RosSHD Consortium: "Russia is trying to cancel import substitution in radio electronics"

According to the current rules, from January 1, 2021, only DSS can get into the register of domestic industrial products of the Ministry of Industry and Trade, where the cost of foreign components is no more than 35% of the price of goods and the Russian central processor is necessarily used. That is, both requirements must be met at the same time (government decree No. 1746 for DSS and government decree No. 2458 for computing). Already adopted resolutions imply that later the requirement for a Russian processor should apply to all types of computer equipment.

And in the published project, the share of the cost of foreign components in the price of products is replaced by a point system: points are awarded for fulfilling various localization parameters, and when a certain amount of points is scored, the products are included in the register of "domestic equipment." In addition, the mandatory use of the Russian processor is canceled - now you can get additional points for it, but you can score the amount of points required to get into the register without it, according to RosStorage.

RosSHD believes that the introduction of a point-based system for assessing the localization of products will allow the inclusion of imported equipment in the register of domestic industrial products of the Ministry of Industry and Trade

Previously, the point system was introduced for a number of industrial equipment, including "shipbuilding products," "trailers and other special equipment," "automotive industry," "medical products" (the latter - at the project stage as of July). But, according to RosStorage, in this case the point system was introduced in addition to the previously existing procedure for calculating the ad valorem share - i.e. the ratio of the share of foreign components in the price of the product.

The depth of localization of the listed equipment is determined through both the ad valorem share and points for technological operations, according to an open letter from RosStorage. And the project of introducing a point system in relation to radio electronics products, contrary to the established procedure, replaces the calculation of the ad valorem share with a point system.

If a draft government decree is adopted in the form in which it is published now, there will be a lot of imported equipment in the register of the Ministry of Industry and Trade. To overcome the localization threshold in radio electronics, according to the proposed criteria, it is enough to take a foreign product and slightly refine it, "says Oleg Emeramrudov, executive director of RosSHD. - It becomes possible to include in the register products that now cannot get into it due to insufficient localization or do not have a central Russian processor. At the same time, domestic processors today can be used in all equipment types listed in the draft decree by 100%.

The RosSHD consortium has prepared an alternative draft government decree on the introduction of a point-based system for assessing the localization of computer equipment. It spells out the need to comply with the current criteria - the ratio of the share of foreign components in the price of the product, the mandatory presence of a central Russian processor, and adds an assessment of localization within the framework of the point system. The corresponding document has already been sent to the Ministry of Industry and Trade, follows from an open letter.

I must say that not only manufacturers of computer equipment of Russian brands are really eyeing the register of domestic products. So, for example, plans to localize Russia servers into production and the desire to include them in the register of domestic products were stated in. At the same Huawei time, the company said that. The story of the inclusion of DSS on IBM processors in the register of domestic products is becoming more and more confusing

Recall that earlier ANO "RosSHD" distributed an open letter stating "gross violation of the decree of the government of the Russian Federation in the field of import substitution" due to the fact that that in April 2021 in the register of industrial products produced in the territory of the Russian Federation, Yadro DSS on IBM processors were included, while from January 2021, new 719-PP requirements prescribe the inclusion of only DSS on Russian processors. The response of the Chamber of Commerce and Industry to Emerald's appeal also states that the Ministry of Industry and Trade notified the Ministry of Industry of the Yadro Chamber of Commerce about the cancellation of the certificates of expertise of DSS. It follows from this letter that the acts issued by the Moscow Chamber of Commerce and Industry indicated incorrect terms of their validity, which the Chamber of Commerce and Industry calls "technical errors." In this regard, the acts were canceled.

It turned out that Yadro first received acts dated December 21, 2020 for a period until December 20, 2021 - for a year. Thus, the deadline for the entry into force of new 719-PP requirements in January 2021 was seized, according to which only DSS on a Russian processor can be included in the register of industrial products of the Ministry of Industry and Trade produced in the Russian Federation. These acts were annulled.

