2023: Suspended sentence in the case of the death of six patients on mechanical ventilation

On March 1, 2023, the Bryansk District Court sentenced Nikolai Romashchenko, head physician of the Bryansk Interdistrict Hospital, to a suspended sentence, finding him guilty of negligence. The decision is associated with the death at the end of 2020 of six patients who were in a medical facility on artificial lung ventilation (IVL).

As reported on the court's website, it was established that Nikolai Romashchenko, being the head physician of the Bryansk Interdistrict Hospital GBUZ, in violation of the rules established by law, hired an employee who did not undergo compulsory technical training, all types of safety briefings, who did not pass the exam and did not have a certificate for the right to operate oxygen cylinders.

As a result of Romashchenko's negligent actions, this employee on November 27, 2020, without special knowledge and admission to work with oxygen equipment, made a sharp increase in pressure in the oxygen supply system, which ensures the uninterrupted operation of ventilators, which led to the exit from the operational state of these devices and the emergency termination of artificial ventilation of the lungs, resulting in the death of six people.

Nikolai Romashchenko was sentenced to 3 years of suspended imprisonment, with a probationary period of 2 years, with deprivation of the right to hold positions related to the performance of the functions of a representative of the authorities, organizational, administrative and economic functions in the public service and in local governments, in state and municipal institutions, for a period of 2 years. Romashchenko was convicted under Part 3 of Article 293 of the Criminal Code of the Russian Federation (negligence, failure to fulfill or improper performance by an official of his duties, resulting in the death of two or more persons by negligence).

According to the information on the website of the Bryansk Interdistrict Hospital, Romashchenko continues to hold the position of head physician by early March 2023.^[1]
