The creation of a system based on 1C in Rosmorport led to a lawsuit. Contractor failed to complete everything on time
As TAdviser found out, in January 2025, Center Forward, which had previously carried out work for FSUE Rosmorport to create and implement corporate InformSystems based on 1C, filed a complaint with the Supreme Court of the Russian Federation after losing courts in the first, appellate and cassation instances. The contract for these works was concluded back in 2021.
From the materials published in the card of this case in the Electronic Justice system[1]it follows that the court in 2024 ordered the company to pay a penalty to Rosmorport, which the latter demanded in connection with the improper execution of the contract for this project. Moreover, initially Rosmorport demanded to recover about 11.7 million rubles from Center Forward, but the court of first instance partially satisfied his claim and decided to recover about 4.1 million rubles from the contractor.
The volume of the controversial agreement for the creation and implementation of the Rosmorport corporate InformSystems "Accounting, Tax Accounting and Reporting," including the Treasury module, statistical reporting, as well as reporting according to international standards "based on the 1C platform, amounted to about 94.8 million rubles. Within the framework of it, work was carried out and accepted in several stages for a total amount of 21.2 million rubles, including licenses for were transferred to the customer ON.
InAt the same time, according to Rosmorport, the contractor repeatedly violated the deadlines for the work under the contract, and the work on a number of stages of the schedule was not completed. As a result, in 2022, the customer notified Center Forward of a unilateral refusal to fulfill the contract, and later went to court.
In turn, Center Forward filed a counterclaim against Rosmorport for recovery from the last debt in the amount of about 21.9 million rubles and losses in the amount of about 5 million rubles, as well as penalties for violation of the terms of payment for the work performed.
In court, "Center Forward" claimed that the violation of the terms of work under the contract committed by him was due to the delay of the enterprise in fulfilling its duties, including assisting the contractor. However, all the courts through which the company has already passed have so far issued judicial acts not in its favor following the consideration of this case.
Rosmorport will switch from ERP Microsoft to 1C. The project is estimated at up to 1 billion rubles
As TAdviser discovered, in February 2025, FSUE Rosmorport plans to summarize the request for proposals for the design, creation and implementation of a corporate information system based on 1C: Holding Management software. We are talking about the block of accounting, tax accounting and reporting, including the Treasury module. The initial contract price is about 1 billion rubles, follows from the documentation published in the UIS "[2]. This is not the first call to create this system, the first ended with the termination of the contract with the supplier (see the article block above for this).
The terms of reference indicate that the purpose of the project is to transfer the current accounting system of the enterprise based on MS Dynamics AX 4.0 to a modern domestic technological platform. The project will cover the central office and branches of the enterprise. They have been using an MS Dynamics AX-based system since 2010.
The company is the owner of the largest diesel icebreaker flotilla in the world. One of its key tasks is to ensure the safety of navigation in the waters of seaports and on approaches to them by forming an innovative port infrastructure. Rosmorport has 11 branches, provides services in 58 Russian seaports out of 62. As of 2024, Rosmorport was in charge of 270 vessels, including 34 units of the icebreaker fleet, which carry out icebreaking operations of ships year-round.
The new corporate information system, created to replace MS Dynamics AX, should function on the operating system and DBMS included in the register of domestic software and recommended by the manufacturer - 1C: for example, Astra Linux Special Edition OS and Postgres Professional DBMS.
It follows from the terms of reference that Rosmorport has already acquired the software "1C" software necessary for the project, such as "1C: Holding Management" and "1C: Enterprise." And the specification for additional software and licenses necessary for the implementation of the project, including server operating systems and DBMS, the procurement participant must submit as part of a quotation.
Among the technical requirements are integration with the already existing internal IT systems of Rosmorport, such as 1C: Payroll and HR Management, IBM Cognos, port fee calculation systems.
The work schedule includes several stages, including the creation and implementation of a corporate information system in the pilot zone, as well as the preparation of the system for commissioning. It is supposed to be implemented in the central office of Rosmorport, as well as in one branch of the enterprise, agreed by the parties at the stage of system design.
In the course of automation of the central office and branches of Rosmorport, it is necessary to organize a single scalable database so that the system is flexibly configurable if the enterprise has a new branch or a separate division in the structure of the branch that is not allocated to a separate balance sheet.
The terms of work performance shall not exceed 36 calendar months from the date of the contract conclusion.
At the beginning of 2024, Rosmorport already conducted a request for proposals with a similar procurement object[3]. Then the initial price of the contract was about 480 million rubles, but the company, apparently, did not conclude the contract according to the results of the request.
It is noteworthy that this project was worked out back in 2020. Then Rosmorport requested quotations in electronic form on the choice of the organization for the right to conclude an agreement on the creation and implementation of the corporate information system "Accounting, Tax Accounting and Reporting," including the Treasury module, statistical reporting, as well as reporting according to international standards "based on the platform" 1C: "Holding Management "/1C:" ERP "/1C: "Holding Management.[4] with an initial price of about 138 million rubles. According to the results of the request, the winner was chosen - "Center Forward," which offered a price of 94.8 million rubles. The purchase card contains information that an agreement was concluded at the beginning of 2021, but it is indicated that its execution was terminated. However, then in the terms of reference, work on replacing the imported system with a domestic one was not mentioned.
Rosmorport could not answer TAdviser's questions, including about changing the purchase price, citing commercial secrets.
