In June 2015, Artur Contrabayev resigned from the ministry of his own free will. Instead of Contrabayev, his deputy , Yaroslav Rakov, was appointed to the post of Minister for Informatization, Communications and Open Management of the Tula Region .

Later, in July, it became known^[1]ex-Minister of Informatization Artur Contrabayev would take the position of general director in one of the largest clothing retailers "Fashion Continent" (brands Incity and Deseo). He will be responsible for the implementation of the company's long-term strategy approved by shareholders. He has been on the company's affiliate list since June 23.

Together with Arthur Contrabayev, another ex-official of the Tula region , Olga Tatarchenkova, joined Fashion Continent . 2017

Criminal case

In May 2017, the Main Investigation Department of the Investigative Committee of the Russian Federation opened a criminal case against Artur Contrabayev on the grounds of a crime under Part 1 of Art. 286 of the Criminal Code of the Russian Federation (abuse of office). A case under a similar article was initiated against "other unidentified persons" of the administration of the Tula region, the law enforcement agencies said in a statement.

According to investigators, in 2013, Contrabayev and a number of other persons exceeded their official powers in the implementation of the "Program for the Modernization of Health Care of the Tula Region for 2011-2013": they allowed unreasonable spending of budget funds in the amount of at least 13 million rubles.

As part of the investigation, searches are being carried out in the premises of the Ministry of Health of the Tula Region and at the places of residence of the defendants to find items and documents that are important for the investigation, according to the Investigative Department of the Investigative Committee for the Tula Region.

2020

Criminal closure

New criminal case

At the same time, for the same circumstances, against the background of which a criminal case was initiated earlier, in 2020, Artur Contrabayev was charged with another charge - embezzlement on an especially large scale (part 4 of article 160 of the Criminal Code of the Russian Federation). In the same case, businessman Alexei Chernousov, founder and former general director of Smart Delta Systems LLC, appears. He is suspected of complicity in the commission of a crime (part 5 of article 33, part 4 of article 160 of the Criminal Code of the Russian Federation).

According to investigators, the newspaper Kommersant writes, in 2013-2015 to create and support a regional health information system (RISZ) Smart Delta Systems received more than 68.3 million rubles from the regional budget, but the investigation considered that the system introduced in Tula did not meet the necessary characteristics, and with the allocated money the company supplied its old product without transferring exclusive rights to the Tula^[5]. The investigation believes that the ex-official and the businessman acted by agreement.

Artur Contrabayev was initially chosen as a preventive measure in the form of house arrest during the investigation in the case, and Alexei Chernousov spent eight months in a pre-trial detention center before the Basmanny Court transferred him to house arrest.

2021

The beginning of the trial in a criminal case

In the Central District Court of Tula, a trial began in the case of embezzlement of funds during the creation and implementation of a regional health information system (RISZ) in the Tula region. There are two in the dock: ex-minister of informatization of the Tula government Artur Contrabayev and businessman Alexei Chernousov, who passes under Part 4 of Art. 160 of the Criminal Code of the Russian Federation, and the founder and former general director of Smart Delta Systems LLC, passing under Part 5 of Art. 33 and part 4 of Art. 160 of the Criminal Code of the Russian Federation.

The investigation says that nothing was created at all. The defense petitioned for the case to be returned to the prosecutor to eliminate violations that, in its opinion, were committed during the investigation. To prepare a position on the declared petitions, the representative of the prosecutor's office took a pause until May 17. It is expected that on this day the court, having heard the arguments of the prosecution, will make a decision - to return the case for further investigation or to appoint a consideration on the merits.

The maximum punishment that Arthur Contrabayev faces if found guilty under Part 4 of Art. 160 of the Criminal Code of the Russian Federation following the consideration of the case on the merits - up to 10 years in prison. In the case of the article on complicity in the commission of a crime, according to which Alexey Chernousov passes, the maximum punishment is not so obvious in the Criminal Code of the Russian Federation.

