2023: FAS reveals cartel in Chelyabinsk at auction for the supply of medical oxygen
The Chelyabinsk Office Federal Antimonopoly Service (FAS) Russia of Russia has established signs of anticompetitive behavior of the two companies in the purchase of medical oxygen by regional medical institutions. The press service of the department announced this on May 15, 2023.
Antimonopolers revealed signs of violations at the purchases in 2022 carried out by the Chelyabinsk City Hospital No. 6, OKB No. 3 and the Chnezhinsky Central Medical Unit No. 15 of the FMBA of Russia. When participating in auctions, business organizations used two anti-competitive models of behavior: "ram" (reducing the price to economically unprofitable for bona fide suppliers) and "the only winner." The case was initiated under the article on cartels, explained in the OFAS in the Chelyabinsk region.
The case was initiated on the grounds of violation of Clause 2, Part 1, Article 11 of the Law on Protection of Competition (prohibition of agreements between business entities selling goods in one commodity market, or between business entities purchasing goods in one commodity market, if such agreements lead or may lead to an increase, decrease or maintenance of prices at auction).
Who received the application is not specified. Companies suspected of a cartel agreement are not named either.
According to the public procurement website, cited by the Delovoy Kvartal publication, City Hospital No. 6 conducted a purchase of liquid oxygen in 2022 with a maximum price of more than 5.1 million rubles, OKB - a purchase of more than 34.2 million rubles, a medical unit in Snezhinsk - two purchases worth 1.5 and 2 million rubles, the second of which was canceled.
The portal adds that in the spring of 2023 this is the third episode of antimonopoly violations in the field of medical public procurement: in March, the South Ural department of the FAS revealed a cartel conspiracy in the auction for the supply of medical equipment in the amount of 737 million rubles. In addition, earlier in 2023 it became known about fraud involving federal companies in the purchase of drugs for Chelyabinsk hospitals.[1]
