2022: Recovery of 287 million rubles in the case of shortage of 7.8 billion rubles in the AMB Bank

On November 30, 2022, the Arbitration Court of the Moscow District upheld the judicial acts of lower instances on the recovery of 287 million rubles from the ex-heads of AMB Bank and its owner Anatoly Motylev.

According to the press service of the Deposit Insurance Agency (DIA), the court brought to subsidiary responsibility the chairman of the bank's board Andrei Loginov, as well as deputy chairman of the board Irina Bulgakova, Alexander Kuzmin and Ilya Galkin. The basis for bringing the defendants in the case to justice was a deal to provide a deliberately bad loan to an offshore foreign company.

Motylev was the owner of Russian Credit, M Bank, AMB Bank, Tula Industrialist and seven non-state pension funds (NPFs). The Central Bank of the Russian Federation revoked licenses from all these organizations. The regulator's audit of the assets of four banks of the Motylev group showed that the traditional banking business was practically absent there.

According to the results of the inventory of AMB Bank's property in June 2016, a shortage of 7 billion 846.782 million rubles was revealed. The largest amount of shortfall (7 billion 694.05 million rubles) fell on undocumented funds placed in correspondent accounts with non-resident banks.

The Investigative Committee opened two criminal cases against Anatoly Motylev on the fact of particularly large fraud on the basis of identified embezzlement of funds from Russian Credit Bank and M Bank. In October 2022, at the suit of the DIA, Anatoly Motylev declared bankrupt in Switzerland, the Deposit Insurance Agency said. Thus, creditors got the opportunity to get to its assets in Switzerland.

As the publication "Банки.ру" reminds on December 1, 2022, according to the verdict of the Russian courts, 11 bankers and businessmen acting at the direction of Motylev are serving sentences from 5.5 to 11 years.[1]
