2023: Imprisonment for 11 years and a fine of 1.6 million rubles. for fraud on an especially large scale

In early February 2023, a debate was held in the Simonovsky Court of Moscow on the case of bankers from three credit institutions. The defendants are accused of embezzling approximately 1.5 billion rubles by issuing bad loans secured by barrels of "expensive chemical raw materials," which in fact turned out to be ordinary water.

According to the Kommersant newspaper, a criminal case on fraud on an especially large scale (part 4 of article 159 of the Criminal Code of the Russian Federation) was initiated against the heads of KB Investment Union LLC Maurice Rasulov, TUSARbank JSC Vladimir Kagan, KB Pulse Capital LLC Dmitry Ilyin and Irina Dokuchalova. Their alleged accomplices, Georgy Tsiklauria, Igor Yakubovich and Pyotr Chistov, also appear in the materials.

The investigation was initiated at the request of the Deposit Insurance Agency to the GUEBiPK Ministry of Internal Affairs: in the spring of 2017, this organization made a request to conduct an audit for violations of the law in the financial and economic activities of these structures. The fact is that in 2015-2016. "Investment Union," "TUSARbank" and "Pulse of the capital" were deprived of licenses by the Central Bank due to a highly risky credit policy, dubious operations to withdraw money abroad in large volumes, as well as the complete loss of their own funds. According to the results of the audit, the investigative department of the Ministry of Internal Affairs opened a criminal case: it was established that in 2014 and 2015. the defendants in the case actively distributed deliberately bad loans to one-day firms controlled by their accomplices.

The defendants themselves, as noted, do not admit guilt: they and their defense declare that the investigation and the state prosecution did not provide evidence of illegal activities.[1]

2025: Recovery of 672 million rubles by the court

On June 18, 2025, the Simonovsky District Court of Moscow recovered more than 670 million rubles from the former chairman of the board of Tusarbank Vladimir Kagan and his accomplices, who were accused of embezzling funds from a credit institution. They were previously sentenced to between 7 and 10 years in prison.

The criminal case was initiated at the request of the state corporation "Deposit Insurance Agency" (DIA). According to the Kommersant newspaper, during the investigation it was established that the bank issued deliberately bad loans to one-day firms controlled by the accomplices of the defendants. The funds were allocated on the security of "hundreds of barrels with expensive chemical raw materials, which turned out to be ordinary water." The money withdrawn from the bank was then cashed out and appropriated by the attackers.

The court recovered 672 million rubles from the ex-board of Tusarbank and his accomplices in the theft

The case was initiated under Part 4 of Art. 159 of the Criminal Code of the Russian Federation - fraud committed by an organized group or on an especially large scale. The defense and the defendants asked the court to acquit them due to the lack of corpus delicti in their actions. According to lawyers and accused, the investigation and the state prosecution did not provide evidence of the unlawful activities of the defendants. Nevertheless, the court found the defendants guilty of embezzlement of bank funds. And on June 18, 2025, it was decided to recover from them about 672 million rubles in compensation for damage caused to the credit institution.

The Bank of Russia revoked Tusarbank's banking license in September 2015. The regulator said that the organization pursued a high-risk credit policy and did not create adequate provisions for possible loan losses for the accepted risks. Due to the unsatisfactory quality of assets that did not generate sufficient cash flow, the bank did not fulfill its obligations to depositors.[2]
