The validity of passports is questionable. The online service of FMS does not work

Online service of Federal Migration Service[1] allows anyone to check validity of the Russian Federation citizen passport according to its main details.

Address service including notaries, the staff of state bodies and banks to whose duties check of validity of the passport, but, as of July, 2015 belongs, information provided by service has no legal importance.

An attempt to adjust work of credit institutions with service through the system of interdepartmental electronic interaction (for ensuring the legal importance), made in 2013-2014, was not crowned with success.

Periodic unavailability of public service on the website of FMS puts its users (first of all, banks) in a difficult situation. Without having an opportunity to check validity of the passport, they are forced to refuse to clients provision of services.

History of service

2007: Start

Service which addresses the database of the Russian passports and checks existence in it of the entered passport data, was started on the website of FMS in September, 2007. The director of migration service Konstantin Romodanovsky then reported that the database was created about a year.

"This service will help the interested structures to check any passport on the basis of which this or that legal, financial, notarial transaction or the transaction will be made" — the director of FMS in 2007 said.

Then to service there were complaints. "From 30 journalists of Izvestia which underwent testing, only five received confirmation that their passport is valid. A system issued the rest shocking - "this passport does not appear on accounting of the issued passports". Or it is even worse - "the passport is invalid", -[2] wrote[2].

The FMS explained it with the fact that the database of passports of launch was completed only for 60% of all available passports.

As DBMS, according to the register of federal state information systems, the FMS uses Oracle Database 11g[3].

2013: Connection of banks to service through SIEI

In 2013 banks had an opportunity to address FMS service through the System of Interdepartmental Electronic Interaction (SIEI) for check of passport data of the borrowers submitting applications for receiving the credit and also when checking the investors wishing to take away the money from bank.

Information transmitted through SIEI has the legal importance.

2014: Claims of banks

In July, 2014 during the meeting of presidium of the Association of Russian Banks (ARB) a number of its participants brought up a question of problems in interaction with FMS.

Often the FMS service does not work within several days and, respectively, banks cannot perform necessary check.

"In practice for this reason banks are often forced to refuse to clients – individuals service, - it was said in the statement of ARB. - At the same time such failures, and especially failures in issue of deposits, are inevitably regarded by clients as sign of presence at bank of the difficulties fraught with revocation of license that in an essential measure harms image and a goodwill of credit institution and also can easily provoke panic of investors".

According to the source editions of CNews familiar with activity of FMS, service of check of passport data had two vital issues. First, its database slowly worked, secondly, he periodically "fell"[4].

The problem connected with periodic unavailability of FMS service, according to a source, arose in connection with the increased access rate from banks. The situation was aggravated by requests from bureaus of credit histories which sold to banks service of verification of passport data and also addressed for their check in FMS.

Some bureaus of credit histories could perform verification of passports through the "friendly" banks connected to FMS service through SIEI and then sell this service to other banks that is violation of the law.

The Ministry of Telecom and Mass Communications then said that to SIEI about 800 banks were connected, respectively, load and of service for check of passport data considerably increased: "The FMS service is one of the most demanded in SIEI. Therefore the service should manage correctly its power".

2015: Shutdown from SIEI

In July, 2015 TAdviser knew that FMS disconnected banks from the service of verification of passports in SIEI. According to the source editions, the reason was the fact that some credit institutions "traded in data".

"The migration service wrote the letter to the government. There charged to the Ministry of Telecom and Mass Communications to publish rules of connection of banks to service. The resolution is still not issued. Banks are disconnected before adoption of the resolution", - he says.

In one of banks entering in top-30 the largest reported to TAdviser that submitted the official application to FMS for connection to service through SIEI at the end of 2014, but did not receive the answer.

The open base FMS, according to the bank representative, sometimes issues inexact data on validity of the passport, and banks should refuse to such clients service. Such situations occur extremely seldom, and in this case the client needs to request the reference in the FMS confirming validity of the passport and already with it repeatedly to address to bank, he adds.

From July 7 to July 10, 2015 also public service did not work at the website of FMS. "We pay your attention! Service is unavailable in connection with carrying out technical works", - it was said on the website of the department.

Thus, these days check of validity of passports could not be performed in general.

The interlocutor of TAdviser close to FMS, the attention that the online service does not work at the website of the department surprises: "It the source which does not have legal character. Banks have no right to refuse to clients on the basis of results of this service".

According to him, in a present situation banks should check the paper passport for signs of counterfeit. The online service in FMS is hoped to display in a legal field in 2016. "Here then all reproaches of banks and other companions will be reasonable", - he considers.

Official comments in FMS and the Ministry of Telecom and Mass Communications by the time of the publication of the text could not provide.
