2021: Payment of 1 million rubles of compensation to a woman in labor for poor diagnosis of a fetus with a defect

The Irkutsk city perinatal center will have to pay compensation to a local resident in the amount of 1 million rubles in a lawsuit about the improper provision of medical services. This was reported by the prosecutor's office of the Irkutsk region at the end of May 2021.

As it turned out, a resident of the Angara region during pregnancy was registered in the perinatal center of the city. According to the case file, during the second and third screening studies, irregularities were committed in the assessment of the facial structures of the fetus, in addition, an assessment of the eye lenses was not carried out. The infant was diagnosed with a congenital anomaly in the development of both eyes. In this regard, he was recognized as a visually impaired since childhood.

Despite the fact that the defects in the quality of the medical examination conducted do not consist in a direct causal relationship with the onset of consequences in the form of the birth of a girl with a defect, however, at the stage of dispensary observation, examination and treatment during pregnancy, medical assistance to the Irkutsk woman by an obstetrician-gynecologist was not provided in full and did not comply with accepted medical standards, the regional prosecutor's office said.

The Kirovsky District Court of Irkutsk upheld these arguments, satisfied the lawsuit and recovered 1 million rubles from the perinatal center as compensation for non-pecuniary damage to the woman in labor. The court decision came into force.

By May 2021, the Irkutsk city perinatal center includes a complex of buildings with an area of ​ ​ about 14 thousand square meters. m, where there are 20 individual maternity halls, 77 chambers of joint stay of mother and child. In addition, the center includes an obstetric hospital for 150 beds, a gynaecological clinic for 100 beds and an outpatient and diagnostic department for 200 visits per shift.[1]
