2024: Fine for participation in the cartel in the supply of medical equipment

On June 24, 2024, it became known that the Chelyabinsk Department of the Federal Antimonopoly Service (OFAS) imposed a fine of 22 million rubles on Medical Technologies LLC, one of the participants in the cartel conspiracy at the auction for the supply of medical equipment. The company is recognized as involved in illegal agreements aimed at limiting competition in the field of public procurement.

In early May 2024, the OFAS has already fined 11 companies for a total of 36 million rubles for participating in the cartel. Later, similar fines were imposed on three more participants, which added 9 million rubles to the total. Currently, the antimonopoly department is considering the case of bringing to administrative responsibility another participant in the conspiracy.

In March 2023, the Chelyabinsk OFAS suspected 19 companies from various regions of Russia, including Chelyabinsk, Magnitogorsk, Kurgan, Orenburg, Yekaterinburg, Moscow, St. Petersburg, Bashkortostan and Udmurtia, in a conspiracy totaling almost 740 million rubles. The two companies were subsequently removed from the cartel's membership list.

According to the antimonopoly department, companies that participated in the conspiracy in 2020-2021 filed applications for the supply of medical equipment and medical devices, such as endoscopes, X-ray systems and artificial lung ventilation devices. They used a single infrastructure and identical application processing, which included a long financial relationship under loan agreements and the supply of goods. Also, cartel participants received certificates of electronic digital signature (EDS) by the same persons and used the same phone numbers and email addresses in applications for the issuance of EDS.

Companies also interacted when submitting commercial offers, influencing the formation of the initial price of contracts and reducing it by 2-4%. In most purchases (46 out of 49), the customer was the Ministry of Health of the Chelyabinsk Region.[1]
