2025: The court ordered the Ministry of Digital Development of the Russian Federation to pay 55 million rubles of debt for the construction of the Operational Management Center in Sochi

At the end of January 2025, it became known that the Moscow Arbitration Court ordered the Ministry of Digital Development of the Russian Federation to pay the debt of its subsidiary FGBU "Industry Center for Monitoring and Development in the Field of Information and Communication Technologies" (Mir IT Center) to the Sochi Construction Company (SSK). In accordance with the decree, the department is obliged to reimburse 55.3 million rubles.

According to CNews, the proceedings are related to a state contract worth 774.5 million rubles for the construction of the Center for Operational Management for Security and Law Enforcement (COU) in Sochi. The corresponding agreement was concluded between SSK and the FGBU Center MIR IT in 2010, and it was planned to complete the work within two years.

In 2012, SSK went to court, saying that it had completed most of the work, but did not receive full payment. The MIR IT Center, in turn, accused the contractor of violating the deadlines and non-performance of a number of works, demanding the return of the undeveloped advance payment and paying the penalty. The court decided to collect the debt from the customer, but part of the money was never paid. After several subsequent appeals to the courts of various instances, SSK filed an application for debt collection in the manner of subsidiary liability from the Ministry of Ministry of Digital Development.

It is noted that the court of first instance granted the request of SSK, obliging the department to pay 55.3 million rubles. Ministry of Digital Development challenged this decision, citing the absence of an obvious refusal by the FGBU "Center MIR IT" to pay off the debt. However, the court rejected these arguments, pointing out that the basis for collecting the debt is not a refusal to pay off the debt, but a lack of funds from the institution to pay the necessary amount. In general, the court confirmed that SSK fulfilled its obligations under the contract, despite delays in the implementation of the project.[1]
