The company purchased the products InfoWatch, but could not implement them and requires to return money

Resurstrans, provider of services of transport outsourcing, filed a lawsuit against InfoWatch Center entering into the InfoWatch group and requires to return money for the software delivered to it. Told about this TAdviser in Resurstrans. A claim was submitted on November 18, 2020.

As explained in Resurstrans, their company purchased the licenses for the InfoWatch DLP system including licenses for such products as InfoWatch Traffic Monitor Enterprise edition, the software components Info Watch OCR module, Info Watch Person Monitor, Info Watch Traffic Monitor Enterprise Edition Advanced, the Info Watch Person Monitor Advanced component. Software was transferred to use for one year since December 26, 2019.

Infowatch Traffic Monitor is intended for privileged information loss prevention on the basis of the content analysis of information flows, and InfoWatch Person Monitor - for the tool for monitoring of personnel collecting data on actions of the employee in a workplace.

In Resurstrans say that to apply InfoWatch software to work it was impossible

The specialist in cybersecurity Resurstrans Alexey Borisov specified TAdviser that was purchased by software on 250 users. Implementation happened by forces of IT service of the company from December, 2019 to June, 2020.

However to apply software to work it was impossible, declare in Resurstrans: "even during process of a commissioning it became clear that all actions of users on a terminal server slowed down, blocking normal work of staff of the company". It was caused by increase in the maximum loading of the server and its CPU. The company claims that at the same time completely observed terms of reference of InfoWatch Center to a technical configuration of terminal servers and provided the 3-fold power reserve of the equipment necessary for normal functioning of a system.

Alexey Borisov told TAdviser that standard loading of the server – 90-100 people, and at start of all modules softwares and loading over 50 people the server ceased to function.

As a result of analysis of a situation it was revealed that the problem arises because of an error in software of InfoWatch Traffic Monitor. The developer recognized a problem and appropriated it the highest degree of importance. It means that the error causes catastrophic failure or threatens integrity of all system or data, - tell in Resurstrans.

According to Alexey Borisov, the company repeatedly tried to solve a problem with engineers of InfoWatch Center, but the error in software was not corrected within 9 months therefore Resurstrans addressed with the requirement to terminate the agreement and to return the money paid for licenses. According to a card file of courts, the amount of claim requirements is about 1.2 million rubles.

As a result of pre-judicial negotiations of it it was not succeeded to make. The supplier did not accept a claim, having proved it by the fact that Resurstrans did not sign the act of commissioning of software. We in return consider this requirement groundless as the license agreement with InfoWatch Center provides only assignment of rights on use of the program by, in addition, installation, start. The supplier did not render us service in installation and software implementation, respectively about any act of input in operation of the speech cannot go, - Alexey Borisov says.

Besides, he added, the act of commissioning is not applied to intellectual property items. Having faced such position, the company decided to take legal action. Resurstrans considers that it of InfoWatch Center did not fulfill the requirement of the agreement and also a condition own terms of reference.

In addition to software of InfoWatch "Resurstrans" also considered the solution StaffCop which develops Atom of Security, Alexey Borisov told TAdviser. However it did not suit the company on required functionality.

However instead they made the decision to take out a discussion in media. Obviously, it is not an optimal way if the purpose is to find the solution of any questions or to reach agreements.

Amir Dautov added that probably in this case it is not about building of constructive dialogue, and about drawing attention attempt. Having studied the message Resurstrans concerning the legal claim, the company noted that in it there are a lot of actual inaccuracies or at all the distorted information.