Lawyer of the ex-Minister of Informatization of the Tula Government: We consider the charge in a criminal case far-fetched and unfounded

Artur Contrabayev does not admit his guilt on charges of embezzlement on an especially large scale (part 4 of article 160 of the Criminal Code of the Russian Federation), his lawyer Igor Chernetsky said in an interview with MK on May 13 after a preliminary hearing in the case in court took place a few days earlier^[9]

We consider this accusation to be far-fetched and unfounded. My principal and the second defendant, IT specialist Alexei Chernousov, do not admit guilt. Initially, another case was initiated against Artur Contrabayev under the article "abuse of power" (Article 286 of the Criminal Code of the Russian Federation). For several years there was a check, the investigation lasted a long time. As a result, the case fell apart, and then a new one arose, according to a more serious article. According to the prosecution, Alexei Chernousov and his company Smart Delta Systems did not fulfill the conditions of the state contract for the creation of a regional health information system in the Tula region, when Artur Contrabayev was responsible for informatization in the region. That is, the program was allegedly not created, although the contractor received money for it, the lawyer says.

In reality, this system exists. A certificate of work was signed in 2013. The program works. In some hospitals and polyclinics of the Tula region, it works better, somewhere worse. But these are already technical issues, issues of setting up and finalizing the program. The main thing is that it was created by Chernousov's company and introduced into the health care system of the Tula region, - said Igor Chernetsky.

Contrabayev, then the Minister of Informatization of the Tula Region, helped Chernousov, agreed with him in advance, ensured victory in the competition, the investigation believes. And the lawyer of Contrabayev claims that this is not the case, and that Chernousov initially did not receive a state contract:

He lost the contest. Another company was recognized as the winner. She undertook to make a InformSystem, but a month later refused. She stated that for such money it is impossible. There was a huge scandal, arbitration proceedings. The health informatization program in the region was on the verge of collapse. I had to announce a new competition, which was won by Smart Delta Systems.

Defender Contrabayev added that when the program was created, Chernousov arranged a large-scale presentation in the assembly hall of the Tula administration building. He taught doctors and officials to use the information system. However, experts from the prosecution concluded that the cost of work on the development of the program was 0 rubles 0 kopecks.

They essentially did not explain it in any way. But the investigator decided that Alexei Chernousov did not develop the program from scratch, but made it on the platform of the existing Infoklinika system. This is also the development of Chernousov's company. It really exists and was intended for private medical organizations, - said MK Igor Chernetsky.

According to him, the damage was first estimated at 17 million rubles, and then the investigation decided that the IT specialists did nothing at all, and the damage grew to 68 million rubles: 30 million rubles - the cost of the state contract and two years of service. At the same time, no money was found, Chernetsky claims:

Artur Contrabayev has only an apartment in Chelyabinsk and a Kia car from the property. Alexey Chernousov is far from a poor man, but he earned everything with his mind. I communicated with him, this is a real brain, a competent specialist.

The lawyer says the defense has prepared a motion to return the case to the prosecutor to address the deficiencies found. In addition, the defense will seek the appointment of a comprehensive examination: "We have repeatedly asked for this investigation, but we were refused all applications."

The prosecution clarified whether the ex-minister understands the difference between disagreement and misunderstanding of the prosecution, and suggested that he still admit that he understands the charge against him and simply does not agree with him. I clearly understand the difference between "agreeing with the charge" and "disagreeing with the charge" and "understanding" and "not understanding." I said that I did not understand, they told me: "You have written in Russian, you read and do not ask unnecessary questions. Alexey Chernousov also said that he also did not understand the accusation, since his actions within the framework of participation in the contract and its execution did not bring any damage, and moreover, the implemented system works on the territory of the Tula region, is available to every resident of the region and everyone can see this personally.

There are two versions of why a criminal case was initiated. First: someone needs it. To whom it is hard to say, think for yourself. Second: we just fell under the plan. There is a fight against corruption, and someone must be held accountable, - also said Artur Contrabayev in court[12]

The ex-minister added that it is difficult to talk about prospects, and that there is no guilt.

