2022: The developer of Medlock through the court demanded that the Ministry of Health connect it to the Uniform State Health Information System
In February 2022, the developer of the Medlock IT system through the court demanded that the Ministry of Health of the Russian Federation connect to the Uniform State Health Information System. We are talking about the Medrating company, which filed a lawsuit with the Moscow Arbitration Court, demanding that the department's refusal be declared illegal.
Medrating sent an application to the Ministry of Health to connect to the Unified State Health Information System in September 2021. A month later, it was considered by the Presidium of the Government Commission on Digital Development, the Use of Information Technologies to Improve the Quality of Life and Business Conditions for Subsequent Consideration and Final Decision. A majority voted for the connection of Medlock (16 votes in favor, 2 against), but nevertheless the connection did not take place. In December 2021, the company sent a pre-trial claim to the Ministry of Health about connecting to the Uniform State Health Information System, but in January 2022 it was refused, and then it went to court.
According to the plaintiff, the actions of the Ministry of Health negatively affect the commercial activities of medical organizations that planned and plan to use the technical resources of Medrating to connect to the Uniform State Health Information System. At the time of filing the claim, 884 clinics already had problems, the statement of claim said.
In accordance with paragraph 18 of Decree of the Government of the Russian Federation No. 447 of 12.04.2018, on the basis of a positive decision to connect the information system to the EGIS, the Ministry of Health connects "other information systems" to the EGIS within 5 working days from the date of the decision. But "the defendant, referring to the unknown requirements of the Apparatus of the Government of the Russian Federation (letter No. P10-94111 dated 28.12.2021) and the position of the FSB of Russia (letter No. 149/11-2124 dated 22.12.2021), asks to provide the Ministry of Health of the Russian Federation with information and documents confirming the full implementation of measures to ensure cryptographic protection of channels during the interaction of information systems," said in the statement of claim "Medrating."[1]
