2020: Creation of service of communication with FSSP through EPGU

Mintsifra announced start on the Uniform portal of the public and municipal services (EPGU) of the service allowing debtors and execution creditors to send to the Federal Bailiff Service (FBS) of the statement, petition, an explanation, branches and complaints after executive to productions electronically. Service is available to physical persons and legal entities. It became known on December 29, 2020.

Debtors will be able to return excessively withheld money, to inform the court usher on debt repayment, to declare reasonable excuses of impossibility to perform requirements of the executive document. Execution creditors will be able to submit the application for time of restrictions for departure of the debtor abroad, to announce judicial a prefix property of the debtor, repeatedly to send the executive document for execution to the court usher and also to check correctness of money recovery from the debtor.

The federal draft "Digital Public Administration" (DPA) of the national program "Digital Economy" assumes selection of 961 million rubles on development of the Automated Information System (AIS) of FSSP. Funds will be allocated from the federal budget.

It is supposed to provide maintaining a databank of executive documents based on GIS GMP (The state information system about the state and municipal payments), their registration by means of SIEI (System of Interdepartmental Electronic Interaction) by courts and other bodies and also automatic providing data from a databank to employers and banks. Ensuring interaction with court ushers through EPGU is also put in fedproyekt by TsGU.

The planned actions will lead to achievement of a number of results. First, lifting of restriction of the departure from Russia imposed according to the executive document on money recovery will be automatically performed within one hour after payment. At the same time an opportunity to trace stages of process of lifting of restriction of departure on EPGU will be provided.

Other planned result — expansion of structure and reduction to 30 seconds of term of providing data on the course of enforcement proceeding. The execution creditor — the legal entity will be able to receive the list of enforcement proceedings on the TIN (taxpayer identification number), including with indication of the debtor's TIN — the legal entity.

The possibility of the notification (notification) of citizens by means of EPGU without existence of consent and without waiting of an input of the citizen in a personal account will be provided. The corresponding opportunity will be implemented through banks and cellular operators. Information on existence of debt will be transferred to a digital profile of the party of enforcement proceeding.

Also the possibility of operational obtaining the Insurance Number of Individual Ledger Account (insurance number of the individual ledger account) and details of the relevant passport of the party of enforcement proceeding according to other information about him specified in the executive document will be provided.

Replies of the Ministry of Internal Affairs (Ministry of Internal Affairs) to requests for receiving a registration address in the place of stay/residence and on providing data on existence/lack of criminal record, replies of Rosreestr from USRRE (Uniform State Register of the Real Estate), replies of other departments will be submitted no more than two days and without restriction on quantity in time. It will be possible to specify the specifying information (the region of residence, details of the passport, the foreign passport, the outdated passport) in requests.

Document flow of executive documents between FSSP and administrators of budget revenues will be excluded. The FSSP will perform forced execution on the basis of data on failure to pay a penalty, the taxes and fees at the scheduled time arriving from GIS GMP. The direction of the executive documents in FSSP issued by the notary will be perhaps in electronic form.

In a pilot zone giving of FSSP in courts of statements and petitions will be provided during enforcement proceeding in an electron a type. Also it will be provided in electronic form FSSP from courts of judicial acts based on the consideration of the applications and petitions received from FSPP and from other participants of enforcement proceeding. Lifting of restrictions for pronouncement of several executive documents in electronic form is planned if the solution contains diverse requirements.

For legal persons and entrepreneurs, being the parties of enforcement proceeding, employers will provide a possibility of the organization of electronic document management with FSPP by means of SIEI regarding obtaining resolutions, obtaining information on the course and existence of enforcement proceeding, filing of applications and petitions. Document management with all credit institutions will be performed by means of SIEI completely in electronic form^[1].