In fact, a criminal case is absurd. I hope that the case will be stopped and we will be acquitted. I think that the process will take at least six months - there are 234 witnesses who need to be interrogated. 2022: Unexpected twist in criminal case

In July 2022, the Central District Court of Tula appointed a repeated computer-technical examination in the case of embezzlement of 68 million rubles, which, according to the investigation, took place during the creation and implementation of the regional health information system (RISZ) in the Tula region. ^[13].

The court ordered a second examination after the prosecution and defense finished presenting evidence. The new study was entrusted to the Center for Independent Expertise of Information Technologies, located in Samara, - quotes Business FM lawyer Andrei Bastrakov, defending the former Minister of Informatization of the Tula government Artur Contrabayev.

According to him, the petition for a re-examination was announced three months ago by the representative of the victim, who recognized the government of the Tula region in the case. According to the defense, the research was carried out with violations. According to the digitalization rating of the regions, compiled in February 2021 by the government of the Russian Federation, the Tula region was among the leaders.

The lawyer claims that experts from the Russian Federal Center for Forensic Expertise under the Ministry of Justice and a specialist from the Russian Expert Foundation "Teheko" also pointed out "multiple shortcomings" of previously submitted examinations.

The main questions of the re-examination are whether the RISZ met the requirements of the contract, and what was the list and cost of the work performed. The lawyer explained that if the examination concludes that the RISZ met the requirements of the contract, then this will mean that the contract has been fulfilled and there is no damage.

The trial has been going on for more than a year - from May 2021. In addition to the ex-Minister of Informatization of the Tula Government, Artur Contrabayev, the general director of Smart Delta Systems LLC Alexei Chernousov also appears in the case. Both of them are under house arrest.

2023: Sentence - 3.6 years in a general regime colony

On May 23, 2023, the Central District Court of Tula sentenced the former Minister of Informatization of the Tula Government Artur Contrabayev in a criminal case - he was sentenced to 3.6 years in a general regime colony and 300 thousand rubles fines, the Tula Press portal reported^[14]He is also prohibited for 3 years from holding positions in state the service. The ex-official was found guilty under Part 4 of Art. 160 of the Criminal Code of the Russian Federation (embezzlement on an especially large scale).

Artur Contrabayev has been under house arrest since July 2020. The court ordered him to count the term of house arrest due to the served sentence at the rate of one day in one day in a general regime colony. The businessman Alexei Chernousov, the owner of Smart Delta Systems, who was in the same case with him, gave the court 3 years in prison and a fine of 200 thousand rubles, and also established a ban on activities related to state contracts. Alexey Chernousov was initially imprisoned in the Matrosskaya Tishina pre-trial detention center at the request of investigators of the Main Investigative Directorate of the Investigative Committee, from where he was transferred to house arrest only a few months later.

Earlier, representatives of the prosecutor's office asked the court to appoint Artur Contrabayev five years in a general regime colony and a fine of 900 thousand rubles, and Alexei Chernousov - six months less.

The case of multimillion-dollar embezzlement was considered for more than two years. During this time, about 90 court sessions took place, dozens of witnesses were questioned, including employees of the Ministry of Health, doctors and former subordinates of Artur Contrabayev.

Recall that, according to the investigation, Artur Contrabayev, holding the post of Minister of Innovation and Informatization of the Tula Region, entered into an agreement with the co-owner of Smart Delta Systems, which was engaged in the development of control systems and software. As a result, the company won the tender and received 68 million rubles from the regional budget to create a new information system for healthcare, but the investigation believes that outdated software was used, which did not require the declared costs.

The defense, in turn, insisted that the system based on the development of Smart Delta Systems - Infoklinika, which has undergone a deep modernization, was introduced and successfully operates, being an example for other regions.

The capital's Smart Delta Systems has been creating control systems and appropriate software for medical institutions for about 20 years. According to the company's website, during its work, it has implemented over 3.3 thousand projects in medical institutions of various profiles.
