2021:2 years in prison for the death of a 16-year-old patient during surgery

In December 2021, the Chistopol City Court of the Republic of Tatarstan sentenced the former chief physician of the Novosheshminsky Central District Hospital Rafis Vafin and anesthesiologist-resuscitator Maxim Konanerov to two years in prison conditionally for the death of a 16-year-old patient during surgery. Doctors were found guilty under Part 2 of Art. 293 of the Criminal Code (negligence).

The tragedy occurred at the end of 2018 during the operation. The cause of death of Milena Mukhametzyanova was massive intra-abdominal bleeding. It was established that the girl was operated on by a surgeon who did not have sufficient experience in conducting such operations. At the same time, there was not enough erythrocyte-containing blood components in the CRB itself to give the patient a transfusion.

As the court found, the chief doctor of the Central District Hospital, Rafis Wafin, wanting to hide his negligence, instructed the head of the personnel department to prepare an order on paper using the appropriate form, which included false information about the appointment of a surgeon responsible for the surgical service and the assignment of responsibility for the management of inpatient patients of the surgical department.

In the debate, the prosecutor demanded that both defendants be sentenced to imprisonment in a penal colony. The defendants themselves said that they were guided by departmental orders, and did not admit their guilt.

We do not agree with such a lenient sentence and will appeal it to the Supreme Court of Tatarstan, "said the father of the deceased girl Ildar Mukhametzanov. - After all doctors didn't even admit the guilt!.

The court's report clarifies that both men did not have circumstances aggravating the punishment. But both have many mitigating circumstances - the state of health (both their own and relatives), the presence of young children, letters of appreciation and letters of thanks.[1]
