2020:2 years of a penal colony for the death of a patient

In mid-October 2020, the Dorogomilovsky District Court sentenced beautician Julia Kachan to two years in a penal colony for the death of a patient. The doctor was found guilty of committing a crime under Part 2 of Art. 238 of the Criminal Code (the provision of services that do not meet the requirements of safety of life or health of consumers, resulting in the death of a person by negligence).

The accused, who did not have a higher medical education and a medical license, provided cosmetic services. One of the patients who came to her appointment in the summer of 2019 died of anaphylactic shock. The girl was given toxic doses of lidocaine.

According to Moskovsky Komsomolets, an examination showed that there were traces of a medical needle on the woman's body. The beautician assured that she and the nurse tried to bring the client back to life and injected her with medication. Kachan said that the woman could take heavy drugs, she was in tremor, she had dilated pupils. The incident occurred in the office, which Kachan rented in one of the capital's clinics.

The state prosecutor of the Dorogomilovskaya interdistrict prosecutor's office asked for Yulia Kachan three years in a penal colony. From a harsh sentence, Kachan burst into tears, but she was taken into custody, the newspaper notes.

The "gray" sector of the cosmetological services market - home cosmetologists, people who carry out procedures without education and a license, counterfeit products - is a long-overdue problem that various organizations are trying to fight. For example, the National Association of Clinics of Aesthetic Medicine proposed to tighten responsibility for the provision of cosmetic services in improper conditions and without a medical license, increasing the fine from the current 500-2,000 rubles (according to Article 14.1 of the Administrative Code of the Russian Federation) to 500 thousand rubles.[1]
