2022: Fine of 10.5 million rubles for cartel conspiracy
In mid-March 2022, the Office of the Federal Antimonopoly Service (FAS) in the Krasnodar Territory recognized the local company Alfa-Med as a member of a cartel conspiracy and fined it a little more than 10.5 million rubles. The supplier of medical equipment violated Part 2 of Art. 14.32 of the Administrative Code of the Russian Federation ("conclusion of a competition-limiting agreement, implementation of coordinated actions limiting competition, coordination of economic activities"; the offender may be fined up to one second of the initial value of the bidding item).
According to the antimonopoly department, Alfa-Med LLC and three individual entrepreneurs, being competitors, entered into a cartel agreement. Its goal was to keep the price at a high level with participation in tenders for the supply of medical products and consumables. According to the FAS, in this way they influenced prices in 40 electronic auctions.
During the audit, it was found that the parties to the agreement created an imitation of competition at auctions. Bidding ended with the conclusion of contracts with the winners with a minimum decrease from the initial price. Moreover, when the members of the cartel themselves participated in the procurement, on the contrary, together they reduced the price of contracts - in some cases to 35%.
The Commission of the Krasnodar OFAS of Russia found that the total income received by the parties to the agreement on electronic auctions amounted to more than 69 million rubles.

2020: Fine of 20 million rubles for bribes in public procurement
In mid-September 2020, the Maykop Magistrates Court fined Alfa-Med 20 million rubles for participating in a corruption scheme in public procurement. Also, in order to ensure the execution of the decision on the imposition of administrative punishment, the court seized the property of the company with a cadastral value of more than 8 million rubles, the press service of the Adygea prosecutor's office reports.
According to the prosecutor's office of the Republic of Adygea, an employee of Alfa-Med LLC in 2019 transferred money to the deputy chief physician of the Maykop City Clinical Hospital for the company to be awarded victories during electronic auctions for the supply of medicines, furniture and medical products. The size of bribes is not reported.
As a result of the audit, the prosecutor opened an administrative offense case against the company under part 2 of article 19.28 of the Administrative Code of the Russian Federation (illegal remuneration on behalf of a legal entity). In relation to the deputy head physician of the city hospital, who, according to the investigation, received bribes, a criminal case was initiated and investigated under Part 6 of Art. 290 of the Criminal Code (receiving a bribe on an especially large scale).
The Maykop Magistrates Court found convincing the arguments of the prosecutor's office that the contracts went to the company thanks to patronage, and fined the legal entity.
In addition, the Adygea Department of the Federal Antimonopoly Service has claims against the supplier of drugs and medical devices. By mid-September 2020, the regulator is considering the case of the participation of Alfa-Med in the cartel. Details of the audit were not disclosed.
According to RusProfile.ru, the Maykop City Clinical Hospital is one of the five largest customers of Alfa-Med. In total, 13 contracts worth more than 23 million rubles were concluded between them.[2]
