4 years in prison and a fine for fraud in the purchase of medical oxygen

On January 21, 2021, the Leninsky District Court of Ulyanovsk issued a verdict in a high-profile criminal case, the defendants of which are former general director of Ulyanovskfarmatsiya JSC Olga Kuznetsova, her deputy Yevgeny Kogan, regional health ministers Pavel Degtyar and Rashid Abdullov, as well as the former vice speaker of the regional legislative assembly and chairman of the committee on social policy, Igor TT, ex-deputy secretary of Russia. All of them are accused of fraud in the purchase of medical goods for the needs of health care (part 4 of article 159 of the Criminal Code of the Russian Federation, up to 10 years in prison).

According to the investigation, Tikhonov and Abdullov, using their official position in state authorities, exerted pressure and forced representatives of medical institutions to conclude contracts and agreements with Ulyanovskfarmatsiya JSC for the supply of medicines and medical oxygen.

The press service of the Main Investigation Department of the IC of Russia reported that no later than May 2017, accomplices united to commit theft of funds allocated for the implementation of state programs. According to the results of the joint bidding in the form of an electronic auction by the heads of medical institutions of the Ulyanovsk region, misled, during 2017 and until January 2018, state contracts and contracts for the supply of oxygen totaling at least 10.4 million rubles were concluded, the UK said.

All members of the group were found guilty by the court of major fraud by prior conspiracy using their official position.

As a result, Pavel Degtyar, Olga Kuznetsova and her deputy Yevgeny Kogan were sentenced to 2.5, 3.5 and 4 years in prison with fines in the amount of 200 to 800 thousand rubles. Igor Tikhonov and Rashid Abdullov were sentenced to 5 and 4 years in prison, respectively, to a fine of 1 million 700 thousand rubles with deprivation of the right to hold positions in government agencies for 3 years and 2.5 years.[1]

Annulment of sentence, withdrawal from colony

At the end of November 2021, the Sixth Court of Cassation of General Jurisdiction in Samara overturned the sentence to the former Minister of Health of the Ulyanovsk Region Rashid Abdullov. He was accused of corruption and misappropriation of budget funds allocated for the purchase of oxygen and medical devices for medical institutions.

In June 2021, the regional court reviewed the case and the sentence remained unchanged. Rashid Abdullov, as well as another person involved in the case of the first vice speaker of the regional Legislative Assembly Igor Tikhonov, was transferred to a colony in Dimitrovgrad.

At the end of November 2021, the court, canceling the sentence, agreed with the arguments of the defense and refused to satisfy the cassation submission of the prosecutor's office, which demanded a harsher punishment. In addition, the court decided the issue as Rashid Abdullov and Igor Tikhonov were suppressed, appointing them a ban on certain actions, and everyone else a recognizance not to leave. Rashid Abdullov and Igor Tikhonov were released from the colony. The case was sent to a new trial in the new composition of the court.

Lawyers Tikhonov and Abdullov call the accusations against the defendants far-fetched, deny the guilt of former officials and hope to prove this during the next court session.

The criminal group is accused of embezzlement of 11.9 million rubles. 2.3 million rubles disappeared when the Ministry of Health was led by Pavel Degtyar. The funds were intended for the purchase of oxygen. 9.6 million disappeared from the budget under Minister Abdullov. This money was supposed to go to the purchase of medical devices.

According to lawyer Pavel Degtyar Irina Savelyeva, the ministers did not violate the laws, but performed their duties.
