Biography

Alexey Ivanov was born on June 15, 1960 in Bashkiria.

Since 2001, he worked in various positions in Russian IT companies.

In 2005, he got a job at Technoserv, where as of 2007 he headed the department for working with the energy industry.

2016: Transition to FIU

In 2016, Ivanov became an adviser to the chairman of the Pension Fund board, and on April 3, 2017, he took office as deputy chairman of the Pension Fund board.

In this post, he oversaw the issues of information technology, telecommunications, personalized accounting, information security, and the provision of services in electronic form.

In the new position, Alexei Ivanov replaced Nikolai Elistratov, who worked in the FIU since 2010.

2019

Arrest for corruption patronage of Technoserv

Detention

On July 10, 2019, Alexei Ivanov was detained by law enforcement officers on suspicion of receiving a bribe (Article 290 of the Criminal Code of the Russian Federation), two sources told TAdviser. According to one of them, the detention was preceded by the seizure of documents in the FIU, as well as in the offices of its IT contractors - in the companies Technoserv and Redsis.

One of the interlocutors of TAdviser says that the detention occurred before the announcement of a tender for the development of the key information system of the Pension Fund - the unified state information system of social security (EGISSO). The volume of the contract, he said, could amount to about 1.5 billion rubles.

The Pension Fund told TAdviser that the necessary assistance is provided to the investigating authorities. The fund is operating normally.

Technoserva believes that conducting investigative actions in the company's offices is associated with the activities of the team of the former chairman of the company, Alexei Ananyev.

Kopeikin as of July 2019 was an employee of Technoserv, his acquaintance confirmed to TAdviser. How the corruption scheme was arranged

According to investigators, in 2017, the Promsvyazbank bank card issued in the name of Technoserv employee Alexei Kopeikin was transferred to Alexei Ivanov. Every month for almost two years, Technoserv transferred 200 thousand rubles to this card. In total, thus, 4.4 million rubles were paid.

Ivanov told the investigation that on his part it was not bribes, but fraud, since he did not provide services to Technoserv for this money.

According to whose instructions the money was transferred, it has not been officially established, Kommersant said. The investigation, however, does not exclude that it was the ex-co-owner of Promsvyazbank Alexei Ananyev, who had previously headed the Technoserv group of companies and was removed from management at the end of 2018.

Ananyev, according to a TAdviser source, left Russia a few months ago and lives in Austria.

Kopeikin's defense insists on his innocence, since "he did not know what was happening to his bank card."

A TAdviser source believes that several people knew about the corruption scheme. Some of them, first of all, former employees of Technoserv, could be interested in disclosing it, because now they work in competing companies and compete with Technoserv in tenders of other state departments. But there are interests both within the FIU and in other departments that want to increase their influence on large financial flows around the fund's IT systems, the source is sure.

Appeal against the arrest decision

Soon after the Basmanny court ruled on the conclusion of Alexei Ivanov in the pre-trial detention center, his lawyers, who asked to choose a preventive measure for the client in the form of house arrest, filed an appeal. A registered complaint was reported to TAdviser in the Basmanny Court on July 16. Its consideration is due on July 31.

The complaint was filed by lawyer Kidyaev. In addition to him, the case of Ivanov is dealt with by lawyer Anas Elmurzaev, on whose account - participation in a number of unique criminal cases. More details here.

Alexei Kopeikin, the manager of Technoserv, who is a suspect in the same case, is not behind Alexei Ivanov. The Basmanny court told TAdviser that his defense would also try to appeal the decision of the first instance on detention. This complaint is scheduled for 29 July.

According to the Basmanny Court, the complaint was filed by lawyer Yurasov N.K. In the court of first instance, in addition to her, Kopeikin's interests were represented by two more lawyers - Glukhov A.N. and Perov A.V. A source close to Technoserva told TAdviser that initially Technoserv provided Alexei Kopeikin with "one of the best lawyers Moscow," decided to attract the best lawyers. The source did not specify the name of the lawyer from Technoserv.

The court did not release Alexei Ivanov under house arrest

On July 31, 2019, the Moscow City Court considered the appeal of the lawyers of Alexei Ivanov against the decision of the Basmanny Court, which sent him to the pre-trial detention center during the investigation in the bribe case. The defense asked to change Ivanov's preventive measure to house arrest, but the court upheld the decision of the first instance. The decision, which was announced by Judge Silina, says that Ivanov will remain in jail until September 9.

The consideration of the complaint of lawyers Alexei Ivanov in the Moscow City Court began with a delay of almost four hours. Ivanov participated in it via video link from the pre-trial detention center.

During the trial, it was mentioned that Alexei Ivanov was transferred to the status of an accused at the request of the investigator. Previously, he appeared in the case in the status of a suspect.

The representative of the prosecutor's office Meshcheryakova in court supported the complaint of the defense of Alexei Ivanov about changing his preventive measure for house arrest.

In turn, the investigator considered it necessary to leave Ivanov in custody. He believes that the accused did not plead guilty.

