2024: Kyrgyz authorities approve digital code

The Jogorku Kenesh Committee on Constitutional Legislation in early December 2024 approved the draft Digital Code of Kyrgyzstan, aimed at creating a unified legal framework for regulating the country's digital space. The document is designed to ensure the protection of the rights of citizens and the development of the digital economy.

According to the Economist, together with the main document, parliamentarians approved bills on the introduction of the code into force and the introduction of relevant amendments to the legislative acts of the republic. Deputy Minister of Digital Development Rakhat Zhusumambetova noted that the code establishes balanced rules of conduct in the digital environment.

Kyrgyz authorities approve digital code

According to the Minister of Digital Development of Kyrgyzstan Talantbek Imanov, the republic has the necessary infrastructure for the implementation of the code. There are 6 million Internet users in the country with a population of 7 million people, with 84% connected to 3G and 4G networks. The mobile penetration rate exceeds 110% of the total population.

The new code implements international standards for the protection of personal data, including the recommendations of the Council of Europe and the provisions of the General Regulation for the Protection of Personal Data (GDPR). A special State Agency for the Protection of Personal Data under the Cabinet of Ministers has been created in the republic.

As part of digitalization, the Digital Documents project has already been introduced in Kyrgyzstan, which allows using electronic versions of documents through a smartphone. The Tunduk platform provides access to government services, and biometric identification is used in elections and banking operations.

Kyrgyzstan may become the first country in the world to adopt a single Digital Code. Similar documents are being developed in Azerbaijan and Kazakhstan. In other countries, including Russia, there are discussions about the need for such codification of digital legislation.[1]

On July 11, 2023, it became known that Kyrgyzstan was the first in the world to develop the so-called Digital Code. The main goal of the initiative is to combine all digital norms into a common legal field.

Talantbek Imanov, Minister of Digital Development of the Kyrgyz Republic, spoke about the project. According to him, the Digital Code will eliminate contradictions and gaps in laws, create a single digital management system, and combine many existing laws and by-laws. It is said that the draft Digital Code is the result of a large-scale analysis of the country's legislation and a study of the best world practices.

The digital code will become a single document, a kind of digital constitution, which should build a harmonious system of public administration in the field of digital technologies and ensure the application of uniform rules for regulating public relations related to the use of digital technologies, "said Imanov.

It is assumed that the implementation of the Digital Code will greatly simplify the lives of ordinary citizens. In addition, the initiative will help improve the system of obtaining digital services and help in providing the population with modern government services. The Digital Code will enshrine the foundations of regulation in the digital environment and determine the bodies responsible for digital governance. There are rules for data - availability, relevance, completeness. The document will contribute to the formation of a management system that does not interfere with the development and emergence of new technologies and services.
