One of the largest casinos Wynn Las Vegas of Las Vegas filed a lawsuit the claim against IBM corporation: managing casinos are sure that they in vain overpaid nearly $10 million for licenses of the Maximo EAM system.
The giant casino Wynn Las Vegas submitted a claim against IBM, having accused vendor of collection of an unjustified big payment for licenses of software which uses casino for management of the primary activity and deliveries of the objects belonging to it.
In the statement of claim representatives of Wynn insist that the company under pressure of vendor was forced to pay mistakenly the total cost of licenses of the IBM Maximo system even for those employees who were users only of basic functionality of a system. Thus, according to the company, IBM was succeeded to receive $9.7 million not justified license payments from management company of casino.
"If to follow logic of IBM in relation to licensing of software in Wynn, then each employee of the company using Maximo, including all housekeepers who use a system only for elementary reports and registration of guest requests, had to have own license for this software cost in several thousands of dollars piece", said in the claim of Wynn submitted last week to federal court of Nevada.
Wynn manages in Las Vegas Wynn and Encore hotels where the specified software was used. The management company claims that in total IBM levied from them a payment for 2000 additional licenses of Maximo which cost varies from $2300 to $4600 for unit.
"Unreasonable requirements of IBM created threat of legality and financial stability of business of Wynn, and it requires trial in court", - representatives of Wynn, sure commented that IBM uses opaque methods in trade in licenses.
Let's remind that the IBM corporation in 2006 purchased MRO Software company and then integrated into the software Tivoli family development of the absorbed company, the Maximo system intended for managements of services and assets.
