"Other" life
In August, 2007 it was arrested within legal investigation of corruption in Federal Compulsory Health Insurance Fund and in March, 2008 it is released on bail. In the summer of 2009 the court found Smerdov guilty of bribery and sentenced to one and a half years of imprisonment in colony settlement, in January, 2010 imprisonment was replaced with the probation which ended in 2011.
Roots "Proteka"
Since 1997 Smerdov worked in "The center of implementation "Leaked"" (TsV "Leaked") - the distributor of medicines. The company created in 1990 in seven years opened more than twenty branches: On December 25, 1997 in Kirov the branch appeared "Leaked-26". Smerdov became the first director of the Kirov department of the company, and then - the branch manager who in 1999 had own trade mission in the Komi Republic. Smerdov managed to form a solid team and to make "Leaked-26" the leading distributor on regional pharmaceutical market.
In 2002 appointment as the sales director of head office of the company followed, and in April, 2003 - the First Deputy CEO TsV "Leaked". In 2004 V. Smerdov gained the diploma of MBA of the international institute of management "LINK" according to the program of the Open university of Great Britain.
In April, 2005 in St. Petersburg the scandal connected with participation by TsV ran high "Leaked" in implementation of the federal program for providing citizens with medicines of preferential categories. The city Healthcare Committee accused the company that it does not cope with supply of drugs for preferential categories of citizens. By this moment without medicines there were left about 200 thousand from half a million Petersburgers who addressed since the beginning of 2005 for preferential drugs. Smerdov explained the events with imperfection of logistics, and experts connected scandal with fight on pharmaceutical market of St. Petersburg.
Within the federal program TsV delivered medicines "Leaked" (for "federal" exempts) and local Imperiya-Pharma (for "regional" exempts). The last won in December, 2004 on the tender to which Center of implementation was not allowed. Besides, Imperiya-Pharma became also the only intermediary between Center of implementation and pharmacy chains. In May, 2005 Imperiya-Pharma obtained the license for supply of medicines for a collateral security therefore, in July, 2005 TsV "Leaked" refused participation in the federal program.
Vertical growth
On January 1, 2006 Smerdov becomes the CEO of TsV Protek Ltd. The previous CEO of TsV "Leaked" Oleg Astafurov became the senior vice president of JSC Protek.
Criminal case
In November, 2006 it became known: The Prosecutor General's Office of Russia about brought criminal case about corruption in the Federal Compulsory Health Insurance Fund (FCHIF). In media it received the name "medicinal" or "pharmaceutical scandal".
On December 4, 2006 the Tvoy Den newspaper reported as if Smerdov and the owner of the large company distributor of the drugs "Biotek" Boris Spiegel decided to leave the country until "medicinal scandal" settles. Arrest of heads of FCMIF disturbed sellers of drugs which said that the fund remained owes distributors about 25 billion rubles, those ran into debt to drug manufacturers who, in turn, perhaps should stop production. According to the edition, Smerdov began to pay off with debts, but soon departed to the USA for an indefinite term. Later other editions reported that Smerdov just was going on vacation and after his termination returned.
Arrest
On the 41st birthday Smerdov was called for questioning in management on investigation of especially important issues of the State Office of Public Prosecutor of the Russian Federation as the witness in the case of corruption in FCMIF. During interrogation investigators changed its status: announced suspected and delayed for 48 hours. Then in the press by mistake of Smerdov called the president of Protek Group.
On August 16, 2007 Basmanny Court of Moscow issued the sanction for Smerdov's arrest. According to some information, the decision to arrest the businessman was made because corruption schemes which the arrested heads of FCMIF used became known to the State Office of Public Prosecutor. According to media, these schemes were opened by three released at the end of July, 2007 from eight former heads of fund. Journalists assumed that heads of other large companies participating in scandal can appear defendants in the case also. It was reported that, according to unofficial information, Smerdov was suspected of bribery to heads of FCMIF. On August 17, 2007 brought to Smerdov official charges and incriminated article 291 parts of 1 Criminal Code of the Russian Federation ("Bribery to the official personally or through intermediaries").
According to Kommersant, Smerdov's arrest caused a serious loss to his company, being one of the largest pharmaceutical distributors in Russia. According to the industry agency RMBC to which the edition referred, "Leaked" reduced the share in terms of money almost twice - from 25% in 2006 to 14.3% in 2007.
Corporate protection
Protek Group and its partners made declarations in support of the arrested head. In November, 2007 "for progress in development and deployment of new technologies" Smerdov received the award "For Diligence for the good of the Fatherland" IV of degree and is awarded with the memorable diploma (the awards ceremony of winners was held a reception framework for participants of the II Annual Logistic forum "Logistics. Merchandising. Supply").
On January 1, 2008 according to the solution of Board of Directors, Smerdov who is in the pre-trial detention center is dismissed the CEO of TsV Protek Ltd and is appointed the vice president for strategic development of JSC Protek. At the head of the company there is Alexey Molchanov - the former first deputy of Smerdov, the acting as the company executive after arrest of the boss.
In criminal case of Smerdov call one of expected bribers: bring him charges of bribery for the total amount of $50 thousand. In the press it was noted that other bribers, "actively cooperating with the investigation, as a result of steel witnesses for the prosecution".
By the resolution of the Moscow City Court of March 25, 2008 to Investigative Committee at prosecutor's office it was dismissed the petition for prolongation of term of keeping of Smerdov under guards. The measure of restraint for it was changed therefore on March 27, 2008 Smerdov is released on bail.
Term and leaving
Trial about corruption in FCMIF ended in July, 2009. On July 30, 2009 mass media with reference to the press service of Moscow City Court reported that the board of jury trial, having considered cases, considered fault of the former heads of fund and Smerdov proved and on August 12, 2009 the Moscow City Court sentenced Smerdov to one and a half years of imprisonment in colony settlement, however in January, 2010 with the decision of the Supreme Court of the Russian Federation it was replaced with probation. In the same month Smerdov left "Leaked".
In November, 2010 Smerdov became the CEO of the production site of Protek of Pharmfirma Soteks Ltd. In February, 2011 it was a part of minority shareholders of Protek - purchased 0.0474 percent of shares of the company.
