2023: Refusal of the product by state customers
At the end of December 2023, it became known that the Moscow company Biem Group Integrator filed lawsuits against customers of its interactive BM Stark Baikal panels based on Russian Baikal processors. It is alleged that buyers refuse to accept these products due to some external pressure.
According to CNews, in June 2023, the State Budgetary Institution of the city of Moscow, the Territorial Center for Social Services, represented by a number of its branches (Zelenogradsky, Timiryazevsky, Yaroslavsky, etc.), signed nine contracts with Biem Group Integrator for the purchase of BM Stark Baikal panels. However, in August and September of the same year, the system integrator Nekstgen initiated an external check of the delivered goods. At the same time, as noted, such a procedure under the procurement law should be initiated by the customer. The check was carried out by the All-Russian Research Institute of Radio Electronics (VNIIR).
The examination revealed in the design of the BM Stark Baikal "many parts produced in China, including the motherboard." It was also found that the installation of the internal elements was not carried out by the factory method, which indicates "possibly not serial production of the product." Thus, it was concluded that the product does not meet the requirements of the terms of reference. After that, state customers began to refuse to accept interactive panels.
In turn, the company "Biem Group Integrator" appealed to the court and the prosecutor's office. It is alleged that a certain Alexander Manyakin, who is the head of the procurement department of the centralization of the network of territorial social services centers of the Moscow Department of Labor and Social Protection, "inexplicably decided to conduct an independent examination of the delivered goods." To do this, he attracted an "interested company of competitors" - Nekstgen LLC (an integrator supplying electronics, including audio and video solutions). The latter in 2023 concluded five contracts with branches of territorial centers of social services in Moscow (customers under an agreement with Biem Group Integrator) in the amount of 6 million rubles.
Biem Group Integrator has filed six lawsuits against customers. By the end of December 2023, verdicts were issued on two of them: the court decided to declare the decision of the Moscow Social Centers State Budgetary Institution and the Alekseevsky Social Services Center to unilaterally terminate the contract for the supply of panels illegal and ordered the acceptance of equipment.[1]
