Charge of the deputy director of the institute with counterfeiting X-ray scanners

On April 7, 2021, it became known about the scheme for counterfeiting X-ray scanners in the Tomsk region, which was revealed by the Investigation Department of the regional Investigative Committee. The agency reported this on April 7, 2021.

The accused in the case is the former deputy director of the Moscow JSC Research Institute of Electromechanics (NIIEM) Vladislav Rasteryaev. According to the investigation, this company delivered X-ray scanners purchased from a third-party company and converted into its own products to four district hospitals in the Tomsk region. Marking and accompanying documentation were changed in the equipment.

Thus, he produced falsified medical products, accompanied by false information about their characteristics and the manufacturer (manufacturer). Then, these falsified medical products, which are sources of ionizing radiation and belong to class 2b of danger in terms of exposure to the human body, were delivered to four district hospitals of the Tomsk region, where when they were accepted and put into operation, their compliance with the technical specifications and information of the registration dossier of Roszdravnadzor was revealed, - said in a message SC Tomsk region.

Vladislav Rasteryaev does not admit his guilt, considering the case initiated on formal grounds in the absence of the corpus delicti itself. He said that the reason for initiating the case was a mistake made in the sticker when marking the equipment, as well as outdated technical conditions remaining in the registration file. According to him, the case lacks an examination that can confirm or refute the thesis of the investigation about the falsification of the delivered X-ray devices, and the investigation refused to conduct its own study. He connects criminal prosecution with the redistribution of spheres of influence in the medical equipment market in the region.

The UK reported that a large-scale set of investigative and operational measures was carried out in the criminal case, including in Moscow and the Moscow Region: interrogations of hospital workers, employees of the joint-stock company, supplier firms. Searches and seizures were carried out in these organizations, documentation relevant to the criminal case was seized. The evidence collected became the basis for charging the Deputy General Director for Medical Equipment of the joint-stock company with the commission of this crime.[1]

Initiation of proceedings due to the supply of unregistered X-ray scanners for 28 million rubles

In early April 2021, the prosecutor's office of the Tomsk region announced the initiation of a criminal case due to the supply of unregistered X-ray scanners in the amount of 28 million rubles.

It was established that as part of the execution of contracts concluded with health care institutions, entrepreneurs delivered two radiographic devices worth 14 million rubles each that did not meet the requirements of technical documentation. So, the characteristics and components of the supplied equipment are different from those provided for by the registration certificate and have signs of unregistered medical products, the circulation of which is prohibited by law, the regional prosecutor's office said.

The agency sent the inspection materials to the investigating authorities, which opened a case under Part 1 of Art. 2381 of the Criminal Code (sale of unregistered medical devices). At the same time, neither the name of the supplier of unregistered medical equipment nor the medical organizations that received this equipment are disclosed.

In the Tomsk region opened a case due to the supply of unregistered X-ray scanners for 28 million rubles

In March 2021, the prosecutor's office of the Tomsk region approved the indictment in a similar case under Part 1 of Art. 238.1 of the Criminal Code.

According to investigators, from October 2018 to January 2019, the deputy director of one of the enterprises producing complex technical products organized the production and supply of four radiographic devices worth 56 million rubles to clinics in the Tomsk Region. Medical equipment was provided with falsified information about its characteristics and manufacturer. The discrepancy was revealed during the acceptance of equipment to medical institutions, in connection with which the customer did not pay for deliveries.

The accused pleaded not guilty. It is assumed that the case will be considered by the Pervomaisky District Court of the Tomsk Region.[2]
