2022: Court confirms company's cartel involvement in operating microscope shipments

At the end of October 2022, the Arbitration Court of the Altai Republic upheld the decision of the regional department of the Federal Antimonopoly Service (OFAS) to have a cartel conspiracy when supplying operating microscopes worth more than 17 million rubles.

In 2022, the Ministry of Health of the Altai Republic held a tender for the supply of operating microscopes for the needs of the republican hospital. The initial contract price was 17,300,000 rubles. Two applications from organizations from Moscow and Tomsk were received to participate in the electronic auction.

The OFAS Commission found that during the auctions, companies exchanged information in the interests of each other, and also conducted joint preparations for participation in the auction using a single infrastructure. In particular, participants used the same IP address when submitting applications for participation in the auction and when submitting quotations; applications of organizations were identical in their content and style of presentation; price proposals by both business entities were submitted simultaneously with a match of up to seconds; each of the participants took only two "steps" during the auction, lowering the initial price by only one and a half percent.

Now the cartel members face large fines - litigation lies ahead. We are talking about the companies "Mercury" (Tomsk) and "Alfa Medica MSK" (Moscow).

In June 2022, the companies appealed the decision of the OFAS Commission in the Arbitration Court of the Altai Republic. Suppliers referred to an agreement on the peculiarities of management and current activities, concluded in January 2021, according to which both companies are under control and belong to one individual - the general director and founder of Mercury LLC Timofey Smolin. However, the court dismissed the claim, citing the fact that, according to the Unified State Register of Legal Entities, the second company is 100% owned by another person. The decision did not enter into legal force.[1]
