2023:6 years in prison for awarding victory to suppliers in public procurement of medical equipment for 191 million rubles

In early February 2023, the Central District Court of Chelyabinsk found the former deputy head of the Ministry of Health of the Chelyabinsk Region, Alexander Kuznetsov, guilty of abuse of office in the purchase of medical equipment. The former official was sentenced to 6 years of suspended imprisonment, with a probationary period of 4 years. This was reported by the press service of the Investigative Department of the TFR in the Chelyabinsk region.

The investigation and the court found that in 2020 the convict agreed on the purchase of tomographs at an inflated cost at the expense of the budget. The crime caused damage to the budget in the amount of more than 80 million rubles. During the investigation of the criminal case, the convict pleaded guilty and entered into a pre-trial agreement. The investigation of a criminal case against the head of a commercial organization accused of committing crimes under Part 4 of Article 159 of the Criminal Code of the Russian Federation (fraud), Part 4 of Article 33, Part 3 of Article 285 of the Criminal Code of the Russian Federation (incitement to abuse of office) when embezzling budget funds is in the final stage.

According to the investigation, the investigation found out that the cost of Optima CT540 tomographs when buying them from the manufacturer JI Helskea LLC (Moscow) did not exceed 26 million rubles per unit, but contracts with companies controlled by Selishcheva were concluded at a price of 46.5-50 million rubles. The investigation established that Kuznetsov was misled by an entrepreneur.

It is specified that Kuznetsov ensured the victory in the tender to affiliated companies with which the authorities concluded four state contracts for the supply of computer tomographs to hospitals for a total cost of 191 million rubles.[1]

2022: Detention in the case of the purchase of CT scanners at inflated prices

On February 18, 2022, it became known about the detention of the Deputy Minister of Health of the Chelyabinsk Region, Alexander Kuznetsov. He became a defendant in a criminal case on the purchase of medical equipment at inflated prices.

According to them, the deputy head of the Ministry of Health was taken for interrogation to the department of the Investigative Committee of Russia (TFR) in the Chelyabinsk region. Investigators were primarily interested in information about violations in the procurement of medical equipment and the possible conclusion of contracts for the supply of computed tomographs at inflated prices.

According to a RIA Novosti source, Kuznetsov is suspected of abuse of office (Article 285 of the Criminal Code). The case was initiated in the summer of 2021.

The investigation considered that in April-May 2020, the regional Ministry of Health purchased three Optima ST540 multispiral computer tomographs manufactured by MTL at an inflated price of 27 million rubles. The value of the contracts amounted to 46.5, 47 and 47.5 million rubles.

In September 2021, investigative officers searched the Ministry of Health of the Chelyabinsk region. According to the publication Znak.com, similar events were held among equipment suppliers. The companies Region-Service LLC, Medservice-Region CJSC and Ural Med Reserve LLC came to the attention of law enforcement agencies. During the investigative actions, accounting documents were seized.

As the newspaper notes, the authorities of the Chelyabinsk region have previously stated several times that there is no overestimation of the cost of purchases. Firstly, according to officials, close attention is riveted on all purchases during the COVID-19 coronavirus pandemic, and secondly, in the spring of 2020, when the pandemic began and medical institutions throughout the country began to urgently purchase medical equipment, prices for it seriously jumped from manufacturers.[2]