Ivanov's interests in court were represented by a total of three lawyers. The key is Anas Elmurzaev, known for his participation in a number of unusual criminal cases (more details here). He is the main defender in the Ivanov case, who is building a line of defense.

Lawyer Ivan Kidyaev in court expressed the position that the decision of the Basmanny court to detain Ivanov is illegal and unmotivated. He argued this by the fact that the chosen preventive measure is applied only when other preventive measures are inoperable. But in the case file there is no reason for Ivanov to be detained, the lawyer believes.

Kidyaev described in detail the exceptional circumstances requiring detention described in the law: when the accused can escape, interfere with the investigation, continue criminal activities, threaten the participants in the investigation and destroy documents. In the case of Alexei Ivanov, the lawyer believes, there are no such grounds.

Also, the defender believes, the court did not take into account such circumstances as the identity of the suspect, his property in Russia and elderly veteran parents, whose health is now in serious condition, as well as his minor granddaughter, whom he provides support. In his opinion, there is no reason to believe that Alexei Ivanov may hide from the investigation.

The lawyer asked the court to change Ivanov's preventive measure to house arrest at the place of his actual housing - in Balashikha, where he lived with his parents before his arrest.

Lawyer Anas Elmurzaev cited to the court the positive characteristics of the accused as a decent citizen and, like his colleague, noted that the court of first instance, when deciding, was based only on the gravity of the crime.

A third lawyer emphasized that Ivanov does not have the opportunity to continue criminal activities, since he has already left his post in the Pension Fund. He added that under house arrest, his client will be in a certain place all the time and will be available for conversations with the investigation. And the conditions of the pre-trial detention center can negatively affect his health.

Ivanov's position: I am to blame, I confirmed the receipt of funds

Ivanov himself, addressing the court, agreed with the arguments of the defenders and asked to consider their request to change the preventive measure.

Comments of the lawyer: we plan to appeal the decision on detention

Lawyer Anas Elmurzaev told TAdviser that Ivanov does not have a phone in the pre-trial detention center, he is allowed to meet only with his next of kin and lawyer once every two weeks, due to the capacity of six dating booths in the Lefortovo detention center.

According to Elmurzaev, in the case file available to the lawyer, there is nothing that indicates the validity of the preventive measure in the form of detention for Ivanov. But the materials of operational-search activities have not yet been declassified, lawyers do not have access to them, he added in a conversation with a TAdviser correspondent.

According to the experience of lawyer Elmurzaev, in such cases, pre-investigation actions last about a year. During this time, suspects may be released from the pre-trial detention center: someone in 2 months, whom in 7. This depends on when the court finds that the suspect will no longer be able to influence the investigation. And this is in a situation where the detention was initially justified, unlike the current case, the lawyer emphasized.

Ivanov's defense plans to file a cassation appeal against the decision to detain him. Anas Elmurzaev expressed joy that the representative of the prosecutor's office supported their position.

Earlier, on July 29, the Moscow City Court did not release under house arrest the manager of Technoserv Alexei Kopeikin, who is also a suspect in the same case.

Dismissal from the post of deputy head of the FIU

On August 19, 2019, Prime Minister Dmitry Medvedev signed an order dismissing Deputy Head of the Pension Fund Alexei Ivanov in connection with the loss of confidence. It was published by the official Internet portal of legal information on August 20.

The FIU noted on this occasion that Ivanov's dismissal did not affect the work of the fund. The FIU is undergoing routine inspections in accordance with internal control and internal audit programs[5].

Seizure of real estate and accounts

On December 6, 2019, the Basmanny Court of Moscow told TAdviser that by court decision a security arrest was imposed on the real estate and accounts of Alexei Ivanov. To what extent Ivanov's real estate and funds were arrested, TAdviser was not specified in court, but they added that we are talking about his ruble and foreign currency accounts.

In addition to Ivanov, Alexei Kopeikin's bank accounts were also seized in one criminal case with Alexei Ivanov. Real estate in his case did not affect this, they say in the Basmanny court.

The TASS agency, citing law enforcement sources, reports that the total amount of Ivanov's seized real estate is about 70 million rubles. According to the interlocutor of the agency, the measure adopted applies to his three apartments in Moscow and the Moscow Region, a country house and a land plot in the Moscow Region[6]

The Basmanny Court also told TAdviser that in addition, at the request of the investigator, the period of detention of Alexei Ivanov and Alexei Kopeikin was extended. They will remain in jail until March 20, 2020, says a representative of the Basmanny Court.

This is due to the need to extend the preliminary investigation in the case. The previous planned deadline for the completion of the preliminary investigation was indicated on December 9, 2019.

2020

Extension of detention

On March 6, 2020, the Basmanny Court of Moscow extended Alexei Ivanov's detention for three months - until June 9, 2020.

Transfer to house arrest

The Basmanny Court of Moscow transferred from the pre-trial detention center to house arrest until July 9, 2020, the former deputy chairman of the board Pension Fund of the Russian Federation Alexei Ivanov. This was reported by Interfax on June 5, 2020 with reference to the press service of the court [7].

