2025: Ministry of Education to create GIS of difficult children

Mikhail Mishustin, head of the Government of the Russian Federation, signed in early April Decree No. 411 "On the State Information System for the Prevention of Neglect and Juvenile Delinquency[1]which approves the provision on the system "Prevention of Neglect and Juvenile Delinquency."

In accordance with the decree, an information system is created for:

  • information support for the prevention of neglect and delinquency of minors and the protection of their rights;
  • automation of relevant activities;
  • Ensuring control over activities to prevent neglect and protect the rights of minors.

The operator of this information system has appointed the Ministry of Education, which must put the corresponding system into operation by December 1, 2025 and fill it with information from suppliers. The rules list the following categories of information providers for the system:

  • commission on juvenile affairs and protection of their rights;
  • management bodies of social protection of the population;
  • social service institutions;
  • specialized institutions for minors in need of social rehabilitation;
  • bodies responsible for management in the field of education;
  • organizations engaged in educational activities;
  • special educational institutions of open and closed type;
  • organizations for orphans and children left without parental care;
  • guardianship and guardianship authorities;
  • youth authorities;
  • institutions of youth bodies;
  • cultural, leisure, sports and tourism bodies;
  • institutions of culture, leisure, sports and tourism;
  • health authorities;
  • medical organizations;
  • employment service bodies;
  • internal affairs bodies;
  • temporary detention centers for juvenile offenders of the internal affairs bodies;
  • pre-trial detention facilities;
  • educational colonies;
  • penitentiary inspections;
  • Commissioner under the President of the Russian Federation for the rights of the child, commissioners for the rights of the child in the constituent entities of the Russian Federation.

Data will be collected both for minors and for parents and families in general. In particular, children will collect such data as facts of drug and alcohol use, employment, unauthorized family leaving, facts of tough relations, administrative offenses, criminal offenses, antisocial actions and others. According to the specified information, statistics will be automatically generated.

GIS prevention of neglect and juvenile delinquency should be launched by December

The procedure for the exchange of information between the Ministry of Education as a federal operator of the created system and information providers should be determined on the basis of an agreement on information interaction concluded between the federal operator and the authorized executive body of the constituent entity of the Russian Federation. Further, the constituent entity of the Russian Federation itself has the right to determine a single information provider authorized to centrally submit to the information prevention system the information available to the executive bodies of the constituent entities of the Russian Federation, as well as conclude an agreement on information interaction with the federal operator.

In fact, this means that the constituent entities of the Russian Federation must now adopt similar resolutions and form appropriate structures that will be obliged to build similar information collection systems from the above sources by December 1 of this year and fill the unified federal register with information.

2024: Creation of GIS for the prevention of neglect and juvenile delinquency

In early August 2024, the Federation Council of the Russian Federation approved a law on the creation of an institute of mentoring in the prevention of neglect and juvenile delinquency. The project provides for the formation of the State Information System (GIS) in the relevant area.

GIS for the prevention of juvenile delinquency is being created in Russia

The database will include data on minors in difficult life situations, socially dangerous situations in need of individual preventive work, as well as on their parents or other legal representatives. The list of information included in the GIS will include:

· Gender, date and place of birth, citizenship information, passport data (other identity document), birth certificate data, address of place of residence (place of stay, actual residence) and insurance number of individual personal account;

· Information on measures taken to protect and restore the rights and legitimate interests of minors, to protect them from all forms of discrimination, physical or mental violence, insult, abuse, sexual and other exploitation;

· Information on the causes and conditions of neglect and juvenile delinquency prevention system identified by bodies and institutions and measures to eliminate them;

· Information on the provision of assistance in the household structure of minors released from institutions of the penal system or returned from special educational institutions;

· Information on the decision to send minors aged 8 to 18 who need a special pedagogical approach to special educational institutions of an open type.

The law provides for the introduction of the institution of mentoring in this area and the formation of a register of mentors. Individuals and organizations included in the register will be able to carry out individual preventive work with children. The mentor will be appointed by the commission on juvenile affairs and the protection of their rights with the consent of the minor himself and his parents or other legal representatives. The register of mentors cannot include citizens who are not allowed to work in the field of education, upbringing, development of minors, organization of their recreation and recreation, medical care, social protection and social services, in the field of youth sports, culture and art with the participation of minors. In addition, persons recognized as foreign agents cannot be included in the register.[2]
