2021: Payment of 2 million rubles for the death of a child from appendix

In early June 2021, the Vasileostrovsky District Court of St. Petersburg issued a verdict in the case of the death of a one and a half year old child from acute apptraditiitis due to untimely treatment.

In June 2017, a child with suspected apptraditiitis entered the Children's Infectious Disease Hospital No. 3 of St. Petersburg. However, the doctor did not organize a surgeon's examination and consultation in a timely manner. According to the court, the attending doctor examined the child only two days after hospitalization.

As a result, the child was not diagnosed with acute inflammation on time and did not undergo surgery. Due to a late transfer to surgery, the baby died of peritonitis, the joint press service of the courts of St. Petersburg reported.

According to Fontanka, the attending doctor suggested, coming down from the symptoms, that the child has acute gastroenteritis, although its signs are very similar in children under 2 years old with signs of appendix. The child was transferred to the Filatov hospital, where doctors fought for his life for three days, but could not save the child.

The court reclassified the actions of the doctor from part 2 of article 293 of the Criminal Code of the Russian Federation (negligence) to part 2 of article 109 of the Criminal Code of the Russian Federation (causing death by negligence). The accused pleaded not guilty. The court appointed two years of restriction of freedom, but she was released from punishment due to the expiration of the statute of limitations. 2 million rubles were recovered from the hospital for compensation for non-pecuniary damage in favor of the parent of the deceased child.

"Fontanka" called the Children's Infectious Diseases Hospital No. 3 by phone of the head physician Galina Tyuleneva. The man picked up the phone, who said that the head of the hospital was on the forum. When asked to comment on the court's decision, he replied that he would not comment, but the hospital would sue (apparently due to a fine). When asked to introduce himself, he stated that he was "no one," and hung up.[1]
