As the publication Autonews.ru explains, referring to this document, now to make an administrative decision, it is not enough to inform ordinary patrol cars about a violation from a hidden traffic police patrol, as it was before. The driver's guilt will need to be proved using a video recording with traffic violations.

Also, according to the new regulations, traffic police officers during hidden patrols on the roads will have to record any violations that contribute to the commission of an accident. During the observation process, inspectors will transmit information about violators to other patrols in cars with a color scheme. The latter, if necessary, will stop drivers.

At the same time, the car should be a patrol, that is, belonging to the Ministry of Internal Affairs, and not some private one. Employees can be in civilian form. But they must interact with other outfits on machines with color schemes, which, if necessary, will stop violators.

Hidden patrols can detect any traffic violations. However, they pay special attention to driving into the oncoming lane and dangerous driving. Sanctions for the latter, however, did not appear in the Administrative Code. In July 2023, a State Duma bill was introduced with a proposal to punish for this in the amount of up to 10 thousand rubles or deprivation of rights for up to a year.

In addition, the procedure, which entered into force in July 2023, instructs employees, if possible, to carry out administrative actions in the field of view of video surveillance systems, as well as notify road users of their use in the implementation of these actions of photo, video or recording equipment.[1]

The amount of road fines increased by 16.7% to 136.8 billion rubles

The amount of road fines in Russia in 2022 increased by 6.7% compared to 2021 and reached 136.8 billion rubles. 90% of fines were issued thanks to photo and video cameras

Traffic police inspectors on the ground in 2022 issued a total of 16 million decisions, which is 7% more than a year ago. There were 530 thousand warnings, but for drunk drivers the statistics are the same as in 2021: 288.4 thousand such violators were caught. 166.4 thousand people refused to be examined (-2.7%). In a state of drug intoxication, 18.7 thousand Russians noticed while driving, which is 400 more than a year earlier.

Moscow became the leader in the number of violations committed, and the increase in the number of fines in the capital turned out to be higher than the national average. In 2022, 39.3 million decisions were issued here for 30.3 billion rubles - 23 and 27.8% more, respectively. Among the leaders in the number of fines are also named Moscow Region, St. Petersburg and Krasnodar Territory. Of these indicators, according to data from cameras in Moscow, almost 38 million fines for 28.4 billion rubles were issued, in the Moscow region - 30.2 million for 17.2 billion rubles.

The number of debtors for traffic police fines has also increased, follows from the data of the Federal Bailiff Service. According to materials received from the State Traffic Inspectorate, bailiffs opened 26.3 million enforcement proceedings per year (+ 12.8% by 2021). Executed in full (or partially) 24.5 million traffic police decisions, the total amount recovered amounted to 17.1 billion rubles[2]

The first seizure of a car in favor of the state for drunk driving in Russia

The court sentenced the offender to 360 hours of compulsory work with deprivation of the right to engage in vehicle management activities for a period of 2.5 years. In addition, for the first time in the Krasnoyarsk Territory, a new norm of legislation was implemented - a car by a court decision was confiscated as state revenue, the Ministry of Internal Affairs said.

On July 25, 2022, amendments came into force that allow the seizure of vehicles of violators of the Traffic Rules in favor of the state. The sanction will be applied as a punishment for repeated red light passes, oncoming lane exits and driving with forged numbers. Criminal prosecution and confiscation of the car await violators who previously neglected the rules and were deprived of their rights for this.

The amendments were criticized by a number of deputies and experts. Deputy Alexei Kurinny (Communist Party of the Russian Federation) said that in nine out of ten cases, citizens deprived of a license for drunk driving or other violations get behind the wheel of someone else's car. The lawyer of the Freedom of Choice movement, Sergei Radko, insisted that it is impossible to apply confiscation of a car for entering the oncoming lane, because inspectors often see a violation even in a small touch of a solid lane with one wheel.[3]

After that, these data will be checked and on the basis of this, a decision was made on a fine for the owner of the vehicle.[4]
