2022: Ban on purchasing the information security system of a pre-selected manufacturer

The Federal Compulsory Health Insurance Fund (MHIF) was caught limiting competition. This became known on September 13, 2022. The Federal Antimonopoly Service (FAS) did not allow the MHIF to purchase software from a well-known vendor.

The MHIF published a tender for the purchase of information protection tools for the development of the state information system compulsory medical insurance (GIS compulsory medical insurance) on August 8, 2022 in the format of an electronic auction. The maximum contract price for it can be 219.7 million rubles.

Only one application was submitted for the auction from the DialogueNauka company, with which the MHIF was supposed to sign a contract. However, the auction was suspended on the complaint on August 23. It was submitted by the Abak2000 group of companies.

According to the decision of the FAS, the MHIF in the description of the procurement object established requirements for product characteristics indicating exclusively the software of the only manufacturer of Aichi Bastion LLC - SKDPU NT. Thus, the MHIF limited the number of procurement participants, the grievor points out.

The FAS Commission found that among the commercial proposals for procurement, only SKDPU NT was presented. In addition, the customer was unable to provide documents or information indicating the presence of other products on the Russian market that meet the requirements established in the notice.

In this regard, the FAS recognized the complaint as justified in terms of restricting competition to the MHIF. The service ordered to cancel the protocol for summing up the results of the determination of the supplier and give a notice of the auction in accordance with the requirements of the law^[1].
