2022: A fine of 30 thousand rubles for circumcision of a 9-year-old girl

At the end of January 2022, in Ingushetia, gynecologist Izan Nalgiev was fined 30 thousand rubles under part 1 of article 115 of the Criminal Code (intentional infliction of slight bodily harm) for circumcision of a 9-year-old girl. The corresponding decision was made by the magistrate of the judicial section No. 15 of the republic.

According to Komsomolskaya Pravda, the girl's father took her daughter and son from his ex-wife for the weekend. During this time, the girl managed to perform genital mutilation. A criminal case was opened against the gynecologist under the article "Causing slight harm to health." During the investigation of the case, the gynecologist gave contradictory evidence, then reporting that the girl had clinical evidence for the operation, then claiming that the operation was a religious ritual.

According to investigators, the stepmother and the doctor forcefully laid the girl on the operating table, then the gynecologist made her a cut on the clitoris hood. After the operation, the father gave his daughter 500 rubles and sent them with his brother to his mother in Grozny on a minibus.

Upon learning of the incident, the mother took the girl to the doctor. The Grozny surgeon fixed the wound in the victim "with a transition to the upper part of the small sex lips."

According to Kommersant, lawyers for the Legal Initiative on the fact of the crippling operation demanded that the doctor Nalgieva be prosecuted for causing harm to health (Article 111, 115 of the Criminal Code of the Russian Federation), other sexual acts (Article 132 of the Criminal Code of the Russian Federation)as well as the provision of a service that does not meet safety requirements (Article 238 of the Criminal Code of the Russian Federation), in addition, not only doctors should be held accountable, but also the management of the clinic in which the accused worked.

Senior lawyer of the organization Tatyana Savvina considered a fine of 30 thousand rubles for a crippling procedure too lenient and unfair punishment. She added that the judge did not appoint a medical examination that could assess the severity of the psychological harm caused to the child.[1]
