2022: A court in Samara recovered a record 4.3 million rubles from the hospital for the death of a child

In early May 2022, the Oktyabrsky District Court of Samara recovered 4.3 million rubles from the Bezenchuk Central District Hospital in favor of parents who lost their child due to a medical error. Vedomosti called this fine a record.

According to the investigation, in the fall of 2019, in the maternity ward of the Bezenchuk Central District Hospital, medical workers committed negligence in their work. As a result, Natalya and Alexander Tsurkanov lost their son, because the obstetrician did not prescribe a caesarean section for a long time and began the operation, after which the baby suffered a severe head injury. As soon as the child fell into a coma, he was taken by helicopter to the intensive care unit of Samara. After he died.

The parents of the deceased child Natalya and Alexander Tsurkanov and their two minor daughters appealed to the court with a claim for compensation for moral damage. Initially, the plaintiffs declared the amount of morality for each family member: mother 5 million rubles, father 4 million rubles and two minor daughters 5 million rubles. The representative of the hospital did not agree with the demands of the Turkanov family and demanded to reduce the amount to 300 thousand rubles for the mother and 200 thousand rubles for the father and refuse compensation to the children, indicating that there is no direct evidence of moral damage.

According to Vedomosti, citing a court decision, he admitted that the death of the child due to the actions of the hospital staff caused significant moral suffering to the plaintiffs, "who, as parents and sisters, forever lost the opportunity to see their son and brother." As a result, the defendant was charged 2 million rubles in compensation for moral damage in favor of each of the parents, 200,000 rubles in favor of the eldest daughter and 100,000 rubles in favor of the youngest.^[1]