The investigation asked to extend Ivanov's detention, but the court refused to satisfy the application.

At the same time, the court took into account that Ivanov has a permanent place of residence and registration, strong social ties, he fully admitted guilt by writing a confession. In addition, the court took into account his age, marital status, state of health and the presence of diseases, elderly parents suffering from chronic diseases, as well as the lack of information that he was hiding from the investigation, evading appearances to the investigator and threatening participants in criminal proceedings.

Earlier, the defense of Alexei Ivanov has repeatedly tried to rescue him from the pre-trial detention center and transfer him to house arrest. However, these attempts were unsuccessful.

At the same time, in December 2019, Mogorsud has already transferred Alexei Kopeikin, who is also in the case, to house arrest, having satisfied the appeal of the defendant's defense against the decision of the Basmanny Court to extend his detention in the pre-trial detention center until March 9, 2020.

In July 2019, the investigation charged Alexei Ivanov with receiving a particularly large bribe (part 6 of article 290 of the Criminal Code of the Russian Federation). According to investigators, in the period from 2017 to 2019, he received a bribe from representatives of Technoserv for a total amount of at least 4.4 million rubles.

In July 2019, Ivanov pleaded guilty. He stated that he repented of his deed and that he had filed an application for dismissal from his post.

Extension of house arrest

On July 7, 2020, the Moscow City Court extended Alexei Ivanov's house arrest for 2 months.

Prosecutor's attempt to re-detain

On July 8, 2020, the Moscow City Court refused the prosecutor of the Prosecutor General's Office of the Russian Federation A.V. Loev to return Alexei Ivanov to custody[8]

The appeal decision of the Moscow City Court provides the main theses of Loev's appeal. Thus, in his opinion, the change in the preventive measure from detention to house arrest is illegal and subject to cancellation due to the inconsistency of the court's conclusions with the factual circumstances of the case, a significant violation of the criminal procedure law.

Loyev also notes that the grounds that served as the reason for the detention of the accused and the further extension of this preventive measure have not changed and have not disappeared. He draws attention to the fact that Ivanov is accused of committing a particularly serious crime of corruption, which poses an increased public danger, the punishment for which is provided in the form of imprisonment for a long period.

The investigation continues to collect evidence, establish all persons aware of the crime and those involved in it. In addition, within the framework of the pre-trial agreement concluded with Alexei Ivanov, his involvement in the commission of similar crimes is checked. Given this, there are sufficient grounds to believe that when choosing a different, milder, preventive measure, Alexei Ivanov will hide from the investigation or the court, may threaten witnesses and other participants in criminal proceedings, destroy evidence, otherwise obstruct the proceedings, the prosecutor's words are quoted in the appeal decision of the Moscow City Court.

Nevertheless, "having checked the submitted materials, discussing the arguments of the appeal submission, listening to the opinions of the parties," the Moscow City Court did not find grounds for returning to Alexei Ivanov the previous preventive measure.

According to the Moscow City Court, the Basmannoy District Court fully took into account all the necessary information, including the volume of planned investigative and procedural actions against Alexei Ivanov.

In such circumstances, the court of first instance, contrary to the arguments of the appeal submission, correctly concluded that the unhindered conduct of further criminal proceedings in the case is possible through the application of a milder preventive measure in the form of house arrest against Alexei Ivanov. Contrary to the arguments of the appeal submission, the mere gravity of the alleged crime and the possibility of imposing a sentence for a long period of time are not unconditional and sufficient grounds for extending the detention of the accused - appears in the appeal submission of the Moscow City Court.

Extension of house arrest

On October 8, 2020, the Moscow City Court extended the house arrest of the ex-deputy head of the FIU Alexei Ivanov and the former director of the department for working with state structures of Technoserv Management Alexei Kopeikin. According to TAdviser lawyer Ivanov Alexander Zinurov, both defendants in the Moscow City Court extended house arrest for 3 months, until January 9, 2021.

Investigation of the criminal case reached the finish line

In December 2020, Alexei Ivanov and Alexei Kopeikin were extended house arrest for another three months. This was announced in January 2021 by TAdviser lawyer Ivanov Alexander Zinurov. The Moscow City Court did this at the request of the investigation.

Alexander Zinurov expects that this extension will most likely be the last. According to him, the investigation is nearing completion. The case should then be referred to the court for consideration on the merits.

2021: Verdict in corruption case - 4 years in a strict regime colony

In September 2021, the Lefortovo Court of Moscow sentenced the former deputy chairman of the board of the Pension Fund of the Russian Federation Alexei Ivanov and the ex-director of the department for working with state bodies of Technoserv Alexei Kopeikin in a criminal case of corruption. The Lefortovo court told TAdviser that Ivanov was found guilty of committing a crime under Part 6 of Art. 290 of the Criminal Code (receiving a bribe on an especially large scale). He was sentenced to imprisonment for a term of 4 years with serving in a maximum security penal colony, with deprivation of the right to hold positions in the civil service and in local self-government bodies related to the exercise of organizational, administrative and administrative powers, for a period of 3 years.
