2021: Opticom sued the Ministry of Digital Science of the Novosibirsk Region for almost 200 million rubles

On September 16, 2021, it became known that the design and construction company Optikom sued the Ministry of Digital Development and Communications of the Novosibirsk Region for almost 200 million rubles.

The court materials do not specify the details of the statement of claim. As Kommersant writes with reference to court documents, the defendant previously asked to postpone consideration until the decision in another case comes into force - to invalidate the decision of the Ministry of Digital Science in a unilateral refusal to fulfill the contract for the development of information and telecommunication infrastructure in educational organizations of the region.

"Optician" sued the Ministry of Digital Science of the Novosibirsk Region almost 200 million rubles

In 2020, the department announced a tender for the provision of services for the development of information and telecommunication infrastructure (data transmission, video surveillance, access control, etc.) in 233 educational organizations in the region within the framework of the Digital Economy national project. The initial contract price amounted to more than 398.7 million rubles. Five bids were submitted for participation in the auction. The winner was PSK Optik LLC. The company reduced the cost of work to 394.7 million rubles. The second place in the bidding was taken by Optik LLC.

In March 2021, the OFAS in the Novosibirsk Region announced the identification of a cartel conspiracy with the participation of the ministry and the Optik and PSK Optik companies when concluding a state contract. According to the department, the organizers and participants of the competition violated the law on protection of competition by organizing a cartel conspiracy. The customer and the contractor repeatedly agreed on the draft terms of reference before the start of the auction, and the contract price was formed from the amount indicated by the contractor. In April 2021, the regional department of the FAS revealed another cartel conspiracy with the participation of Optik LLC, PSK Optik LLC. The companies challenged in court the conclusions of the antimonopoly department.[1]
