2021: Fine of 75 thousand rubles for non-receipt of a prescription to a patient with cancer

In early October 2021, the municipal budgetary health institution (MBUZ) "District Hospital of the city of Krasnoye Sulina and Krasnosulinsky District" was fined by a court in the Rostov Region for 75 thousand rubles for not issuing a prescription to a patient with cancer.

According to the territorial body of Roszdravnadzor in the Rostov Region, which filed a lawsuit, relatives of the palliative patient turned to the department. They said that the medical institution to which he is attached did not prescribe free Fentanyl transdermal painkillers. Because of this, the patient was not timely pain relief, to alleviate his condition, relatives had to call an ambulance.

Relatives appealed to the supervisory authority, it, in turn, conducted an audit and submitted her materials to the court.

A fine was issued to the medical institution under Part 3 of Article 19.20 of the Administrative Code of the Russian Federation (carrying out activities not related to profit-making, with gross violation of the requirements and conditions provided for by a special permit (license), if a special permit (license) is mandatory (mandatory). Earlier, the chief doctor of MBUZ "District Hospital of the city of Krasnoye Sulina and Krasnosulinsky District" was fined 10 thousand rubles for violating the rules for storing medicines. In particular, in the room where the medicines were stored, the temperature regime was incorrectly set, and there were also no devices for recording air parameters and other parameters.[1]