And then the Moscow Chamber of Commerce and Industry issued new acts from the same date with the same numbers, but with a validity period until December 31, 2020 - that is, for only 10 days. Thus, at the time of the entry into force of the new requirements 719-PP that only DSS on domestic processors should be included in the register of the Ministry of Industry and Trade, Yadro no longer had valid acts of expertise from the Chamber of Commerce and Industry.

In December 2020, when KNS Group LLC issued expert examination reports on the compliance of manufactured industrial products with the requirements for its classification as products manufactured in the Russian Federation, a technical error was made in the CCI documents, and the first version of the documents indicated an incorrect date of their validity. The error was corrected, the acts were updated, the regulations were not violated, since all document submissions were carried out strictly on time and according to the established rules, says a source familiar with the situation to TAdviser.

The Ministry of Industry and Trade, CCI and Yadro at the time of publication could not provide TAdviser comments on the situation with the acts. The Ministry of Industry and Trade and Yadro previously rejected complaints about illegal entry into the register of domestic products and said that everything was done in accordance with the regulatory framework.

A direct answer from the Ministry of Industry and Trade to the question of what moment the department is starting from when deciding to include DSS in the register according to the new rules - from the date of filing an application by the DSS manufacturer or from some other moment - has not yet been received.

At the end of June 2021, Yadro (part of the ICS Holding IT group) responded to an open letter from Oleg Emeramrudov, executive director of the ANO Consortium of Russian DSS Developers (ANO RosSHD), which stated "gross violation of the Russian government decree in the field of import substitution." Yadro's position on this letter is set out in a message to TAdviser and additional comments from the company.

Recall that Oleg Emeralrudov in his letter pointed out that in April 2021 the Ministry of Industry and Trade issued conclusions confirming production in the Russian Federation and included Yadro DSS using IBM processors in the register of domestic industrial products, while since January 2021, in accordance with the new requirements of the government decree (719-PP), only DSS using Russian processors can be considered domestic (for more information on the content of the Emerald letter, see the block below).

From the register of the Ministry of Industry and Trade of Industrial Products produced on the territory of the Russian Federation, it follows that the conclusions on the Yadro DSS, which Oleg Emerald speaks of, were indeed issued by the Ministry of Industry and Trade in April 2021, that is, after the entry into force of the new 719-PP requirements.

The company explained that two of the three products discussed in the letter were previously in the registers of the Ministry of Industry and Trade: in the Unified Register of Russian Radio-Electronic Products and the Register of Industrial Products Produced in the Russian Federation. According to the representative of the company, at the end of 2020, in accordance with the requirements of the legislation, Yadro DSS systems passed an examination of the Chamber of Commerce and Industry (CCI) for compliance with the requirements of the 719-PP, which was received in 2020 relevant acts of expert examination of the Chamber of Commerce and Industry. On their basis, the Ministry of Industry and Trade issued conclusions on the compliance of Yadro products with the 719-PP criteria, the products are included in the Unified Register of Russian Electronic Products. At the same time, previously received conclusions with a period until August 2021 are valid for the same products.

As for March 2, 2021 - the date of submission of the application, which Oleg Emeraludov refers to in an open letter - Yadro believes that this is the date of receipt of a paper copy of the application by the Ministry of Industry and Trade, from which the department counts.

The application to the Ministry of Industry and Trade was submitted by KNS Group LLC in 2020 and the timing of the issuance of the conclusion does not depend on the applicant, since only the date of submitting the application to the Ministry of Industry and Trade is fixed, Yadro added.

All DSS in the Tatlin line were developed by domestic Yadro engineers based on OpenPower processors, the company emphasized. However, the intellectual property of the processors used in Yadro DSS belongs to IBM.

The Ministry of Industry and Trade believes that there are no violations due to the fact that the Register of Industrial Products produced in the Russian Federation did not include DSS on the Russian processor after the entry into force of the new 719-PP requirements. The department told TAdviser that the issuance of opinions on confirmation of the production of industrial products on the territory of the Russian Federation is carried out in accordance with the 719-PP, and that on the basis of the documents submitted by the applicant, a conclusion was issued for a period of 1 year. And in accordance with the established regulatory acts, the products were also included in the Unified Register of Russian Electronic Products.

