosis of a throat. However doctors underestimated severity of a situation, and instead of emergency measures and connection to the medical ventilator appointed simple inhalations.

The child of 5 hours choked in intensive care unit. When the girl was connected nevertheless to the ventilator, it turned out that the device is faulty. The term of its operation expired three years ago, tubes and internal parts were littered. 

The prosecutor said that the chief physician knew about fault, but did not take any actions. Moreover, in resuscitation instead of a cylinder with medical oxygen there was a cylinder with industrial oxygen. The two-year-old girl felled into a coma, and in six hours after hospitalization died.[1]
