2023: Return of Softline money for depreciated certificates for software technical support in the Central Bank of the Russian Federation

At the end of June 2023, it became known that Softline, through the court, had ensured that the Russian software distributor Netkom returned the money to him for inactive certificates for software technical support at the Central Bank of the Russian Federation. Due to the fact that the Indian developer of this software HCL Technologies has left the Russian market.

According to the publication CNews, after the start of a special military operation of Russia in Ukraine at the end of February 2022. Indian HCL Technologies announced that from March 3, 2022 it will stop providing services to Russian customers. In this context, prepaid maintenance certificates in the Russian Federation have depreciated.

Softline made Netcom return money to the company

The buyer of certificates from HCL Technologies at the end of 2021 was Softline Trade (part of the Softline group). On February 28, 2023, Softline Trade filed a lawsuit with the distributor Netcom to recover unjust enrichment and impose fines.

The Moscow Arbitration Court sided with Softline and ordered Netkom to pay the plaintiff an amount pro rata to the period of previously paid, but not received technical support in the amount of $187.58 thousand and a similar amount as a penalty. According to court documents presented during the proceedings between the companies, the end user of the certificates from HCL Technologies was the Central Bank of Russia, which acted in the process as a third party.

During the proceedings, the defendant, represented by Netcom, tried to involve HCL Technologies and the distributor Windy Haven as third parties. The Moscow Arbitration Court rejected this petition due to the fact that it considered it as an insufficiently justified claim. The Moscow Arbitration Court, when making its decision, was guided by the fact that in the case in question, where the plaintiff, Softline Trade did not receive the services in full, provided for by the concluded agreement with Netk[1]
