2023: Fine for participation in the cartel when purchasing medical equipment for the Omsk Ministry of Health

The Office of the Federal Antimonopoly Service (OFAS) in the Omsk Region in March 2023 announced the imposition of working fines on cartel participants, which was created during the supply of medical products to the regional Ministry of Health. The amount of the fine amounted to 18 million rubles.

Violations of antimonopoly legislation in the actions of the Ministry of Health of the Omsk Region, the regional Directorate for Servicing the State Health System and Suppliers of Medical Equipment: UnikHelz LLC, Linkos MK LLC, NickMed LLC and NewMedTech LLC - OFAS revealed in April 2022. Ministry officials gave instructions to conclude contracts for the supply of medical equipment with a specific supplier in the amount of over 634 million rubles.

The OFAS found that the contracts were concluded with violations. Justification of the initial maximum price of contracts by the customer was not carried out in accordance with the established procedure. The prices at which medical equipment was purchased were overestimated. The actions of the parties to the agreement led to the restriction of competition, the department said.

Initially, investigators believed that the then head of the Ministry of Health of the Omsk Region, Irina Soldatova, together with the head of the Directorate for Servicing the State Health System of the Omsk Region, Viktor Babikov, organized the preparation of documents for concluding state contracts "with affiliated commercial organizations for the supply of medical equipment at a clearly inflated cost, including as part of the development of budgetary funds allocated to the Omsk region to combat the spread of a new coronavirus infection. " The budget suffered damage in the amount of 105 million rubles. However, in November 2021, the criminal prosecution of Babikov was stopped - "due to the non-involvement of the suspect in the commission of the crime." In December 2022, the Court of Appeal of the Omsk Region confirmed the cartel conspiracy.[1]

2022: Award of 396 million rubles in a dispute with the Ministry of Health of the Omsk Region

In October 2022, the Eighth Arbitration Court of Appeal considered the complaint of the Ministry of Health of the Omsk Region in the case of the supply of medical equipment to combat the COVID-19 coronavirus. The agency was unable to challenge the debt to the NickMed company.

NickMed filed a lawsuit against the regional Ministry of Health with a demand in the amount of about 396 million rubles. The reason for the lawsuit was the state contract for the supply of medical equipment concluded in 2020 by Irina Soldatova, who was then the head of the ministry. The total amount of the contract amounted to more than 565 million rubles.

"Nikmed" handed over to the customer 8 anesthesia-respiratory and 4 X-ray devices, 10 bronchoscopes, 300 pulse oximeters, 101 gas supply systems, a tomograph, 107 ventilators, 19 gas analyzers, etc. Therefore, the regional Ministry of Health refused to pay for them and demanded to terminate the contract. The contract was the largest of those concluded by the Ministry of Health of the Omsk region during the pandemic.

The regional Ministry of Health transferred an advance to NickMeda in the amount of 30% of the total contract amount. The amount of claims filed by NickHoney is equal to the remaining 70%, which the supplier never received. According to some reports, the Ministry of Health does not close the contract, because some of the equipment supplied does not meet the technical characteristics.

In 2022, the Omsk OFAS revealed a conspiracy between the regional Ministry of Health and suppliers of medical equipment, including Nikmed. The amount of contracts concluded in 2020 was estimated at almost 600 million rubles. In relation to Soldatova and accomplices, a criminal case is being investigated on abuse of office with serious consequences.[2]