In accordance with clause 10 of the Decree of the Government of the Russian Federation of 10.07.2019 No. 878, the basis for exclusion from the register is: receipt of an application from the applicant, identification by the Ministry of Industry and Trade of the Russian Federation of the facts of the applicant's submission of forged documents and (or) inaccurate information about the applicant and (or) electronic products, - added to the Ministry of Industry and Trade.

When asked why DSS based on non-domestic processors were re-included in the Register of Industrial Products Produced in the Russian Federation after the entry into force of the new 719-PP requirements, the department did not answer at the time of publication of the material. By all indications, the department counts from the date of submission of an application for inclusion in the register, and not from the date of entry into force of new requirements.

I must say that Yadro DSS are not the only ones on a foreign processor that are in the Register of Industrial Products Produced in the Russian Federation. For example, the registry also lists the Bulat DSS system B-DSS-500-RD using Intel processors. However, this product was entered into the register in October 2020, even before the new requirements came into force.

And Yadro told TAdviser that, taking into account the new requirements 719-PP their company in 2020 began developing products based on domestic processors. The company itself develops processors based on the RISC-V architecture.

It should be noted that the development cycle of technically complex products such as DSS takes at least 3-5 years, despite this, the start of deliveries of Yadro products based on its own processors based on the RISC-V architecture is planned in 2023, the company noted.

As for the assessment of Oleg Emeradov's letter, the company believes that these are "information stuffing about the alleged illegal issuance of conclusions of the Ministry of Industry and Trade on DSS manufactured by Yadro," which began on the part of ANO RosSHD in June 2020, and indicate that one of the founders of ANO RosSHD is Aero Disk, a developer and manufacturer of solutions in the field of data storage and virtualization.

It should be noted that competition methods similar to those used by Aero Disk LLC interfere with the development of technological interaction, as well as healthy competition between Russian manufacturers and developers, said TAdviser in Yadro.

Conclusion of the Ministry of Industry and Trade on confirmation of production of SATA SSD format M.2 2258 in the Russian Federation

On July 13, 2020, it became known that the GS Nanotech microelectronics development and production center (as part of the GS Group holding) received an opinion from the Ministry of Industry and Trade confirming the production of proprietary solid-state non-volatile data storage devices (SSDs) in the Russian Federation. Starting the registry

On June 9, 2020, the Ministry of Industry and Trade announced the launch of the Register of Industrial Products Produced in the Russian Federation. It is available on the Government Information System (GIS) industry website.

By the time the service began, 27.14 thousand positions were placed there, indicating information about the manufacturer and the conclusion of the Ministry of Industry and Trade on confirming the production of industrial products in the Russian Federation. Also, within the framework of GIS, registers of such conclusions (3.7 thousand conclusions) and manufacturers of industrial products (1096 enterprises) were launched.

The register of industrial goods produced in Russia has been launched

With the launch of this register, state customers can comply with the requirements of legislation banning the purchase of certain types of imported industrial products.

At the end of April 2020, the government systematized and consolidated the prohibitive regulatory framework in the field of public procurement. In particular, the relevant government decree introduced a ban on public procurement of 125 items of certain types of imported industrial products

With the adoption of this decree, more than 10 other government decrees lost their force, which previously regulated the ban on the purchase by state customers of imported goods, works, services. We are talking, for example, about decisions on the establishment of bans on the purchase of certain types of mechanical engineering goods, light industry goods, certain types of goods of the furniture and woodworking industries and others.

At the same time, the resolution also indicated that the confirmation of the production of a particular product on the territory of the Russian Federation or the EAEU countries is the inclusion of information about such products in the registers of industrial products produced, respectively, on the territory of the Russian Federation and the EAEU countries.
