2024: Recognizance not to leave

Former Minister of Digital Development of Kyrgyzstan Azamat Dyikanbayev was released on recognizance not to leave. The decision was made by the Pervomaisky District Court of Bishkek on August 7, 2024. This was announced by lawyer Kaysyn Abakirov.

According to TASS, lawyer Abakirov expressed confidence that the criminal case against Dyikanbaev will be dismissed for lack of corpus delicti. The former minister is charged with illegally using access to the automated information system of the State Customs Service for unauthorized export of goods. Dyikanbaev was charged with using a login and password to carry out illegal actions.

Azamat Dykanbaev was detained in May 2021 on charges of extorting 2.6 million soms for extending the agreement on the Safe City project. At that time, he served as Minister of Digital Development of Kazakhstan. On the same day, May 20, President Sadyr Japarov dismissed him from his post.

According to the lawyer, during the investigation, numerous violations of the criminal procedure law were committed. The lawyer accused the investigator of the Ministry of Internal Affairs, Police Major Shadmanov, of inaction and mistakes in the investigation of the case. Since Dyikanbayev's arrest on May 17, 2024, not a single investigative action has been carried out with his participation, which the lawyer equates with torture.

The lawyer also noted that the criminal case against Dyikanbayev was initiated illegally, and the alleged material damage to the state was not established. This raises doubts about the competence of the investigator. Abakirov stressed that his client did not have access to the automated system and could not influence its work.

The situation with the accusations against Dyikanbayev is not new. In 2021, as Minister for Digital Development, he was already facing accusations when lawyers proved his innocence. Then Dyikanbaev spent three months in a pre-trial detention center, despite the illegal initiation of a criminal case.

In February 2022, the case against Dyikanbayev was dismissed, but a new round of the investigation began in 2024. The lawyer called on the President of Kazakhstan Sadyr Japarov and the Minister of Internal Affairs Ulan Niyazbekov to ensure an objective consideration of the case and speed up the process.[1]
