MiG did not pay 65 million to the Russian telecom developer for "iron" of Huawei

2019: The claim of Damask steel on 65 million rubles.

On August 23, 2019 it became known that the Russian aircraft constructing corporation "MiG" it is necessary to be calculated compulsorily with the IT- the contractor for the works performed by him of 65 million rubles and also to pay him 683 thousand rubles in the form of a penalty. These amounts appear in the decision of Arbitration court Moscow as subjects to collecting for benefit of the company "Damask steel", known in the market as the developer of the domestic telecommunication equipment (enters a guidance loop Rostec state corporations).

Follows from court documents that on November 9, 2018 MiG signed with Damask steel the delivery agreement of a certain hardware and software system (HSS) and implementation of balancing and commissioning concerning it. The contractor fulfilled the obligations in full and in time that is confirmed by the consignment note of December 25, 2018 and the act of readiness of the PACK ICE for operation of December 29, 2018. However the state customer did not pay off the company, as forced Damask steel to take on May 20, 2019 with the claim legal action.

MiG during trial objected to the satisfaction of the stated requirements, but his argumentation is not reflected in the conclusion of judges. At the time of a material exit in aircraft constructing corporation to explain CNews the non-payment reason for the contractor could not explain.

Rendering a verdict for benefit of Damask steel, judges specified that they assessed a situation "on the internal belief based on a comprehensive, complete, objective and direct investigation available in proofs".

The analysis of the website of state procurements allows to claim that at least for the last year MiG conducted procurement of an expensive PACK ICE only once, and in this tender just and Bulat got a victory. Thus, judicial proceedings concerned the so-called quotation request started aircraft constructing corporation on September 28, 2018 with the starting price of agreement of 63.8 million rubles. Nobody competed with Damask steel on the tender.

In the technical project follows from the specification of the equipment that the state customer needed "iron" the Chinese Huawei. In particular, MiG requested storage system Huawei OceanStor 5500 V5, the Huawei E9000 and 16 bleyd-chassis bleyd-servers Huawei E9000 on processors Intel Xeon E5-2697 v4. "The HSS should be provided by the monobranded complete solution" — it was emphasized in terms of reference.

Proceeding from the text of the technical project, it is possible to conclude that the HSS was required to MiG for the system of virtualization of the automated jobs (AJ). It was supposed that the HSS will ensure functioning of virtual remote jobs for work with office applications and also the centralized control and control of system servers. The virtualization platform, virtual workstations, virtualization servers, a storage system and network equipment had to be a part of the PACK ICE a management subsystem client connections.

"All server components of a HSS should be connected among themselves by a high-speed local computer network based on Ethernet technology with capacity of 10 Gbps — it was specified in terms of reference. — As the main network transport protocol for communication between all HSS components the stack of protocols of TCP/IP should be used".

In the section of documentation concerning perspectives of development of the PACK ICE it was noted that it "should have long lifecycle". "For maintenance of compliance of system performance to relevant requirements throughout the entire period of operation, when developing it is necessary to provide a possibility of its upgrade in use due to the choice of the corresponding architecture of the software and technical means and also due to use standardized and effectively accompanied solutions" — the customer added.^[1]
