2026: The case of illegal re-registration of a hotel into a residential complex is closed due to the expiration of the statute of limitations

The developer Georgy Deliporanidi was exempted from criminal liability for fraud in the construction of the premium residential complex "Aquatoria" on the Gelendzhik embankment, Kommersant reported in March 2026, [1]. The prosecution argued that the residential facility, declared as a hotel, was erected without permission and legalized through the court. After that, the developer tried to assign a plot under buildings worth 190 million rubles.

The Gelendzhik City Court published a decision in a criminal case against the founder of Stenos LLC Georgy Deliporanidi, accused of attempted particularly large-scale fraud (part 3 of article 30, part 4 of article 159 of the Criminal Code of the Russian Federation) during the construction of the Aquatoria residential complex - the case was closed due to the expiration of the statute of limitations.

As follows from the court order, the developer Stenos in 2007 entered into a lease agreement for a municipal land plot with an area of ​ ​ 2.1 hectares. In 2010, the mayor's office of the resort city issued a permit to the tenant for the construction of the Aquatoria hotel complex.

According to the prosecution, Georgy Deliporanidi entered into a conspiracy with unidentified persons in order to appropriate the rights to the land plot.

"Without a building permit, Deliporanidi, under the guise of building a hotel, organized the construction of a residential apartment building, concluding equity participation agreements with citizens. Then the developer initiated a lawsuit on behalf of equity holders with the aim of introducing an unauthorized object into civil circulation, "the ruling of the Gelendzhik City Court says.

The decision to recognize the rights to premises in the Aquatoria complex as equity holders was made in 2013 by the same Gelendzhik City Court. The defendant in the process was the Gelendzhik mayor's office, which objected to the claims of equity holders, but did not indicate a violation of urban planning regulations and did not give a single argument at all in support of its position. As a result, the controversial object was legalized on the basis of consumer protection norms, the municipality did not challenge the decision.

In 2015, Georgy Deliporanidi organized a change in the type of permitted use of the site from the category "accommodation of a hotel complex" to "multi-storey residential buildings," after which he tried to register ownership of the site worth 190 million rubles. under the residential complex "Aquatoria."

However, according to the prosecution, the attacker could not bring his criminal intent to the end, since Rosreestr refused to register the object.

The latest events in the criminal case against Georgy Deliporanidi took place in early 2016, so the ten-year term for criminal prosecution for fraud has expired.

George Deliporanidi agreed with the termination of criminal prosecution on a non-rehabilitating basis. The court canceled his measure of restraint in the form of a ban on certain actions.
